WHEREAS, on May 1, 2018, the City Council of the City of Denton passed Ordinance Number 18-757 creating a new Article XI to Chapter 2 of the Code of Ordinances (the “Ethics Ordinance”); and WHEREAS, Section 2-277(k) of the Ethics Ordinance obligates the Board of Ethics to adopt rules of procedure governing how to conduct meetings and hearings, and such rules are subject to confirmation or modification by the City Council; and WHEREAS, the City Council adopted the attached procedural rules for the Board of Ethics on July 18, 2023, finding them to be reasonable, prudent, and necessary for the Board of Ethics to conduct efficient, effective, and fair meetings and hearings; and WHEREAS, prior to December 12, 2023, pursuant to the Ethics Ordinance, the Board of Ethics was comprised of seven (7) regular members and three (3) alternate members; and WHEREAS, on December 12, 2023, the City Council adopted Ordinance No. 23-2251, amending the Ethics Ordinance to eliminate the alternate member positions from the Board of Ethics;and WHEREAS, the City Council seeks to amend the Board of Ethics Rules of Procedure to reflect the elimination of the alternate member positions from the Board of Ethics; and WHEREAS, the City Council finds the attached amendments to be reasonable, prudent, and necessary to conduct efficient, effective, and fair meetings and hearings; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The foregoing recitals are incorporated into this Ordinance by reference as findings of fact as if expressly set forth herein. SECTION 2. The City Council hereby adopts the amendments to the Rules of Procedure for the Board of Ethics, pursuant to the Code of Ordinances, Chapter 2, Article XI, Section 2-277(k), as shown in Attachment A, attached hereto and incorporated into this Ordinance. SECTION 3. Should any of the clauses, sentences, paragraphs, sections, or parts of this Ordinance be deemed invalid, unconstitutional, or unenforceable by a court of law or administrative agency with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this Ordinance. SECTION 4. This ordinance shall be effective immediately upon its passage and approval.
