AN ORDINANCE OF THE CITY OF DENTON, A HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE GENERAL MANAGER OF DENTON MUNICIPAL
ELECTRIC TO EXECUTE AN AGREEMENT WITH THE PUBLIC UTILITIES COMMISSION
OF TEXAS (PUCT) SETTLING A DISGORGEMENT OF $42,012.60 FOR REVENUES
RECEIVED BY DENTON MUNICIPAL ELECTRIC IN FEBRUARY OF 202 1 FROM THE
ELECTRIC RELIABILITY COMMISSION OF TEXAS (ERCOT); AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Denton Municipal Electric operates within the ERCOT region and as such is
subject to the authority of the Division of Compliance and Enforcement at the Public Utility
Commission of Texas; and
WHEREAS, During Winter Storm Uri in February of 2021, Denton Municipal Electric
received payments from ERCOT due to the alleged improper reporting of the generation status of the
Denton Energy Center during the storm; and
WHEREAS, Denton Municipal Electric has checked its records and recommends
accepting the settlement terms; and
WHEREAS, the City Manager recommends that the City Council approve and authorize the
settlement and payment of the disgorgement to ERCOT; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitals contained in the preamble of this ordinance are true and correct
and are incorporated into the body of this ordinances as if fully set out herein.
SECTION 2. The expenditure of funds in an amount not to exceed $42,012.60 is authorized
to be refunded the Electric Reliability Commission of Texas. This ordinance also delegates authority
to the Denton Municipal Electric General Manager to negotiate and execute any required
documentation in connection with such payment.
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval.
