23-729ORD[NANCE NO. 23-729 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE ADDITIONAL EXPENDITURE OF $150.000. FOROUTSIDE COUNSEL EXPENSES AND OTHER APPELLATE EXPENSES IN THE rNITLALLITIGIATION STYLED “MICFL4EL GRIM AND JIM MAYNARD K CITY OF DENTON TEXAS.” CURRENTLY PENDING MERITS BR[EFrNG BEFORE THE SUPREME COURTOF TEXAS; AND DECLARING AN EFFECTIVE DATE (FILE 6567 – PROVIDING FOR ANADDITIONAL AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $150,000.00, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $1,491,900.00). WHEREAS, the City Council has previously budgeted a risk retention fund, providing forthe City’s defense in litigation; and WHEREAS, this procurement was undertaken as part of the City’s governmental function; WHEREAS, the additional fees under the proposed Additional Expenditure are fair and reasonable and are consistent with, and not higher than, the recommended practices and fees applicable to the Provider’s profession, and such fees do not exceed the maximum provided bylaw; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council hereby approves the additional expenditure of $150,000.00, for outside counsel and appellate expenses related in the litigation styled “ Michael Grim and Jim Maynard v. City of Denton, Texas ,” currently pending merits briefing before the Texas Supreme Court. SECTION 2. This ordinance shall become effective immediately upon its passage and approval.
