AN ORDINANCE DECLARING AN UNOPPOSED CANDIDATE IN THE MAY 6, 2023GENERAL CITY ELECTION, DECLARING BRIAN BECK ELECTED TO OFFICE ANDCANCELLING THE ELECTION IN DISTRICT 2; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a municipal election was ordered to be held in the City of Denton, Texas on
Saturday, May 6, 2023, such date being a uniform election date as defined in Texas Election Code
§41.001, for the purpose of electing council members for Districts 1, 2, 3 and 4; and
WHEREAS, pursuant to Texas Election Code, Section 2.052, the authority responsible for
having the ballot prepared in an election shall certify, in writing, that a candidate is unopposed inan election for office. The certification must be made to the governing body of the political
subdivision as soon as possible after the filing deadlines for applications for place on the ballot
and write-in candidate declarations; and
WHEREAS, pursuant to Texas Election Code, Section 2.053, upon receiving certification
candidates are unopposed, the governing body of the political subdivision must, by order or
ordinance, declare such unopposed candidates elected. If the candidates are declared elected, the
election is not held and the governing body must post a copy of the order or ordinance declaring
the unopposed candidates elected at each polling place that would have been used in the election;and
WHEREAS, the City Secretary has certified in writing only one person has filed for a place
on the General Election ballot for District 2, no person has filed for write-in-candidacy in District
2 prior to the write-in candidacy deadline, and the candidate on the ballot for District 2 is
unopposed for election to office (See Exhibit A for Certification); and
WHEREAS, as required by the Texas Election Code, under these circumstances, the City
Council shall declare the unopposed candidate elected to office and cancel the election for District2; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. Brian Beck, being unopposed in the May 6, 2023 General Election, isdeclared elected to office for District 2 and shall be issued a certificate of election at the time the
election is canvassed.
SECTION 2. The May 6, 2023 General City Election for District 2 is cancelled, and the
City Secretary is directed to cause a copy of the “Order of Cancellation” (Exhibit B) to be posted
on Election Day at each polling place.
SECTION 3. This Ordinance shall become effective immediately upon its passage and
approval.

The City of Denton hereby cancels the election for District 2 scheduled to be held on Saturday, May
6, 2023, in accordance with Section 2.053(a) of the Texas Election Code. The following candidate

UNA ORDENANZA QUE DECLARA A UN CANDIDATO SIN OPONENTES EN LA ELECCIONGENERAL DE LA CIUDAD EL DIA 6 DE MAYO DE 2023; QUE DECLARA A BRIAN BECK ELECTOPARA EL CARGO Y CANCELA LA ELECCI6N EN EL DISTRITO 2; Y QUE DISPONE UNA FECHADE ENTRADA EN VIGOR.
POR CUANTO, se orden6 la celebraci6n de una elecci6n municipal en la Ciudad de Denton, Texas
el sabado 6 de mayo de 2023, siendo dicha fecha una fecha electoral uniforme, segan se define en la Secci6n
[§] 41.001 del C6digo Electoral de Texas, con la finalidad de elegir concejales para los distritos 1, 2, 3 y 4;y
POR CUANTO, de conformidad con la Secci6n 2.052 del C6digo Electoral de Texas, la autoridad
responsable de preparar la boleta electoral en una elecci6n certificar£, por escrito, que un candidato no tiene
oponentes en una elecci6n para un cargo. La certificaci6n debe efectuarse ante el organismo rector de la
subdivisi6n polftica tan pronto como sea posible despu6s de las fechas Ifmite de presentaci6n de solicitudes
de posici6n en la boleta electoral y las declaraciones de candidatos por escrito; y
POR CUANTO, de conformidad con la Secci6n 2.053 del C6digo Electoral de Texas, al recibir la
certificaci6n de candidatos sin oponentes, el organismo rector de la subdivisi6n polftica debe, mediante orden
u ordenanza, declarar electos a dichos candidatos sin oponentes. Si los candidatos son declarados electos, la
elecci6n no se celebra y el organismo rector debe publicar una copia de la orden u ordenanza que declara
electos a los candidatos sin oponentes en cada lugar de votaci6n que se hubiera utilizado en la elecci6n; y
POR CUANTO, la Secretaria Municipal ha certificado por escrito que solo una persona ha solicitado
una posici6n en la boleta electoral de la Elecci6n General para el Distrito 2, ninguna persona ha solicitado
una candidatura por escrito en el Distrito 2 antes de la fecha limite de candidaturas por escrito, y el candidato
en la boleta electoral para el Distrito 2 no tiene oponentes para la elecci6n a1 cargo (consulte respecto a la
certificaci6n en el Anexo A); y
POR CUANTO, segQn lo exige el C6digo Electoral de Texas, en estas circunstancias, el Concejo
Municipal declarara electo al candidato sin oponentes para el cargo y cancelara la elecci6n para el Distrito2; EN VIRTUD DE LO CUAL,
POR EL PRESENTE DOCUMENTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE DENTONORDENA LO SIGUIENTE:
SECCION I. Brian Beck, al no tener oponentes en la Elecci6n General del dia 6 de mayo de 2023,
es declarado electo para el cargo del Distrito 2 y se le emitira un certificado de elecci6n en el momento en
que se efectae el escrutinio de la elecci6n.
SECCI ON 2. Se cancela la Elecci6n General de la Ciudad para el Distrito 2 del dla 6 de mayo de
2023, y se ordena a la Secretaria Municipal que haga llegar un ejemplar de la “Orden de Cancelaci6n” (Anexo
B) que se publicara el Dia de la Elecci6n en cada lugar de votaci6n.
SECCION 3. Esta ordenanza entrara en vigencia inmediatamente tras su promulgaci6n y aprobaci6n.
