AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TOEXECUTE AND DELIVER TO ATMOS ENERGY CORPORATION A TEMPORARY
CONSTRUCTION EASEMENT CONTAINING AN APPROXIMATE TOTAL OF 138,050.00SQUARE FEET (3.169 ACRES) LOCATED NEAR MAYHILL ROAD IN THE CITY ANDCOUNTY OF DENTON, TEXAS; PROVIDING FOR SEVERABILITY; AND PROVIDINGAN EFFECTIVE DATE.
WHEREAS, Atmos Energy Corporation (“ATMOS”) has requested that the City of
Denton (“City”) extend the grant to ATMOS of a temporary construction easement as attached
hereto as Exhibit 1 and incorporated herein for all purposes (collectively, the “TemporaryConstruction Easement“) encumbering approximately 138,050.00 square feet (3.169 acres) as
more particularly described and depicted in Exhibit “A“ to Exhibit 1, located near Mayhill Road
in the City and County of Denton, Texas, for installation and construction of an underground gas
line and all necessary or desirable appurtenances; and
WHEREAS, ATMOS paid the agreed compensation amount of One Thousand Five
Hundred Eighty-Four Dollars and 50/100 for the original Temporary Construction Easement;and
WHEREAS, the City is willing to extend the grant to ATMOS the Temporary
Construction Easement for a period of up to six months to complete the construction project; and
WHEREAS, the City Council hereby finds the easement extension to ATMOS willbenefit and serve the public; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings set forth in the preamble of this Ordinance are incorporated by
reference into the body of this Ordinance as if fully set forth herein.
SECTION 2. The City Manager, or designee, is authorized to execute and deliver to
ATMOS the Temporary Construction Easement attached hereto as Exhibit 1.
SECTION 3. If any section, article, paragraph, sentence, phrase, clause, or word in this
Ordinance, or application thereof to any persons or circumstances, is held invalid or
unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of
the remaining portions of this Ordinance; the City Council declares that it would have ordained
such remaining portion despite such invalidity, and such remaining portion shall remain in fullforce and effect.
SECTION 4. This Ordinance shall become effective immediately upon its passage and
approval.
