GOSSELINK ROCHELLE & TOWNSEND, P.C., AMENDING THE CONTRACT APPROVED
BY THE CITY MANAGER ON MARCH 29, 2021, IN THE NOT-TO-EXCEED AMOUNT OF
$45,500.00; SAID FERST AMENDMENT FOR OUTSIDE COUNSEL IN THE LITIGATION
STYLED “CITY OF DENTON V. ELECTRIC RELIABILITY COUNCIL OF TEXAS, ET AL.,” nq
THE 353RD JUDICLAL DISTRICT COURT, TRAVIS COUNTY, TEXAS; PROviDnqG FOR
THE EXPENDITURE OF FUNDS THEREFOR; AND PROVEDnqG AN EFFECTrvE DATE
(FILE 7711 - PROVEDnqG FOR AN ADDITIONAL FRST AMENDMENT EXPENDITURE
AMOUNT NOT-TO-EXCEED $154,500.00, WITH THE TOTAL CONTRACT AMOUNT NOT-
TO-EXCEED $200,000.00).
WHEREAS, on March 29, 2021, the City Manager awarded a contract Lloyd Gosselink
Rochelle & Townsend, P.C., in the amount of $45,500.00 for ERCOT uplift charges; and
WHEREAS, the additional fees under the proposed First Amendment are fair and reasonable
and are consistent with, and not higher than, the recommended practices and fees applicable to the
Provider’s profession, and such fees do not exceed the maximum provided by law; NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAnqs:
SECTION 1. The First Amendment, increasing the amount ofthe contract between the City
and Lloyd Gosselink Rochelle & Townsend, P.C., which is on file in the office of the Purchasing
Agent, in the amount of One Hundred Fifty-Four Thousand Five Hundred and 0/100 ($ 154,500.00)
Dollars, is hereby approved and the expenditure of funds therefor is hereby authorized in accordance
with said amendment. The total contract amount increases to $200,000.00.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
