23-323ORDINANCE NO. 23-323 AN ORDINANCE OF THE CITY OF DENTON CANVASSING THE RETURNS ANDDECLARING THE RESULTS OF THE REGULAR AND SPECIAL MUNICIPALELECTIONS HELD ON MAY 6, 2023; DECLARING THAT A RUNOFF ELECTION IS NOTNECESSARY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton, Texas (“City”) ordered a regular and specialelection to be held in the City on May 6, 2023 for the purpose of electing council members to Districts 1, 2, 3, and 4 and for the proposition of determining whether City Council MemberJesse Davis shall be removed from District 3 Seat of the City Council by Recall; and WHEREAS, the election officers who held the election have duly made the returns of the result thereof, and these returns have been duly delivered to the City Council; and WHEREAS, the meeting at which this ordinance was passed was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by the Texas GovernmentCode, Chapter 551. NOW THEREFORE; THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council officially finds and determines the election held on May 6, 2023 was duly ordered, proper notice of this election was duly given, proper election officers were duly appointed prior to this election, this election was duly held, the City has complied with the Federal Voting Rights Act and the Texas Election Code, the returns of the result of this election have been made and delivered to the Council, and the City Council has duly canvassed these returns, all in accordance with the law and the ordinance calling this election. SECTION 2. The official returns of the election, herein incorporated by reference and attached as “Exhibit A”, having been opened, examined, and canvassed, and the Council hereby finds and declares that the following candidates received a majority of the votes cast at the election in Districts 1, 2, 3, and 4 and are declared to be elected to the City Council of the City of Denton as follows: FOR DISTRICT 1 : FOR DISTRICT 2:FOR DISTRICT 3 : FOR DISTRICT 4: VICKI BYRD BRLAN BECK (UNOPPOSED)PAUL N4ELTZERJOE HOLLAND SECTION 3. The City Council finds and declares that no runoff election is necessary. SECTION 4. The official returns of the election officials having been opened, examined, and canvassed and the City Council officially finds and determines al:go votes were cast at this special election on the submitted PROPOSITION A, by the residents, qualified electors of the City, who voted at the election and that the votes cast for such proposition on the ballot for the election were as follows: EARLY/ABSENTEE VOTING : CITY OF DENTON PROPOSITION A Shall Jesse Davis be removed from the City Council by Recall? The City Council officially declares the result of said special election to be thatPROPOSITION A so submitted HAS received a favorable majority vote in all respects and has CARRIED. The City Council finds and declares that Councilmember Jesse Davis is removed from office by Recall. SECTION 6. The City Council has found and determined the meeting at which this ordinance is considered is open to the public and that notice thereof was given in accordance with provisions of the Texas open meetings law, Texas Government Code Chapter 551, as amended, and a quorum of the City Council was present. SECTION 7. This ordinance shall become effective immediately upon its passage and approval.
