AN ORDINANCE OF THE CITY OF DENTON RATIFYING AND AUTHORIZING THE CITYMANAGER, OR DESIGNEE, TO EXECUTE AND DELIVER AN ADVANCE FUND[NGAGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION (TxDOT) FORBRIDGE REPLACEMENT OR REHABILITATION OF THE STATE SYTEM PROJECTLOCATED AT TRINITY ROAD AT COOPER CREEK IN THE CITY OF DENTON; PROVIDINGFOR THE USE OF FEDERAL FUNDS FOR A PROJECT OF 100% FUNDING WITH NO LOCAL
MATCH REQUIRED, IN THE AMOUNT OF NINE HUNDRED SEVENTY-THREE THOUSANDAND EIGHTY-ONE DOLLARS ($973,081.00) FOR CSJ #0918-46-300; AUTHORIZING THEEXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton, Texas ("Local Government”) and the State of Texas, acting by
and through the Texas Department of Transportation ("State") have entered into an Advance Funding
Agreement regarding the replacement of the bridge on Trinity Road at Cooper Creek. National Bridge
Inventory WI) Structure Number (18-061-O-B082-20-002), State Control-Section Job (CS J) Number
(0918-46-300); herein referred to as the “Project”; and
WHEREAS, the Local Government and the State have agreed to increase participation in the project,
to replace the bridge on Trinity Road at Cooper Creek; and
WHEREAS, the Local Government owns one or more bridges on a public road or street located at
Trinity Road at Cooper Creek in the City of Denton, and these bridges are included in the currently approvedoff-state system federal-aid Highway Bridge Replacement and Rehabilitation Program (HBRRP) as
authorized by Texas Transportation Commission Minute Order Number 115814, dated August 27, 2020 and
Minute Order Number 1 15550, dated August 29, 2019; and
WHEREAS, the State funding will provide Nine Hundred Seventy-Three Thousand And Eighty One
Dollars ($973,081.00) of the project funding; accounting for 100% federal and state funding through the
Infrastructure Investment and Jobs Act (IIJA) as well as the Highway Bridge Replacement and Rehabilitation
Program (HBRRP): and
WHEREAS, the typical estimated local match fund participation requirement for federally-eligibleitems of work is waived in full for CSJ 0918-46-300; and
WHEREAS, any non-eligible items of work will be paid by the Local Government; and
WHEREAS, the City Council having considered the importance of the Trinity Bridge at Cooper Creek
to the citizens of Denton, Texas and finding that it is in the public’s health and safety interest, is of the opinion
that it should ratify and approve the Advanced Funding Agreement attached hereto by and between the LocalGovernment and the State: NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference as true and as if fully set forth in the body of this ordinance.
SECTION 2. The City Manager of the City of Denton, or designee, is hereby authorized to execute
on behalf of the City, the Local Transportation Project Advance Funding Agreement (" AFA”) with the Texas
Department of Transportation, a copy of which is attached hereto as Exhibit "A" and made a part hereof for allpurposes.
SECTION 3. The City Manager, or designee, is further authorized to carry out all duties and
agreements to be performed by the City under the AFA
SECTION 4. Any previous expenditures regarding the AFA are hereby confirmed, ratified, and
approved, and the expenditure of funds in accordance with the City Manager’s expenditure authority is herebyauthorized.
SECTION 5 . That this ordinance shall become effective immediately upon its passage and
approval.
