23-1795FILE REFERENCE FORM UK X Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act Other FILE(S)Date 1 o'\ 7 Initials 23- tIIE ORDINANCE NO. 23-1795 AN ORDINANCE OF THE CITY OF DENTON ESTABLISHING CLASSIFICATIONS AND POSITIONS IN THE POLICE DEPARTMENT; CREATING CERTAIN POSITIONS; REPEALING ORDINANCE NO. 23-438 RELATING TO ESTABLISHING THE CLASSIFICATIONS AND PRESCRIBING THE NUMBER OF POSITIONS IN EACH CLASSIFICATION FOR THE POLICE DEPARTMENT; PROVIDING REPEALER, CUMULATIVE, AND SEVERABILITY CLAUSES; AND DECLAR[NG AN EFFECTIVE DATE WHEREAS, pursuant to Section 143.021, Texas Local Government Code, the City Council of the City of Denton is required by ordinance to prescribe the number of positions in each civil service classification for Police Department personnel; and WHEREAS, on February 21, 2023, the City Council passed Ordinance No. 23-438, adopting and approving a schedule of Authorized positions relating to classifications of police officers; and WHEREAS, since the passage of Ordinance No. 23-438, the Police Department has updated the number of positions designated for certain classifications of Police Department personnel and has submitted these revisions to the City Council for review and approval based on the Department’s determination that these changes are in the Department’s best interest; and WHEREAS, the City Council has considered these updated classification numbers and has found these changes to be in the City of Denton’s best interest and accordingly has determined that Ordinance No. 23-438 should be repealed and the following classification titles, the number of each position within each classification, and total number of classified positions in the Police Department should be adopted; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS : SECTION 1. Ordinance No. No. 23-438 is hereby repealed. SECTION 2. The City Council hereby adopts and approves the following civil service classifications of the Denton Police Department and the number of positions in each classification is established as follows: (A) (B) (C) (D) (E) Assistant Chief Deputy Chief Lieutenant Sergeant Police Officer 4 10 24 176 TOTAL: 215 Page 1 SECTION 3. The number of positions in the civil service classification of Sergeant in Section 2 of this ordinance is an increase of one (1) from the number in existence immediately before the effective date of this ordinance. SECTION 4. This ordinance shall be cumulative of all provisions of ordinances of the City of Denton, except where the provisions of the ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation of this ordinance of any such unconstitutional phase, clause, sentence, paragraph, or section.
