22-1985ORDiNANCE NO. 22-1985 AN ORDINANCE OF THE CITY OF DENTON ESTABLISHING CLASSIFICATIONS ANDPOSITIONS rN THE DENTON FIRE DEPARTMENT; CREATING AND ELIMINATINGCERTAIN POSITIONS; REPEALING ORDINANCE NO. 22-957 RELATING TOESTABLiSHrNG THE CLASSIFICATIONS AND PRESCRIBING THE NUMBER OFPOSITIONS IN EACH CLASSIFICATION FOR THE DENTON FIRE DEPARTMENT:PROVIDING REPEALER, CUMULATIVE, AND SEVERABILITY CLAUSES; ANDDECLARING AN EFFECTIVE DATE. WHEREAS, pursuant to Section 143.021, Texas Local Government Code, the City Council of the City of Denton, is required by ordinance to prescribe the number of positions in each classification for Fire Department personnel; and WHEREAS, on May 3, 2022, the City Council passed Ordinance No. 22-957 adopting andapproving a schedule of Authorized Positions relating to classification of fire fighters; and WHEREAS, since the passage of Ordinance No. 22-957, the Fire Department has updated the titles and number of positions designated for certain classifications of Fire Department personnel, and have submitted the revisions to the City Council for review and approval based on the Department’s determination that these changes are in the Department’s best interest; and WHEREAS, the City Council has considered these updated classification titles and numbers and has found these changes to be in the City’s best interest and accordingly has determined that Ordinance No. 22-957 should be repealed and the following classification titles and total number of positions in the Fire Department should be adopted; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Ordinance No. 22-957 is hereby repealed. SECTION 2. The City Council hereby adopts and approves the following civil service classifications of the Denton Fire Department and the number of positions in each classification is established as follows: (A)(B)(C)(D) (E)(F) (G)(H) (1)(J)(K)(L) Assistant Fire Chief Assistant Fire Chief/Fire Marshal Battalion Chief – OperationsAssistant Fire Marshal Fire Community Services OfficerFire Training Captain 1 1 9 1 1I 1 28 1 54 2 7 EMS Captain Captain – OperationsDeputy Fire Marshal IIIDriver Deputy Fire Marshal II Deputy Fire Marshall I Page 1 (M) Emergency Management Program Manager (N) Firefighter I 97 TOTAL: 205 SECTION 3. The number of positions in the civil service classification of Captain Operations - in Section 2 of this ordinance is an increase of three (3) from the number in existence immediately before the effective date of this ordinance. SECTION 4. The number ofpositions in the civil service classification of Driver in Section 2 of this ordinance is an increase of five (5) from the number in existence immediately before the effective date of this ordinance. SECTION 5. The number of positions in the civil service classification of Deputy Fire Marshall I in Section 2 of this ordinance is an increase of one (1) from the number in existence immediately before the effective date of this ordinance. SECTION 6. The number of positions in the civil service classification of Firefighter in Section 2 of this ordinance is a decrease of three (3) from the number in existence immediatelybefore the effective date of this ordinance. SECTION 7. This ordinance shall be cumulative of all provisions of ordinances of the City of Denton, except where the provisions of the ordinance are in direct conflict with the provisions such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 8. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance, shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such urlconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. Section 9. This ordinance shall become effective immediately upon its passage and approval as provided by law.
