AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TOEXPEND FUNDS FOR PAYMENT BY DENTON MUNICIPAL ELECTRIC TO THE
NORTH AMERICAN ELECTRIC RELIABILITY CORPORATION (NERC) ACTINGTHROUGH THE TEXAS RELIABILITY ENTITY, INC. FOR THE PAYMENT OF FEESAND/OR ASSESSMENTS BY THE TEXAS RELIABILITY ENTITY, INC.; AND
PROVIDING AN EFFECTIVE DATE (TEXAS RELIABILITY ENTITY, INC. FEE IN THE
TOTAL NOT-TO-EXCEED AMOUNT OF $150,000.00).
WHEREAS, Section 215(e)(4) of the Federal Power Act delegated the authority of
NERC to the Texas Reliability Entity, Inc. to become the regional entity for the ERCOT region;and
WHEREAS, Denton Municipal Electric operates within the ERCOT region and as such
is subject to the NERC and Regional Reliability Standards of the Texas Reliability Entity, Inc.;and
WHEREAS, the City Manager recommends that the City Council approve and authorize
the payment of these required fees and/or assessments as part of the Denton Municipal Electric
obligations to NERC and the Texas Reliability Entity, Inc.; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1. The recitals contained in the preamble of this ordinance are true and correct
and are incorporated into the body of this ordinance as if fully set out herein.
SECTION 2. The expenditure of funds in an amount not to exceed $150,000.00 is
authorized to be paid to the Texas Reliability Entity, Inc. under the authority delegated by the
Federal Power Act for the required fees and/or assessments. This Ordinance also delegates
authority to the Denton Municipal Electric General Manager to execute any required
documentation in connection with such payment.
SECTION 3. This Ordinance shall become effective immediately upon its passage and
approval
