22-2455ORDINANCE NO. 22-2455 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOW-RULE MUNICIPALCORPORATION, AUTHORIZING THE CITY MANAGER TO SIGN A MEDICAL OFFICEBUILDRqG LEASE AND FIRST AMENDMENT TO MEDICAL OFFICE BUILDING LEASEBY AND BETWEEN THE CITY OF DENTON AND EPIC DEVELOPbaNT, INC. FOR THEUSE AND OCCUPANCY OF PREMISES AT 3537 SOUTH 1-35E, DENTON, TEXAS 76210FOR THE CITY OF DENTON EMPLOYEE HEALTH CENTER FOR A TTREE (3) YEARPERIOD; AUTHORIZING TIE EXPENDITURE OF FUNDS THEREFOR (WITH A ONE-YEAR COST OF $72,216.00, AND A THREE (3) YEAR NOT-TO-EXCEED AMOUNT OF $223,300.00); AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Denton (“City”) operates an Employee Health Center to provide services to its employees, retirees, and family members (ages 2 and up) who are covered by a City health plan; and WHEREAS, the City has previously entered into lease agreements withEpic Development, Inc. (“Epic”) to lease space at 3537 South 1-35E, Denton, Texas 76210 (the “Medical Center”) forthe use and occupancy of space to house the City’s Employee Health Center; and WHEREAS, Epic has offered the City a three (3) year Medical Office Building Lease (the “Lease”) beginning January 1, 2023 through a First Amendment to Medical Office Building Lease (the “First Amendment”); and WHEREAS, the lease rates under the proposed First Amendment are fair and reasonable based upon an independent market analysis performed in April 2022; and WHEREAS, the City Council deems it is in the public interest to enter into the Lease and First Amendment to secure space at the Medical Center for the Employee Health Center for three(3) years; NOW, THEREFORE, TIU COUNCIL OF THE CITY OF DENTON HEREBY ORDAnqs: Section 1. The findings and recitations contained in the preamble of this Ordinance areincorporated herein by reference. Section 2. The City Manager, or their designee, is hereby authorized to execute the Lease and First Amendment, both attached hereto and incorporated herein by reference, and to carry out the duties and responsibilities of the City under the Lease and First Amendment. Section 3. The City Manager, or their designee, is authorized to expend such funds and perform such obligations as required in the Lease and First Amendment. Section 4.
