PD20-00 X 0a AN ORDINANCE OF THE CITY OF DENTON, TEXAS REGARDING A CHANGE IN THE ZONING DISTRICT AND USE CLASSIFICATION FROM NEIGHBORHOOD RESIDENTIAL 4 (NR4) DISTRICT AND RURAL RESIDENTIAL (RR) DISTRICT TO A PLANNED DEVELOPMENT (PD) DISTRICT ON APPROXIMATELY 7.11 ACRES GENERALLY LOCATED ON THE NORTH SIDE OF EAST MCKINNEY STREET, APPROXIMATELY 1615 FEET EAST OF SOUTH TRINITY ROAD, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; ADOPTING AN AMENDMENT TO THE CITY'S OFFICIAL ZONING MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. (PD20-001 Oa; Light Industrial) WHEREAS, Steve Homeyer of Homeyer Engineering, applied on behalf of the property owner, Star Gaze Investments LLC, for a zoning change from Neighborhood Residential 4 (NR4) District and Rural Residential (RR) District to a Planned Development (PD) District on approximately 7.11 acres of land, legally described and depicted in Exhibit "A" (hereinafter, the "Property"); and WHEREAS, on September 22, 2021, the Planning and Zoning Commission, in compliance with the laws of the State of Texas, have given the requisite notices by publication and otherwise, and have held due hearings and afforded full and fair hearings to all property owners interested in this regard, and have recommended approval (7-0) of the amendment; and WHEREAS, on October 19, 2021, the City Council likewise conducted a public hearing as required by law, and finds that the request meets and complies with all substantive and procedural standards for a zoning change to PIanned Development (PD) District set forth in Section 2.7.3 of the Denton Development Code, and is consistent with the Denton Plan 2030 and the Denton Development Code; and WHEREAS, the Planning and Zoning Commission and the City Council of the City of Denton, in considering the application for a change in the zoning classification of the property, have determined that the proposed use is in the best interest of the health, safety, morals, and general welfare of the City of Denton, and accordingly, the City Council of the City of Denton is of the opinion and finds that said zoning change is in the public interest and should be granted as set forth herein; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. The zoning district and use classification for the Property is hereby changed from Residential Rural (RR) and Residential 4 (R4) Districts to Planned Development (PD) District. The Development Standards for the Property are described in Exhibit "B" attached hereto and incorporated herein by reference, and the PD Development Plans depicting the proposed development layout for the Property is provided in Exhibits "C" through "E" attached hereto and incorporated herein by reference. Development of the Property shall be in accordance with the Development Standards in Exhibit "B" and the Development Plans in Exhibits "C" through "E". SECTION 3. The City's official zoning map is hereby amended to show the change in the zoning district and use classification. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person, firm, partnership or corporation violating any provision of this ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record - Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage. Building Coverage — 60 % (Maximum) Site Design Requirements The existing landscaping, parking and screening shall remain as -is. All future development shall be designed in accordance with these standards and with DDC Section 7.2.2. Location of Off -Street Loading Areas Section 7.9.7.B of the DDC shall be revised to remove the LI exception as it relates to this property. All existing loading spaces are exempt from this requirement. Future loading areas may be permitted in the rear and side yard only. Any future loading area must be screened from all rights-of-way, residential uses and residential zoning districts Landscape Landscape requirements for future improvements shall comply with DDC Subsection 7.7.5 Expansion and Redevelopment Any expansions and redevelopment within 400 feet of the ROW must conform to the Site and Building Design standards in DDC Section 7.10. The exemption for industrial uses in DDC Section 7.10.5A.2a would be revised to 400 feet replacing 250 feet to be read as (a. Any additional structures that would require more parking for the new structure will conform to DDC parking standards. Future Conditions: Parking requirements shall comply with DDC Subsection 7.9.4 Screening All walls, fences, and screening requirements shall comply with DDC Subsection 7.7.8 Any change in use will require that all Accessory Outside Storage comply with DDC Section 5.4.3F and shall be screened with an 8 -foot opaque fence or landscaping as proposed on the attached site plan.
