AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING THE APPROVAL OFCHANGE ORDER NO. 1 TO THE EXISTING ADVANCE FUNDING AGREEMENTBETWEEN THE CITY OF DENTON AND THE TEXAS DEPARTMENT OF
TRANSPORTATION (TXDOT) FOR RELOCATION OF PUBLIC UTILITY FACILITIESALONG FM 2181 FROM LILLIAN MILLER PARKWAY TO WEST OF FM 2499 IN CITY OF
DENTON, DENTON COUNTY, TEXAS; PROVIDING AN EFFECTIVE DATE (2054-02-015) –CHANGE ORDER NO. 1 1N AN AMOUNT NOT TO EXCEED THE SUM OF $56,907.78 FOR
A TOTAL CONTRACT AMOUNT AGGREGATED TO ($2,216,736.81); AUTHORIZING THEEXPENDITURE OF FUNDS THEREFOR; AND PROVDDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton (the "City") and the Texas Department of Transportation
("TxDOT'’) entered into an Advance Funding Agreement for relocation of existing water mains,
wastewater mains and associated appurtenances along FM 2181 from Lillian Miller Parkway to
West of FM 2499 in the City of Denton, Denton County, due to the
widening of a 2-lane rural roadway to a 6-land divided urban roadway; and
WHEREAS, Additional work is required by TxDOT to complete the agreed upon scope of
the project; and
WHEREAS, The City of Denton is responsible for the financial portion of the additional
work; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this
Ordinance are incorporated herein by reference.
SECTION 2. Change Order No. 1, increasing the amount if the contract between the City and
Texas Department of Transportation in the amount of Fifty Six Thousand, Nine Hundred and Seven
and 78/100 Dollars ($56,907.78), is hereby approved and the expenditure of funds therefore is hereby
authorized in accordance with said change order. The total purchase order amount increases to
($2,216,736.81)
SECTION 3. The City Manager, or their designee, is hereby authorized to carry out the
rights and duties of the City under the Advance Funding Agreement, including the expenditure
of funds provided for therein.
SECTION 4. This Ordinance shall become effective immediately upon its passage
and approval.
