WHEREAS, on February 1, 2022, City Council awarded a contract to Kimley-Horn and Associates, Inc., in the amount of $113,137.00, for design services for the TXDOT 1-35 Aesthetic Package for the Parks and Recreation Department; and WHEREAS, on October 1 1, 2022, Purchasing awarded a First Amendment to Kimley-Horn and Associates, Inc. in the amount of $49,900.00, to continue to provide design services for the TXDOT 1-35 Aesthetic Package for the Parks and Recreation Department; and WHEREAS, this procurement was undertaken as part of the City’s governmental function; and WHEREAS, the additional fees under the proposed Second Amendment are fair and reasonable and are consistent with, and not higher than, the recommended practices and fees applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Second Amendment, increasing the amount of the contract between the City and Kimley-Horn and Associates, Inc., which is on file in the office of the Purchasing Agent, in the amount of Twenty-Five Thousand Seven Hundred Sixty-Five and 0/ 100 ($25,765.00) Dollars, is hereby approved, and the expenditure of funds therefor is hereby authorized in accordance with said amendment which shall be effective upon the execution of the amendment attached hereto. This is Amendment number 02 dated July 5, 2023 to the agreement between the City of Denton, Texas ("Client") and Kimley-Horn and Associates, Inc. ("Consultant") dated 01-01-2022 (“the Agreemenf') concerning redesigning overpasses on 1-35 through the City of Denton (the "Project"). The Consultant has entered into the Agreement with Client for the furnishing of professional services, and the parties now desire to amend the Agreement. The Agreement is amended to include services to be performed by Consultant for compensation as set forth below in accordance with the terms of the Agreement, which are incorporated byreference Our project understanding, scope of services, schedule, and fee are below. Project Understanding Kimley-Horn previously prepared corridor Mechanically Stabilized Earth (MSE) schematic wall themes and submitted 95% level PS&E to the City and TxDOT. The scope below excludes revising these previously prepared schematic themes, however, per TxDOT and the Clients request, the MSE wall panels that were previously designed at the IH35 and 380/University location including a Texas Women’s University (TWU) graphic logo will now be modified to include a wall mounted TWU medallion. Utilizing the medallion theme that Texas Women’s University has provided for the wall mounted TWU medallion, Kimley-Horn will prepare plans, specifications, and estimates in accordance with the description of process in the tasks below. Scope of Services Consultant will perform the following services: TASK ADS.1: MSE Retaining Wall and Medallion Enhancements Kimley-Horn will prepare elevation and detail drawings utilizing the medallion themes developed by Texas Women’s University Medallion approved by the City for incorporating into the IH35 and 380/University abutment location. These elevation drawings will be provided to the City and TxDOT for them to provide to TxDOT’s engineering consultant for incorporation into their 100% PS&E package. The drawings will depict the wall mounted medallion dimensions, graphic representation, reveal details, finish texture and colors. The limit of this task is an approximate 18’ diameter wall mounted medallion in accordance with the modified TxDOT MSE graphic panels that were originally accepted and approved by TxDOT for the bridge abutments on the eastbound and westbound approach. Kimley-Horn will submit 60% level plans to City and TxDOT for review.Kimley-Horn will respond to one (1 ) simultaneous round of City and TxDOT comments and will provide 100% final plans and submittals to the City for submittal to TxDOT. Kimley-Horn will prepare an opinion of probable construction cost to understand the delta cost from TxDOT and City. As a part of this task, Kimley-Horn will attend (1) Client 60% plan comment review meeting, (1 ) Client 100% plan comment review meeting and up to (2) total coordination meetings. The mounting design is limited to structural design and detailing of anchorage and mounting hardware connecting signage to proposed MSE walls. MSE wall design provided by others is assumed to be designed for the loading from proposed aluminum medallion signs. Kimley-Horn will provide signed and sealed construction plans in 11'’x17” PDF format. Kimley-Horn will also provide special specification language for proposed aluminum medallion signs. Kimley-Horn will respond to one (1) round of comments from the Texas Department of Transportation (TxDOT). Exclusions: • Prepare/submit calculation package • Attend meetings • Any drawings other than the single structural requirements connecting signs to MSE walls detail sheet for mounting hardware TASK ADS.3: Meetings / Coordination (During Design) K}mley-Horn can be available to attend design team meetings, Client meetings, and/or conference calls and any other project related meetings not listed in previous task items. This task includes up to two (2) hours of meetings in addition to the quantity provided in the tasks above. Should additional meetings or coordination be required, this effort will be billed on an hourly basis at the then current hourly rate schedule. Additional Services Any services not specifically provided for in the above scope, as well as any changes in the scope the City requests in writing, will be considered additional services. Additional services we can provide include under a separate Addendum, but are not limited to, the following: • • • • • • • • • • Incorporation of additional rounds of review or comments from the City and TxDOT other than those specified above. Public input on the alternative art themes.
