AN ORDINANCE OF THE CITY OF DENTON DIRECTING THE INTERIM CITY
MANAGER TO CHANGE THE COMMUNITY DEVELOPMENT BLOCK GRANT
AND HOME INVESTMENT PARTNERSHIP PROGRAM YEAR TO ALIGN WITH THE
CITY’S FISCAL YEAR; APPROVING A THIRD SUBSTANTIAL AMENDMENT TO
THE CITY’S 2020 ACTION PLAN TO IMPLEMENT THE CHANGE TO THE
PROGRAM YEAR; AUTHORIZING THE INTERIM CITY MANAGER TO HANDLE
ALL FISCAL AND ADMINISTRATIVE MATTERS RELATED THERETO; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 20-1265, in July 2020 the City of Denton
(“City”), as a Community Development Block Grant (“CDBG”) Entitlement City and a Home
Investment Partnerships (“HOME”) Participating Jurisdiction, submitted to the U.S. Department
of Housing and Urban Development (“HUD”) an action plan for Housing and Community
Development for allocating the City’s 2020 program year, August 1, 2020 through July 3 1 , 2021,
entitlement funds, program income, and reallocated funding from previous years (the “2020
Action Plan”); and
WHEREAS, the City’s Community Development program year has begun August 1
every year since the inception of the CDBG and HOME programs; and
WHEREAS, the August 1 program year start date does not coincide with the City’s fiscal
year, creating challenges in managing the CDBG and HOME programs; and
WHEREAS, staff issued a request to HUD seeking to align the CDBG and HOME
program year with the City’s fiscal year to automate and enhance financial and data accuracy,
promote effective internal and external communication, and streamline yearly close-out
procedures, and HUD approved such request; and
WHEREAS, to implement the alignment of the program year and City’s fiscal year, staff
is proposing a third substantial amendment to the 2020 Action Plan to extend the 2020 program
year by two months so that it would run from August 1, 2020 through September 30, 2021 (the
“Third Substantial Amendment”); and
WHEREAS, there is no anticipated disruption of services due to this program year
change; and
WHEREAS, the Citizen Participation Plan process and requirements have been met in
connection with the Third Substantial Amendment to the 2020 Action Plan and via approved
HUD waivers allowing use of a 5-day virtual public comment period due to the COVID-19
pandemic; and
WHEREAS, the City Council of the City hereby finds that the change to align the CDBG
and HOME program year with the City’s fiscal year and the Third Substantial Amendment to
the 2020 Action Plan are in the public interest; NOW THEREFORE,
THE couNcn OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this Ordinance
are incorporated herein by reference.
SECTION 2. The Interim City Manager, or their designee, is hereby directed to change
the City’s CDBG and HOME program year from August 1 through July 3 1 to October 1 through
September 30 in order to align the program year with the City’s fiscal year.
SECTION 3. The Third Substantial Amendment to the 2020 Action Plan is hereby
approved.
SECTION 4. The Interim City Manager, or their designee, is hereby authorized to
handle all fiscal and administrative matters related to the alignment of the CDBG and HOME
program year with the City’s fiscal year and the Third Substantial Amendment to the 2020
Action Plan.
SECTION 5. This Ordinance shall become effective immediately upon its passage and
approval.
