AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO
EXPEND FUNDS FOR PAYMENT BY THE CITY TO THE TEXAS COMMISSION ON
ENVIRONMENTAL QUALITY FOR THE ANNUAL CONSOLIDATED WATER QUALITY
FEE FOR OPERATION OF THE PECAN CREEK WATER RECLAMATION PLANT; AND
PROVIDING AN EFFECTIVE DATE (CONSOLIDATED WATER QUALITY FEE IN THE
TOTAL NOT -TO -EXCEED AMOUNT OF $127,000.00).
WHEREAS, Section 26.0291 of the Texas Water Code requires each wastewater
discharge permit holder to pay a Water Quality Fee to the Texas Commission on Environmental
Quality ("TCEQ") in order for the State to cover costs of inspections and enforcement of the
Water Code with respect to wastewater facilities; and
WHEREAS, the City of Denton operates the Pecan Creek Water Reclamation Plant
within the City and holds a wastewater discharge permit for such operation; therefore, the City
of Denton is required to pay such annual water quality fee imposed by the TCEQ; and
WHEREAS, the Interim City Manager recommends that the City Council approve and
authorize the payment of these required fees to continue wastewater plant operation; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1. The recitals contained in the preamble of this ordinance are true and correct
and are incorporated into the body of this ordinance as if fully set out herein.
SECTION 2. The expenditure of funds in an amount not to exceed $127,000.00 is
authorized to be paid to the Texas Commission on Environmental Quality for the required annual
water quality fee upon receipt of the annual invoice, which is typically received in December.
SECTION 3. This Ordinance shall become effective immediately upon its passage and
approval.
