AN ORDINANCE OF THE CITY OF DENTON ORDERING AN ELECTION FOR DISTRICTS
1, 2, 3 AND 4 TO BE HELD ON MAY 6, 2023, AND, IF REQUERED, A RUNOFF ELECTIONTO BE HELD ON JUNE 10, 2023; PRESCRIBING THE TME, MANNER, AND CONDUCTOF THE ELECTION IN ACCORDANCE WITH A JOINT ELECTION AGREEMENT ANDCONTRACT FOR ELECTION SERVICES WITH THE ELECTIONS ADMn{iSTRATOR OFDENTON COUNTY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Article II, Section 2.01(a) of the Denton City Charter provides, the city
council shall have seven (7) members, six (6) councilpersons and a mayor...Each councilperson
shall be elected to and occupy a place on the council, such places being numbered one (1), two (2),
three (3), four (4), five (5) and six (6). The mayor’s position on the council shall be place seven
(7)and
WHEREAS, in accordance with Article II, Section 2.01 (b) of the Denton City Charter, four
(4) members of the council whose positions shall be places one (1), two (2), three (3) and four (4),
shall be residents of and elected by the qualified voters of single-member geographical districts of
the city, known as districts one (1), two (2), three (3) and four (4); and
WHEREAS, as a result of the recall election held November 8, 2022 on the proposition ofremoving Alison Maguire from City Council District 4, canvassed on November 22, 2022, a
vacancy was created in District 4; and
WHEREAS, the two-year term for Districts 1, 2, 3, and 4 are due for a regular election to
be held in accordance with the Denton City Charter on a uniform election date as defined in the
Texas Election Code. NOW THEREFORE;
THE COUNCL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. A municipal election is ordered to be held in the City of Denton, Texas on
Saturday, May 6, 2023, such date being a uniform election date as defined in the Texas Election
Code §41.001, for the purpose of electing council members for Districts 1, 2, 3, and 4. In the event
a runoff is required, the runoff election shall be held on Saturday, June 10, 2023 .
SECTION 2. The polling places shall be designated by the Denton County Elections
Administrator (the “Elections Administrator”) in accordance with the provisions of a joint election
agreement and contract for election services (the “Agreement”) with the Elections Administrator.
The locations of such polling places are set forth in Exhibit A, attached hereto. Exhibit A shall be
modified to include additional or different election day polling places designated by the Elections
Administrator and to conform to the Agreement.
SECTION 3. Early voting shall be conducted by personal appearance at the locations, dates
and times set forth in Exhibit B, attached hereto, and during the early voting period as required orpermitted by law. Exhibit B shall be modified to include additional or different early voting
locations designated by the Elections Administrator and to conform to the Agreement.

SECTION 5. The Elections Administrator shall serve as the early voting clerk in
accordance with the terms of the Agreement. The main early voting location for the election shall
be at the following address:

SECTION 6. Applications for early voting by mail must be received no later than the close
of regular business on April 25, 2023. Applications for early voting by mail must be submitted to

SECTION 7. The manner of holding such election and all questions pertaining thereto shall
be governed by the election laws of the State of Texas.
SECTION 8. This Ordinance shall become effective immediately upon its passage and
approval.

POR CUANTO, el Articulo II de la Secci6n 2.01(a) de los Estatutos de la Ciudad de Denton

concejal sera elegido y ocupara una posici6n en el Concejo, dichas posiciones se enumeran uno (1), dos(2), tres (3), cuatro (4), cinco (5) y seis (6). La posici6n de alcalde en el Concejo sera la posici6n siete (7;

POR CUANTO, de conformidad con el Articulo II de la Secci6n 2.01(b) de los Estatutos de la
Ciudad de Denton, cuatro (4) miembros del consejo cuyos puestos sean las posiciones uno (1), dos (2),
tres (3) y cuatro (4) seran residentes y elegidos por los votantes calificados de los distritos geograficos
uninominales de la Ciudad, conocidos como distritos uno (1), dos (2), tres (3) y cuatro (4); y
POR CUANTO, como resultado de la elecci6n revocatoria celebrada el dia 8 de noviembre de 2022sobre la propuesta de destituir a Alison Maguire del Distrito 4 del Concejo Municipal, escrutada el 22 de
noviembre de 2022, se cre6 una vacante en el Distrito 4; y
POR CUANTO, el mandato de dos aims para los distritos 1, 2, 3 y 4 esti pendiente para la
celebraci6n de una elecci6n regular, de conformidad con los Estatutos de la Ciudad de Denton, en una fecha
electoral uniforme, como se define en el C6digo Electoral de Texas. POR LO TANTO,
EL CONCEJO DE LA CIUDAD DE DENTON ORDENA LO SIGU[ENTE:
SECCION I. Se ordena la celebraci6n de una elecci6n municipal en la Ciudad de Denton, Texas
el sabado 6 de mayo de 2023, siendo dicha fecha una fecha electoral uniforme, como se define en la Secci6n
(§) 41.001 del C6digo Electoral de Texas, con el fin de elegir a los concejales para los distritos 1, 2, 3 y 4.
En caso de que se requiera una segunda welta, la elecci6n de segunda vuelta se celebrara el sabado 10 de
junio de 2023.
SECCION 2. Los lugares de votaci6n sean designados por el AdminisUador Electoral del Condado
de Denton (el “Administrador Electoral”), de conformidad con las disposiciones de un acuerdo electoral
conjunto y un contrato de servicios electorales (el “Acuerdo”) con el Administrador Electoral. Las sedes
de dichos lugares de votaci6n se establecen en el Anexo A, adjunto al presente documento. El Anexo A semodificara para incluir lugares de votaci6n adicionales o diferentes designados por el Administrador
Electoral y para cumplir con el Acuerdo.
SECCION 3. La votaci6n anticipada se llevara a cabo mediante comparecencia personal en las
sedes, fechas y horas establecidas en el Anexo B, adjunto al presente documento, y durante el periodo de
votaci6n anticipada conforme lo exija o permita Ia ley. El Anexo B se modificara para incluir sedes devotaci6n anticipada adicionales o diferentes designados por el Administrador Electoral y para cumplir con
el Acuerdo.
