ORDINANCE NO. 23-1780
AN ORDiNANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO
EXECUTE AMENDMENT 1 TO THE AGREEMENT BETWEEN THE CITY AND
FORESTAR (USA) REAL ESTATE GROUP INC. FOR THE DEDICATION OF PARK LAND
AND GRANTING OF A CITY TRAIL, AMENDING THE PHASING OF THE
CONSTRUCTION OF THE TRAIL; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, pursuant to Ordinance No. 22-249, the City of Denton (the “City“) entered
into an agreement on December 7, 2022 with Forestar (USA) Real Estate Group, Inc. (the
“Developer”) for the dedication of park land and a city trail, as well as the construction of the city
trail; and
WHEREAS, the City Council of the City hereby finds that amending the Agreement
pursuant to Amendment 1, a copy of which is attached hereto, serves the public interest by
allowing for completion of the city trail in manageable phases; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS :
SECTION 1. The findings and recitations contained in the preamble of this Ordinance are
incorporated herein by reference.
SECTION 2. The City Manager or their designee is hereby authorized to execut
Amendment 1 to the Agreement, a copy of which is attached hereto, and to carry out the duties
and responsibilities of the City under Amendment 1 and the Agreement.
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval.
