23-1794ORDINANCE NO. 23-1794 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE REOPENING OF EAST / WEST WESTGATE DRIVE FROM THE EASTERN BOUNDARY EDGE OF WESTGATE DRIVE TO THE NORTHERN BOUNDARY EDGE OF NORTH/SOUTH WESTGATE DRIVE RIGHT-OF-WAY, 215 FEET NORTH OF BARROW DRIVE AS A PUBLIC STREET AND THOROUGHFARE; PROVIDING FOR A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, On April 17th, 1950, the Denton County Commissioners’ Court approved an order (Order No. 2044), filed of record in Denton County Records as Vol. 359 Page 61, accepting, approving, dedicating, establishing, and claiming all public roads for the purpose of definitely establishing the general location of such roads, attached hereto as Exhibit A. WHEREAS, the map provided as the exhibit was prepared by the Texas State Highway Department in cooperation with the U.S. Department of Agriculture, Bureau of Public Roads and the data obtained from the State-Wide Highway Planning Survey in 1949. Payne Road and Westgate Drive were shown as roads that were graded and drained and bituminous surfaced roads; and WHEREAS, On October 26th, 1965, the City of Denton, as a Home Rule City and under the City Charter, approved an ordinance (Ordinance No. 65-43) providing for the annexation of certain tracts of land contiguous and adjacent to the City of Denton city limits, Attached hereto as Exhibit B WHEREAS, the annexation made all public highways and roads contiguous and adjacent to the City of Denton become streets of the City of Denton; and WHEREAS, Payne Road and Westgate Drive were annexed into the City of Denton and have been and continue to be public roads owned by the general public and maintained and operated by the City of Denton; and WHEREAS, on June 15th, 1993, the City of Denton City Council approved an ordinance (Ordinance No. 93-108) providing for the indefinite closing of Westgate Drive, just North of Barrow Street, attached hereto as Exhibit C. Prior to the City Council action in June, support for the closure to that portion of Westgate Drive was approved by the Citizens Traffic Safety Support Commission and the Planning and Zoning Commission at the beginning of that year; and WHEREAS, the closure of this portion of Westgate Drive was also done in anticipation of a possible negative affect from increased traffic along the Westgate Park Addition Subdivision due to the Exposition Mills Development. The North/South portion of Westgate Drive acts as the eastern boundary to the subdivision; and WHEREAS, the City closed, barricaded and have maintained the aforementioned locations and it is determined to be in the best interest of the citizens of the City of Denton to reopen this portion of Westgate Drive in order to provide applicable City services to the area and allow for the development of this public roadway in accordance with the City’s 2022 Mobility Plan Thoroughfare Plan; and Whereas, the city engineer and public works staff have confirmed that the reopening of East / West Westgate drive from the eastern boundary edge of Westgate drive to the northern boundary edge of North/South Westgate Drive right-of-way 215 feet north of Barrow Drive is necessary to address previous public infrastructure improvements concerns and for any current and future public utility projects; and WHEREAS, the City Council of the City of Denton, acting pursuant to law, is of the opinion that the best interest and welfare of the City will be served by reopening of East / West Westgate drive from the eastern boundary edge of Westgate drive to the northern boundary edge of North/South Westgate Drive right-of-way 215 feet north of Barrow Drive as a public street and thoroughfare; NOW, THEREFORE, TUE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The recitals contained in the preamble of this ordinance are hereby incorporated into the body of this ordinance are true and correct. SECTION 2. That the portion of East / West Westgate drive from Westgate drive to Bronco Way, north of Barrow Drive shall be opened as a public street and thoroughfare. SECTION 3. The City Manager, or her designee, shall direct the appropriate City Department to remove traffic control devices in order to implement the reopening of East / West Westgate drive from the eastern boundary edge of Westgate drive to the northern boundary edge of North/South Westgate Drive right-of-way 215 feet north of Barrow Drive. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and approval. SECTION 5. Ordinance 93-108 is hereby repealed. All ordinances or parts of ordinances in force when the provisions of this ordinance became effective which are inconsistent, or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict. SECTION 6. That the City Secretary is hereby authorized and directed to certify a copy of this ordinance for recordation in the official real property records of the county in which the public street and thoroughfare is located, which certified copy shall be delivered to the Director of Department of Development Services, or designee. CLOSING OF WESTGATE DRIVE NORTH OF BARROW STREET ; AND PROViDING FOR AN EFFECTIVE DATE.
