22-1269ORDiNANCE NO. 22-1269 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS FORVEHICLE PURCHASES FOR FLEET SERVICES FOR A PERIOD OF THREE (3) YEARS;PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING ANEFFECTIVE DATE. WHEREAS, the City of Denton (the “City”) routinely purchases vehicles through Fleet Services and the Purchasing Department; and WHEREAS, the supply chain issues have created issues for Fleet Services and their current procured contracts; and WHEREAS, the City Council of the City of Denton (the “City Council”) recognizes that an alternative method of vehicle purchasing is required for a period of time not to exceed three (3) years; and WHEREAS, the City budgets annually for vehicle purchases associated with the delegated authority requested hereby; and WHEREAS, the City Council recognizes that Fleet Services needs to be able to purchase vehicles via dealer inventory, lease-to-own opportunities, and unclaimed allocations from non- contracted sources; and WHEREAS, the City Council has determined that it is in the public interest to authorize the City Manager, or their designee, to execute contracts and expend budgeted funds to purchase vehicles for the City utility and public safety departments through Fleet Services; NOWTHEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The recitations contained in the preamble of this ordinance are incorporated herein by reference as findings of the City Council. SECTION 2. The City Council approves and authorizes the City Manager, or their designee, to execute contracts and expend budgeted funds to purchase vehicles for the City utility and public safety departments through Fleet Services, where such funds are available in the budget, without further authority, guidance, or direction from the City Council, and is further authorized to carry out the rights, duties, obligations, and responsibilities of the City related thereto. SECTION 3. The City Council approves and authorizes the City Manager, or their designee, to take such additional actions as the City Manager, or their designee, determines to be necessary and advisable to continue to effectuate the purpose, terms, and conditions of vehicle purchases. SECTION 4. Fleet Services and Purchasing will utilize every effort to make purchases using City of Denton contracts, co-operative contracts, or other city contracts with piggy back options prior to making any emergency purchases under Local Government Code 252. To the extent such a procured contract is not available, and an emergency purchase is required to protect the health and safety of City of Denton residents, Fleet Services, Procurement, and the City Attorney’s Office will prepare an emergency declaration that will detail why the purchase had to go outside of the normal procurement process and how health and safety are at issue. SECTION 5. Fleet Services will provide a report to City Council in the Friday Report, or other appropriate method, regarding any vehicles purchased with this authority, the cost, any markup or discounts received, and a running total of each department’s vehicle budget as the fundsare used. SECTION 6. This ordinance shall become effective immediately upon its passage and approval and shall expire three (3) years after its passage.
