AN ORDINANCE APPROVING A WATER UTILITY RELOCATION STANDARD UTILITY
AGREEMENT (“AGREEMENT”) BY AND BETWEEN THE CITY OF DENTON (“CITY”)AND THE TEXAS DEPARTMENT OF TRANSPORTATION (“TXDOT”), FOR THEREIMBURSEMENT OF ELIGIBLE COSTS INCURRED IN THE ADJUSTMENT, REMOVAL,AND RELOCATION OF CITY FACILITIES OF WATER UTILITIES ALONG 1-35E FROM US
380 (UNIVERSITY DRIVE) TO US 77 (N. ELM ST.) AND LOOP 288 MORE SPECIFICALLYCALLED TXDOT PROJECTS CSJ 0195-03-087 AND ROW CSJ 0195-03-091, WITHIN THECOUNTY AND CITY OF DENTON, TEXAS; AUTHORIZING THE CITY MANAGER, OR
DESIGNEE, TO EXECUTE AND DELIVER THE AGREEMENT; STANDARD UTILITYAGREEMENT NO. UOOO11548 FOR WATER UTILITY RELOCATION EFFORTS IN THE
AMOUNT OF $3,964,720.00; PROVIDING FOR THE EXPENDITURE OF FUNDS
THEREFOR; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, TxDOT has widened its right-of-way through the 1-35E corridor and Loop 288
within the Denton city limits in anticipation of the State’s 1-35E Widening project with a planned
project letting schedule for September 2023; and
WHEREAS, the proposed project will necessitate the adjustment, removal, and/or relocation
of certain facilities of the City as indicated in the following statement of work:
1)Water Line A: Install approximately 2 LF of 20" ductile iron water line, 162 LF of 24"
concrete water line by open cut, 3,889 LF of 36" concrete water line by open cut, 806 LF of
54" steel casing with 36" water carrier pipe by other than open cut, 293 LF of 54" steel casing
with 36" water carrier pipe by open cut. This segment will be installed north and roughly
parallel to Loop 288 beginning west of IH 35, crossing IH 35 at IH 35 STA 2213+62 and
continuing to the east, and crossing Loop 288 at Loop 288 STA 899+33.
Water Line B: Install approximately 4 LF of 16" ductile iron water line, 290 LF of 30"
concrete water line by open cut, and 50 LF of 48" steel casing with 30" water carrier pipe by
other than open cut. This segment will be installed parallel to IH 35 ROW directly south of
FM 1173. Approximately 420 LF of 8’' water line, 144 LF of 12" water line, 1,102 LF of 16"
water line, and 508 LF of 20" water line to be abandoned by grout fill. Approximately 2,343
LF of 16" water line and 439 LF of 20" water line to be removed by open cut.

WHEREAS, in an effort to meet TxDOT’s anticipated roadway construction schedule, the
City of Denton Northwest Water Transmission Main Improvement Project will relocate water
utilities out of TxDOT’s recently expanded right-of-way between US-380 and US-77; and
WHEREAS, The City of Denton is responsible for the minimum required water main
relocations which should be fully reimbursable in accordance with TxDOT ROW Utilities Manual,
and TAC Title 43, Chapter 21 ; and
WHEREAS, the City Council having considered the importance of the project to the citizens
of Denton and finding that it is in the public's health and safety interest, is of the opinion that itshould approve the Agreement; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDArNS:
SECTION 1. The recitals contained in the preamble of this ordinance are hereby
incorporated into the body of this ordinance are true and correct.
SECTION 2. The City Manager, or designee, is authorized to expend funds in the amount
of expenditure of funds in the amount of Three Million, Nine Hundred Sixty-Four Thousand, Seven
Hundred Twenty and 00/100 Dollars ($3,964,720.00) for the Northwest Water Transmission Main
Project to relocate water utilities out of TxDOT’s recently expanded right-of-way between US-380
and US-77 in the City and County of Denton, Texas.
SECTION 3. The City Manager, or designee, is hereby authorized to execute, on behalf
of the City, the Standard Utility Agreement No. U00011548, a copy of which is attached hereto
as Exhibit "A" and made a part hereof for all purposes.
SECTION 4. The City Manager, or designee, is further authorized to carry out all
obligations and duties of the City as set forth in the Agreement, including but not limited to the
expenditure of funds.
SECTION 5. That this ordinance shall become effective immediately upon its passage
and approval.
