AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE CiTY MANAGER TO EXECUTE CONTRACTSREGARDING USE OF THE DEPARTMENT OF PUBLIC SAFETY OF THE STATE OF TEXAS
(DPS) INTERACTIVE SYSTEM WHICH SUPPLIES DRIVER RECORDS AND MONITORINGSERVICES FOR HUMAN RESOURCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton’s Comprehensive Driving Policy, 409.05, requires that all
employees driving or operating a City Vehicle or equipment must have an appropriate operator's or
commercial driver’s license as required by the State of Texas; and
WHEREAS, the City Council recognizes that the use of these records by the Human
Resources department meets a public purpose and provides a governmental function; and
WHEREAS, the City Council recognizes the City’s need to execute these agreements from
time to time without additional City Council authority; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. That the findings and recitations contained in the preamble of this ordinance
are incorporated herein by reference and are made a part of this ordinance.
SECTION 2. The City Council approves the agreement, attached hereto as Exhibit A and
delegates authority to City Manager, or their designee to execute the contract.
SECTION 4. The City Council of the City of Denton, hereby expressly delegates the
authority to execute future agreements for use of the Department of Public Safety of the State of
Texas (DPS) Interactive System which supplies Driver Records and Monitoring Services without
additional council approval as long as they are substantially similar to the attached form or in a form
approved by the City Attorney and City Manager. City Manager may also take any additional
actions that are deemed necessary or advisable by the City Manager, or their designee, or may be
required or permitted to be performed by the City of Denton under this ordinance to the City
Manager of the City of Denton, or their designee.
SECTION 6. This ordinance shall become effective immediately upon its passage and
approval.
