AN ORDINANCE OF THE CITY OF DENTON APPROVING A SUBSTANTIALAMENDMENT TO THE CITY’S 2021 ACTION PLAN FOR HOUSING AND COMMUNITY
DEVELOPMENT; AUTHORIZING THE CITY MANAGER TO SIGN AND SUBMIT THESUBSTANTLAL AMENDMENT 1; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton is concerned with the development of viable urban
communities, including decent housing, a suitable living environment and expanded economic
development opportunities; and
WHEREAS, the City of Denton has an interest in expanding access to affordable housing
for persons of low and moderate income; and
WHEREAS, in the City’s 2021 Action Plan for Housing and Community Development
(the “Action Plan”), $402,327 of Community Development Block Grant (CDBG) funding was
approved to be paid to Grace Like Rain and $100,000 of HOME Investment Partnership Program
(HOME) funding was approved to be paid to the Denton Affordable Housing Corporation for
programs to expand access to affordable housing; and
WHEREAS, on October 29, 2021, Grace Like Rain notified the City that it cancelled its
program, freeing up the CDBG funds it had been allocated; and
WHEREAS, on January 20, 2022, Denton Affordable Housing Corporation submitted a
request to the city to change the use of the HOME funds it had been allocated; and
WHEREAS, reallocating the CDBG funds and changing the use of the HOME funds will
serve the purpose of expanding affordable housing for persons of low and moderate income in the
City of Denton; and
WHEREAS, citizen participation requirements, including a 30-day comment period, have
been met; and
WHEREAS, the City of Denton, as a recipient of Community Development Block Grant
(CDBG) funding under the Housing and Community Development Act of 1974, as amended, and
the National Affordable Housing Act of 1990, as amended, has developed, using a citizen
participation process, a substantial amendment to the Action Plan for the reallocation of $402,327
in CDBG funds and the change of use of $100,000 of HOME funds; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS;
SECTION 1. The findings and recitations contained in the preamble of this Ordinance are
incorporated herein by reference.
SECTION 2. The City Manager, or their designee, is authorized to submit to the U.S.
Department of Housing and Urban Development the Substantial Amendment to the City’s 2021
Action Plan for Housing and Community Development reallocating $402,327 in CDBG funds and
changing the authorized use of $100,000 in HOME funds;
SECTION 2. The City Manager or their designee is authorized to distribute funds and
undertake any administrative actions necessary to implement the amended Action Plan; and
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval.
