AN ORDINANCE OF THE CITY OF DENTON STATING ITS INTENT TO REQUESTFINANCIAL ASSISTANCE FROM THE TEXAS DEPARTMENT OF TRANSPORTATION
FOR AIRPORT IMPROVEMENTS; AUTHORIZING THE CITY MANAGER TO ACCEPT ONBEHALF OF THE CITY AN OFFER FROM THE TEXAS DEPARTMENT OF
TRANSPORTATION (“TxDOT”) RELATING TO A GRANT OF $607,700 FOR DESIGNCOSTS WITH THE CITY RESPONSIBLE FOR TEN PERCENT OF TOTAL PROJECT
COSTS; REQUIRING THE CITY TO PROVIDE $60,770 1N CONTRIBUTORY FUNDS FORDESIGN OF THE ANTICIPATED IMPROVEMENTS TO COMPLETE THE RUNWAYRECONSTRUCTION PROJECT AT THE DENTON ENTERPRISE AIRPORT WITH AN
ESTIMATED TOTAL PROJECT COST OF $19,888,000; AND PROVIDING FOR ANEFFECTIVE DATE.
WHEREAS, the City of Denton (“City”) intends to make certain improvements to the
runway at the Denton Enterprise Airport; and
WHEREAS, the project generally consists of design and construction of reconstruction
improvements for the runway (the “Project”); and
WHEREAS, the City intends to request financial assistance from the Texas Department ofTransportation (“TxDOT”) for the Project; and
WHEREAS, the total Project cost is estimated to be $19,888,000.00 with the City’s
contribution estimated to be $1,988,000.00, calculated as follows:
• Design cost is estimated to be $607,700, and the City will be responsiblefor 10% of the design project costs currently estimated to be $60,770, and
• Construction cost is estimated to be $19,280,300, and the City of Denton
will be responsible for 10% of the total construction costs currently
estimated to be $1,928,030.
WHEREAS, the Airport Advisory Board on December 14, 2022 voted to recommend
Council approval by a vote of 7 - 0; and
WHEREAS, the City of Denton names TxDOT as its agent for the purposes of applying
for, receiving, and disbursing all funds for these improvements and for the administration of
contracts necessary for the implementation of these improvements; and
WHEREAS, the City of Denton hereby directs the Airport Director to execute on behalf of
the City of Denton, at the appropriate time, and with the appropriate authorizations of this
governing body, all contracts and agreements with the State of Texas, represented by the Texas
Department of Transportation, and such other parties as shall be necessary and appropriate for theimplementation of the improvements at Denton Enterprise Airport; NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:

SECTION 1. The findings and recitals contained in the preamble of this ordinance are
incorporated herein by reference as true and as if fully set forth in the body of this ordinance.
SECTION 2. The City of Denton hereby authorizes the City Manager, or their designee,
to execute on behalf of the City all contracts and agreements with the State of Texas, represented
by TxDOT, for the financial assistance and implementation of the Project at the Denton Enterprise
Airport
SECTION 3. The City Manager, or their designee, is further authorized to carry out all
duties and responsibilities to be performed by the City under the offer for the completion of theProject, including, but not limited to, the expenditure of funds.
SECTION 4. This ordinance shall become effective immediately upon its passage and
approval.
