AN ORDINANCE ORDERING A RECALL ELECTION TO BE HELD IN THE CITY OFDENTON ON MAY 6, 2023, FOR THE PURPOSE OF DETERMINING WHETHER CITYCOUNCIL MEMBER JESSE DAVIS SHALL BE REMOVED FROM DISTRICT 3 SEAT OF THECITY COUNCIL BY RECALL; PRESCRIBING THE TIME, MANNER, AND CONDUCT OFTHE ELECTION IN ACCORDANCE WITH AN ELECTION AGREEMENT AND CONTRACT
FOR ELECTION SERVICES WITH THE ELECTION ADMINISTRATOR OF DENTON
COUNTY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on January 20, 2023, a petition seeking the Recall of City Council Member
Jesse Davis was filed with the City Secretary; and
WHEREAS, within seven days of the filing of the petition in accordance with Section 4.13
of the City Charter, the City Secretary examined the petition, and on February 7, 2023 submitted
her certificate stating the petition was sufficient and in compliance with the provisions of Article
IV Initiative, Referendum and Recall ofthe City Charter; and
WHEREAS, Council Member Jesse Davis did not resign his office and in order to comply
with the requirements ofthe Recall Election provisions ofthe City Charter, the Texas Election Code,
and other applicable provisions of the law, it is necessary to order a Recall Election; NOWTHEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. That a municipal Recall Election is ordered to be held in the City of Denton,
Texas, on Saturday, May 6, 2023, such date being a uniform election date as defined in Texas
Election Code §41.001, for the purpose of determining whether Council Member Jesse Davis shall
be removed from the City Council by Recall.
SECTION 2. That the City Secretary is authorized to prepare the official ballot for the
Recall Election and perform every act required by the City Charter and laws of the State of Texas
for holding elections. That the ballots used at the recall election shall conform to the following
requrrernents :
With respect to the person whose removal is sought, the question shall be submitted:

"SHALL JESSE DAVIS BE REMOVED FROM THE CITY COUNCIL BYRECALL?"
(a)Immediately below such question shall be printed the two following propositions,one above the other, in the order indicated:
"YES"
SECTION 3. The polling places shall be designated by the Denton County Elections
Administrator (the “Elections Administrator”) in accordance with the provisions of a joint election
agreement and contract for election services (the “Agreement”) with the Elections Administrator.
The locations of such polling places are set forth in Exhibit A, attached hereto. Exhibit A shall be
modified to include additional or different election day polling places designated by the Elections
Administrator and to conform to the Agreement.
SECTION 4. Early voting shall be conducted by personal appearance at the locations, dates
and times set forth in Exhibit B, attached hereto, and during the early voting period as required or
permitted by law. Exhibit B shall be modified to include additional or different early voting
locations designated by the Elections Administrator and to conform to the Agreement.
SECTION 5. The most accurate information on election day and early voting locations and
voting times can be found or obtained by visiting the Denton County webpage noted below or
contacting said County as noted:

SECTION 6. The Elections Administrator shall serve as the early voting clerk in
accordance with the terms of the Agreement. The main early voting location for the election shall
be at the following address:

SECTION 7. Applications for early voting by mail must be received no later than the close
of regular business on April 25, 2023. Applications for early voting by mail must be submitted to

SECTION 8. The City Council has found and determined that the meeting at which this
Ordinance is considered is open to the public, and that notice therefore was given in accordance
with provisions of the Texas open meetings law, Tex. Gov’t. Code Ch. 551, as amended, and that
a quorum of the City Council was present.
SECTION 9. The manner of holding such election and all questions pertaining thereto shall
be governed by the election laws of the State of Texas.
SECTION 10. This Ordinance shall become effective immediately upon its passage and
approval.

petici6n y, el dia 7 de febrero de 2023, present6 su certificado afirmando que la petici6n erasuficiente y en cumplimiento con las disposiciones del Articulo IV (Iniciativa, refer6ndum y
revocaci6n de los Estatutos de la Ciudad); y
POR CUANTO, el Concejal Jesse Davis no renunci6 a su cargo y, con el fin de cumplir con
los requisitos de las disposiciones respecto a la Elecci6n Revocatoria de los Estatutos de la Ciudad,
del C6digo Electoral de Texas y de otras disposiciones aplicab Ies de la ley, es necesario ordenar
una Elecci6n Revocatoria; EN VIRTUD DE LO CUAL,
POR EL PRESENTE DOCUMENTO, EL CONCEJO DE LA CIUDAD DE DENTONORDENA LO SIGUIENTE:
SECCION I. Que se ordena la celebraci6n de una Elecci6n Revocatoria municipal en la
Ciudad de Denton, Texas, el dia s£bado, 6 de mayo de 2023, siendo dicho momento una fecha
electoral uniforme, segan se define en la secci6n §41.001 del C6digo Electoral de Texas, con elfin de determinar si el Concejal Jesse Davis sera destituido del Concejo Municipal medianteRevocaci6n.
SECCION 2. Que la Secretaria Municipal esti autorizada a preparar la boleta oficiaI para
la Elecci6n Revocatoria y a efectuar todos los actos exigidos por los Estatutos de la Ciudad y las
leyes del Estado de Texas para la celebraci6n de elecciones. Que las boletas utilizadas en la
elecci6n revocatoria cumplir£n con los siguientes requisitos:
a)Con respecto a la persona cuya destituci6n se pretende, se sometera la siguiente

SECCION 3. Los lugares de votaci6n seran designados por el Administrador Electoral del
Condado de Denton (el “Administrador Electoral”), de conformidad con las disposiciones de un
acuerdo electoral conjunto y un contrato de servicios electorales (el “Acuerdo”) con el
Administrador Electoral. Las sedes de dichos lugares de votaci6n se establecen en el Anexo A,
adjunto al presente documento. El Anexo A se modificara para incluir lugares de votaci6n
adicionales o diferentes para el dia de la elecci6n designados por el Administrador Electoral y paracumplir con el Acuerdo.
SECCI6N 4. La votaci6n anticipada se llevara a cabo mediante comparecencia personal
