AN ORDINANCE OF THE CITY OF DENTON AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES BY ADDING ARTICLE XII. HISTORIC LANDMARK COMMISSION,SECTION 2-287; SECTION 2-288; SECTION 2-289; AND SECTION 2-290; AND PROVIDiNGAN EFFECTIVE DATE. WHEREAS, on October 1, 2019, the Denton Development Code (the DDC) became effective; and WHEREAS, in order to establish and maintain the committee member composition of the Historic Landmark Commission in a more efficient manner, solicit and maintain committee membership to include the highest number of diverse and expert members, enhance governmental efficiency and facilitate expedient appointment of future committee member vacancies, the City Council deems it in the public interest to amend Chapter 2, of the Code of Ordinances by addingArticle XII, Section 2-287; Section 2-288; Section 2-289; and Section 2-290, NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON ORDAINS : SECTION 1. The Code of Ordinances, Denton, Texas is hereby amended by amending Chapter 2, by adding Article XII., Historic Landmark Commission; and which said Article shall readas follows: “Article XII -Historic Landmark Commission Sec. 2-287. -Reserved Sec. 2-288.- Creation, members qualifications, and tenure (a) There is hereby established and created a Historic Landmark Commission. All prior decisions of the prior Historic Landmark Commission are hereby ratified and confirmed. (b) The Historic Landmark Commission shall be composed of seven (7) members who are residents of the City of Denton. Four members shall constitute a quorum. At least five (5) members shall be required to represent one of the following memberships, qualifications, or professions listed in Subsection (c) to meet the 60 percent requirement provided by the National Park Service Certified Local Government (CLG) program as administered by the State of Texas Historical Commission (THC). The commission membership requirements listed in Subsection (c) may be waived if the City can provide written documentation to the Texas Historical Commission (THC) that it has made a reasonable effort to fill those positions. (c) As a participant of the CLG program, the City of Denton is required to maintain a qualified review commission, board, or committee for historic preservation of which at least 60 percent of commission membership shall be drawn from the preservation related professions defined by the National Park Service listed below. The CLG program serves to empower local communities to better protect historic resources by identifying local priorities, meeting recognized historic preservation standards and providing access to financial and technical Page 1 of 4 services to further the identification, evaluation, designation and protection of buildings, sites, districts, structures, and objects. Denton County Historical Commissioners who are residents of theCity of Denton are encouraged where possible for synergy between City and County efforts. The list of memberships, qualifications, or professions are: • • • • • • • • • • Architecture; History ; Architectural History ; Planning; Prehistoric and Historic Archaeology;Folklore: Cultural Anthropology ; Curation; Conservation; or Landscape Architecture. (d) To maintain historical knowledge of the Historic Landmark Commission, terms of office of commission members shall be staggered and of at least two years duration. Term of each of the positions shall expire and renew as follows: • • • • • • • District 1 Commissioner’s term shall expire in 2022, and renew every even year as follows District 2 Commissioner’s term shall expire in 2022, and renew every even year as follows District 3 Commissioner’s term shall expire in 2023, and renew every odd year as follows District 4 Commissioner’s term shall expire in 2023, and renew every odd year as follows District 5 Commissioner’s term shall expire in 2022, and renew every even year as follows District 6 Commissioner’s term shall expire in 2023, and renew every odd year as follows District 7 Commissioner’s term shall expire in 2022, and renew every even year as follows (e) For District 3, the current appointee will be held over until August 31, 2023, at which time the current appointee would still be eligible for one more term appointment unless the appointee resigns or is removed for cause. (f) For District 4, the current appointee will be held over until August 31, 2023, unless the appointee resigns or is removed for cause. The current appointee will not be eligible for reappointment due to having served three full terms at that time. (g) As part of the CLG program, all commission members must attempt to remain current concerning historic preservation issues and techniques. At least once a year, one or more commission members must attend a THC led or THC approved training. (h) The City of Denton Council shall act within 60 days to fill a vacancy, including expired terms. (i) As part of the CLG program, the Historic Landmark Commission must meet no less than six tImes a year. Page 2 of 4 a) All provisions of the Denton Development Code, Subchapter 2., Section 2.3.6 Parts B and C shall remain applicable to the Historic Landmark Commission. Sec. 2-289. ReservedSec. 2-290. Reserved” SECTION 2. All prior ordinances, resolutions, amendments, policies, or guidelines thatconflict with this amendment are hereby rescinded and repealed in whole or in part to the extent necessary to give full effect to this amendment. SECTION 3. All other portions of the Code of Ordinances shall remain in effect. SECTION 4, The findings and recitation contained in the preamble of this ordinance are incorporated herein by reference. SECTION 5. This ordinance shall become effective immediatejy UDon its oassage and approval.
