21-1328ORDINANCE NO. 21-1328 AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO EXECUTE A RENEWAL LETTER TO EXTEND THE AGREEMENT BETWEEN THE CITY OF DENTON AND THE DENTON CHAMBER OF COMMERCE REGARDING AN ECONOMIC DEVELOPMENT PROGRAM FOR FISCAL YEAR 2021-2022; AUTHORIZING THE EXPENDITURE OF FUNDS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton ("City") and the Denton Chamber of Commerce ("Chamber") entered into an economic development program agreement on September 15, 2020 ("Agreement") for the purpose of providing for a program to promote economic development through joint efforts; and WHEREAS, the City and Chamber developed a work plan for the Chamber Office of Economic Development that aligned with the City's economic development strategies as part of the Agreement; and WHEREAS, the City and Chamber desire to continue joint efforts to execute on the economic development strategies identified in the Agreement; and WHEREAS, Section I of the Agreement allows the City and Chamber to agree to extend the term of the Agreement for one year; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council hereby authorizes the Interim City Manager or her designee to execute a renewal letter, attached hereto as Exhibit A, that extends the term of the Agreement for one additional year. SECTION 2. The City will pay the Chamber $125,000 for Fiscal Year 2021-22 in accordance to the terms outlined in the Agreement, with two payments being made to the Chamber, per Section C of the Agreement, in the amount of $62,500 on or October 31, 2021 and $62,500 on or before April 30, 2022. SECTION 3. This Ordinance shall become effective upon its passage and approval. McKinney St., Denton, TX 76201 • (940) 349-8307 RE: Extension of Denton Chamber of Commerce Program Agreement to Sept. 1, 2022 Dear Erin: 1 have received your written request to renew the Economic Development Program Agreement Between the City of Denton and Denton Chamber of Commerce executed on September 15, 2020 (the "Agreement") for an additional year, per Section 1 of the Agreement. For reference, City of Denton Ordinance 20-1634 authorized the City Manager to execute the Agreement to allow the Denton Chamber of Commerce to operate the Chamber Off -lee of Economic Development, employ a Vice President of Economic Development, raise private funds in support of economic development, and partner on a number of strategic initiatives from October 1, 2020 until September 30, 2021. Under "Section 1. Term of the Agreement" of the executed Agreement, the Agreement can be renewed and extended for an additional one (1) year term if both parties agree to the renewal in writing. The City of Denton agrees to your request for a one-year extension of the Agreement. This letter serves as confirmation of the approval for a one-year extension of the Agreement and establishes a new termination date of September 30, 2022. The fundraising and reporting requirements will remain the same for the additional one-year period. All date references and reporting requirements stated as occurring between October 1, 2020 to September 30, 2021 will apply equally to the same date in the period of October 1, 2021 to September 30, 2022. The City of Denton will pay the Chamber of Commerce $125,000 for Fiscal Year 2021-22 in accordance to the terms outlined in the Agreement, with two payments being made to the Chamber, per Section C of the Agreement, in the amount of $62,500 on or October 31, 2021 and $62,500 on or before April 30, 2022. The Chamber of Commerce will need to provide an updated budget for the Office of Economic Development for FY 2021-22 prior to October 1, 2021.
