AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT BETWEEN DENTON INDEPENDENT SCHOOL DISTRICT
AND THE CITY OF DENTON TO WORK COLLABORATIVELY TO ENABLE STUDENTS
AND EMPLOYEES OF DISD TO HAVE GREATER ACCESS TO DENTON PUBLIC
LIBRARY RESOURCES THROUGH A BOOKS2GO ACCOUNT AT THE DENTON PUBLIC
LIBRARY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton ("City") and the Denton Independent School District
("DISD") desire to enter into an agreement to provide reduce barriers to public library services;
and
WHEREAS, the City and DISD wish to increase awareness of Denton Public Library
resources for students and school district employees; and
WHEREAS, the City and DISD agree to establish a seamless library experience for DISD
students; and
WHEREAS, the City and DISD wish to provide access to library resources to DISD
employees as they support student education; and
WHEREAS, DISD and the City agree and by the execution hereof are bound to the mutual
obligations outlined in the Memorandum of Understanding (“MOU”) attached hereto and made a
part hereof by reference; and
WHEREAS, the City Council of the City of Denton hereby finds that the agreement
between the City and DISD serves a municipal and public purpose, is in the public interest, and is
of a benefit to the citizens of the City of Denton; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings set forth in the preamble of this ordinance are incorporated
herein by reference.
SECTION 2. The City Manager, or their designee, is hereby authorized to execute the
Memorandum of Understanding with the Denton Independent School District to carry out the
duties and responsibilities of the City under the MOU.
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval.

MEMORANDUM OF UNDERSTANDING (MOU)
RE: DISD Students and Employees Checking Out Materials
from Denton Public Library using DISD ID
This Memorandum of Understanding (“MOU-) is between Denton Independent School
District (hereinafter "DISD”) and the City of Denton, a Texas home rule municipal
corporation (hereinafter “City") to provide DISD students access to City Public Library
materials (“Program").
Nothing in this MOU should be construed as limiting or impeding the basic spirit of
cooperation which exists between the participating entities listed above.
1.Purpose
This MOU establishes and delineates the mission of mutual resource sharing agreement
as a joint cooperative effort whereby the City hereby wishes to provide the students and
employees of DISD with access to physical materials and digital resources, The
Books2Go Account program began in the 2020-2021 school year serving students of
DISD. Beginning in the 2023-2024 school year, the program will be expanded to include
DISD students and employees. Future expansion may include pickup and delivery of
materials between the City and DISD. This MOU formalizes relationships between the
participating entities to provide a “student and educator centric" approach towards
building a positive relationship between the City library and students and school district
employees.
II . Mission
The mission of the program is to work collaboratively to enable students in DISD and
employees of DISD to have greater access to library resources by partnering with the
City
111.Program Goals
The following goals are established to accomplish the mission of the program.
A. Promote use of the City library to all DISD students including those living outside
the Denton city limits.
B. Provide access to physical and digital library resources to support curricular
assignments and student choice in reading materials.
C. Provide access to physical and digital library resources to support educators and
DISD employees as they provide support and services to DISD students.
D. Establish a positive relationship between students and DISD employees and the
library.
IV. Procedures
A. Concept
DISD Students
DISD parents or guardians will be given an option during enrollment to opt-
in to allow students to get a Denton Public Library account to borrow
materials from the City library.
DISD will provide a regular import of student data throughout the school
year as determined by DISD and the City’s technology departments.
DISD parents or guardians may activate the student account by visiting or
calling any Denton Public Library location during operating hours or
submitting an online form after the school year begins.
DISD students may use their school ID Cards or ID number to access
physical materials and digital resources from the City library.
DISD students may check out 3 physical items and access digital resources.
Denton Public Library does not charge overdue fines.
DISD students will be responsible for any physical materials lost or
damaged. If the lost material is found and returned in usable condition after
it has been paid for, the cost of the item will be refunded.

DISD Employees
8. Current DISD employees who are not eligible for a full-service resident
account may apply for a Books2Go Account by visiting any Denton Public
Library location during operating hours.
9. DISD employees must present their DISD employee badge when
requesting an account.
IO.DISD employees may check out 3 physical items and access digital
resources .
11.DISD employee accounts expire on September 1 of the following school
year and must be renewed annually by presenting their DISD employee
badge when renewing the account.
12. Denton Public Library does not charge overdue fines.
13.DISD employees will be responsible for any physical materials lost or
damaged. If the lost material is found and returned in usable condition after
it has been paid for, the cost of the item will be refunded,
B.Future Program Expansion Options
1. DISD may provide delivery services to and from Denton Public Library
locations.
2, Bins would be provided by the City.
3. Bags for small materials would be provided by DISD.
D. Legal Implications
DISD and the City will abide by federal FERPA law. State law 552.124 (p. 40), and
the guidelines set forth by the American Library Association regarding student
privacy (http://www.ala.org/privacypolicy). This policy requires a subpoena for the
release of confidential patron information, personal data such as name and
address, as well as a list of materials checked out.
VI.Termination
This MOU may be terminated by either party upon 30 days written notice to the
other party at the addresses provided below.
VII . Timeframe
This MOU will commence as of the date of the last signature hereto and will
dissolve on June 30, 2026 unless extended. The City shall have the right, but not the
obligation, to extend the term of this agreement for three (3) additional one-year periods.
