AN ORDINANCE OF THE CITY OF DENTON APPROVING AND AUTHORIZING THE
CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANING WITH
DENTON COUNTY, TEXAS, CONSTITUTING DENTON COUNTY’S FORMAL WAIVING
OF A CLAIM TO ITS POSSIBLE ALLOCATED SHARE OF THE PROCEEDS OF THE U.S
DEPARTMENT OF JUSTICE – OFFICE OF JUSTICE PROGRAMS – EDWARD BYRNE
rusTicE ASSISTANCE GRANT (JAG GRANT) 2023; AND DECLARING AN EFFECTIVE
DATE
WHEREAS, On June 30, 2023, the U.S. Department of Justice - Office of Justice Programs
- Edward Byrne Justice Assistance Grant (“JAG Grant”) issued Local Solicitation Number O-B JA-
2023-171790 for Fiscal Year 2023 (“Solicitation”); and
WHEREAS, this program furthers the Department of Justice mission by assisting state, local,
and tribal law enforcement efforts to prevent or reduce crime and violence; and
WHEREAS, pursuant to the Solicitation and in accordance with the 2023 Texas Local JAG
Allocation, the City of Denton, Texas, the City ofLewisville, Texas, the City of the Colony, Texas,
and Denton County, Texas, were eligible for a JAG Grant totaling $71,615, in the following
amounts:

The City of Denton: $34,143 .
The City ofLewisville: $24,596.
The City of The Colony: $12,876
Denton County: No amount was specified as Denton County did not submit the
level of violent crime data to qualify for a direct award from the Bureau of Justice
Assistance; and
WHEREAS, neither the City of Lewisville, the City of The Colony, nor Denton County
applied for the Solicitation; and
WHEREAS, the City of Denton applied for the Solicitation and was awarded a JAG Grant
for Fiscal Year 2023 in the amount of $71,615, the combined amount of eligibility for the City of
Lewisville, the City of The Colony, and the City of Denton; and
WHEREAS, the JAG Grant funds awarded will be distributed through a Memorandum of
Understanding with each of the eligible cities in accordance with the JAG Grant provisions; and
WHEREAS, the Denton County Commissioners Court met on December 5, 2023 and
approved a Memorandum of Understanding formally waiving Denton County’s claim to its
allocated share of the proceeds of the 2023 JAG Grant; NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitals are hereby incorporated and made part of this ordinance for all
purposes.
SECTION 2. The City Manager or their designee is hereby authorized to execute the
Memorandum of Understanding with Denton County, Texas, attached hereto as Exhibit “A,”
authorizing the Denton Police Department to spend its share of the allocated proceeds of the 2023
JAG Grant in accordance with the authorized purposes cited in the 2023 JAG Grant.
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval.

PROGRAM
1. This Memorandum of Understanding (MOU) is made and entered into by and
between TIle CITY of DENTON, TEnAS, and the DENTON COUNTY, TE 'AS
("The Parties").
2.On June 30, 2023, the U.S. Department of Justice - Office of Justice Programs -
Edward Byrne Justice Assistance Grant ("JAG Grant”) issued Local Solicitation

7. The City of the Colony did not apply for this solicitation.
8. Although the City of Lewisville. the City of the Colony, and Denton County, did not
apply for this solicitation, the CIty of Denton understood that the funds could be
shared with them through an MOU .
9.This MOU constitutes Denton County fbrmally waiving a claim to its allocated share
of the proceeds of this Grant and releases the City of Denton and its employees,
agents. and officers. from any and all claims it may have regarding those proceeds.
Denton County further consents to the City of Denton spending its share of the
allocated proceeds of this Grant for any of the authorized purposes cited in the
Grant. This MOU ratifies any share of Denton County’s proceeds of this Grant that
have already been spent by the City of Denton

10.By entering into this MOU. the Parties do not intend to create any obligations
