AN ORDINANCE OF THE CITY OF DENTON ESTABLISHING THE MOBILITY
COMMITTEE AS AN ADVISORY COMMITTEE; ESTABLISHING THE POWERS AND
DUTIES OF THE MOBILITY COMMITTEE; DISSOLVING THE TRAFFIC SAFETY
COMMISSION; DISSOLVING THE COUNCIL MOBILITY COMMITTEE; REPEALING ALL
ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR A
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE.
WHEREAS, on June 16, 2009, the City Council adopted a Resolution re-establishing the Mobility
Committee (See R2009-015); and
WHEREAS, on December 14, 2010, the City Council re-established the Traffic Safety
Commission (See Ordinance 20 10-3 17); and
WHEREAS, on Wednesday, December 12, 2023 the City Council discussed and directed staff to
combine the Traffic Safety Commission and the Mobility Committee, set forth how members to
the Committee are nominated, and to describe the role and responsibilities of the Committee; NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
adopted by the City Council and incorporated herein.
SECTION 2. The council standing committees referred to as Mobility
Committee and the Traffic Safety Commission are hereby dissolved.
SECTION 3. The Mobility Committee is hereby established as an advisory
committee of the City of Denton. The Mobility Committee shall be composed of 5 voting
members. Two members shall be residents of the City of Denton, who shall be appointed by the
City Council, and three members shall be City of Denton Council members. The members who
are not Council members shall be nominated and appointed by the City Council for a term of two
years and shall serve at the pleasure of Council until successors are duly appointed by the City
Council. The term of the inaugural members who are not Council members shall commence on
the date the members are appointed and the members will serve staggered terms. The staggered
term of the members who are not Council members shall end on August 3 1, 2025 for one member
and August 3 1, 2026 for the other member. City Council shall determine which inaugural member
who is not Council members will serve the shorter term. All other members of the Mobility
Committee must be Council members of the City of Denton who are currently serving as an elected
council member of the City of Denton. The Chair and Vice Chair of the Mobility Committee shall
be Council members. The members of the Mobility Committee who are Council members of the
City of Denton will serve 2 year terms, unless such member ceases to be a Council member during
the term, in which case such Council member shall no longer serve on the Mobility Committee.
The Chair and Vice Chair shall be chosen annually by the Mobility Committee members. A
quorum of the Mobility Committee required to hold a meeting shall be three of the Mobility
Committee members. The Mobility Committee shall meet monthly or as needed when called by
the City Council or City manager or designee.
SECTION 4. The Mobility Committee shall be advisory only. The powers and duties of
the Mobility Committee shall include and are limited to providing information, advice, and making
the making of recommendations to the City Council in matters brought forward to the Mobility
Committee by the City Manager or designee, or assigned by the City Council which pertain to
traffic safety, education, and publicity; ways and means of improving traffic conditions and safety
for motor vehicles; ways and means for improving bicycle and pedestrian safety; implementation
of traffic control devices; or other matters assigned to the Mobility Committee.
SECTION 5. The City Manager or designee will provide support to the Mobility
Committee as necessary and shall be responsible for ensuring that records are maintained in
accordance with the requirements of the City Secretary’s Office. The City Attorney shall provide
legal counsel to the Mobility Committee and city staff.
SECTION 6. Any matters not addressed by this ordinance shall be governed by the Code
of Ordinances of the City of Denton and the City of Denton Handbook for Boards and
Commissions and Council committees except §2-83(c) of the Code does not apply to City Council
members serving on the Mobility Committee.
SECTION 7. All ordinances and resolutions or parts of ordinances and resolutions in force
when this ordinance becomes effective which are inconsistent or in conflict with the terms of this
ordinance are hereby repealed to the extent of such conflict including without limitation the
entirety of ordinance 20 10-3 1 7 and all portions applicable to the Mobility Committee of resolution
R2009- 1 5
SECTION 8. This ordinance shall become effective immediately upon its passage and
approval.
