AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGERTO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF DENTONAND UNIVERSITY OF NORTH TEXAS, A HIGHER EDUCATION AGENCY OF THE
STATE OF TEXAS (UNT), FOR THE NORTH TEXAS BOULEVARD WIDENING ANDIMPROVEMENTS AT APOGEE STADIUM CONSTRUCTION PROJECT.
WHEREAS, The City of Denton (“City”) and University of North Texas (“UNT“) mutually
desire to enter into an interlocal agreement as provided for in Chapter 791.032 of the TexasGovernment Code; and
WHEREAS, CITY has been provided funding from North Central Texas Council of
Governments (“NCTCOG”) to widen North Texas Boulevard from the 1-35E Service Road to theUNT Stadium access road, matching the alignment of the North Texas Boulevard overpass
constructed by the Texas Department of Transportation (TxDOT); and
WHEREAS, CITY and UNT desire to complete the project in order to provide better
ingress/egress between the stadium and 1-35E; and
WHEREAS, UNT has authorized the donation of the needed street right-of-way to the
City through a Street Right of Way Deed as well as the additional area needed to construct the
project through a Temporary Construction Easement; and
WHEREAS, the CITY, in exchange for the Street Right of Way Donation Deed and the
Temporary Construction Easement agrees to provide within the construction of the project, tree
mitigation and irrigation; and
WHEREAS, the City Council having considered the importance of the project to the citizens
of Denton and finding that it is in the public's health and safety interest, is of the opinion that it
should approve the Agreements;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitals contained in the preamble of this ordinance are hereby
incorporated into the body of this ordinance are true and correct.
SECTION 2. The City Council hereby approves and authorizes the City Manager to
execute the Interlocal Agreement for the North Texas Boulevard Widening and Improvements
Construction Project
SECTION 3. The City Manager, or their designee, is further authorized to carry out all
obligations and duties of the City as set forth in the Agreements, including but not limited to the
expenditure of funds.
SECTION 4. That this ordinance shall become effective immediately upon its passage
and approval.
