Airport Operations Update - Denton Enterprise Airport reached an all-time high! September was a record-breaking month for Denton Enterprise Airport, totaling an amazing 20,217 takeoffs and landings. This is the busiest month for the Airport since official records started with the opening of the Air Traffic Control Tower in 2004. The Airport is experiencing 25% YTD growth and continues to be the busiest general aviation airport in the State of Texas. Staff contact: Scott Gray, Airport. B. Denton City Auditor Recognized as an Emerging Leader — On September 30, 2022, the Institute of Internal Auditors announced that City Auditor Madison Rorschach was being recognized as one of 15 emerging leaders in the internal audit profession from around the world. Notice of"Fill the Boot"Activities—Denton Fire Department members will participate in"Fill the Boot"activities along the major intersections of Interstate 35,Loop 288,Carroll at University,and Dallas Dr. @ Teasley Ln. Uniformed firefighters with boots in hand will be asking pedestrians, motorists, and other passersby to donate to Muscular Dystrophy Association (MDA) on Wednesday,October 12, Thursday, October 13, and Friday, October 14. All proceeds are donated to the MDA. The International Association of Fire Fighters (IAFF) has collected critical funds in the community since 1954—one dollar at a time—as part of the Fill the Boot program for the Muscular Dystrophy Association (MDA). The Denton Fire Department and the Denton Fire Fighters Association Local 1291 will continue this long-standing tradition as its members raise funds to support the MDA's vision to accelerate research,advance care,and advocate for the support of MDA families. Innovative Transportation Solutions (ITS) Monthly Mobility Report — During the September 28, 2022, Mobility Committee meeting, Innovative Transportation Solutions (ITS) gave their monthly report. During the Mobility Committee meeting, the overview of the attached report was given on several major regional Texas Department of Transportation(TxDOT)projects.The report is provided for review. Staff contact:Rebecca Diviney, Capital Projects/Engineering E. National Night Out — On Thursday, September 27, the City hosted its annual National Night Out (NNO) Kickoff Party. For the first time, the event was moved to Wolff s Park on Industrial Street as it also served as a preview for the Denton Main Street Association's Fall Twilight Tunes series. Community Resource Officer Anthony Cunningham served as DJ for the kickoff. Attendees enjoyed yard games, touch-a-truck, and a variety of booths about City departments. 2 For National Night Out on Tuesday,October 4, staff visited 11 neighborhood parties across Denton. Residents got to know their neighbors and City staff during an evening that included Police and Fire vehicles, cookouts, bounce houses, and more. This was a great opportunity for Police Chief Doug Shoemaker to meet community members, as seen in DTV's NNO video. Across both nights, participating departments included Police, Fire, Denton Municipal Electric, Denton Public Library, Sustainability, Solid Waste and Recycling, Animal Services, Internal Audit, Human Resources, Community Services, Development Services, Municipal Court, Traffic Operations, Capital Projects, and Water Utilities. Denton Arts & Jazz Festival Interactive Map - Staff from Technology Services, Development Services, and the Water Utilities Departments partnered with Denton Festival Foundation to provide a NEW online interactive map for the Denton Arts & Jazz Festival. The map provides a mobile-friendly birdseye view of the festival's layout, vendors, and stages and enhances public safety by identifying the locations of first-aid booths and the Police Department's tent. The map is being shared via social media and is searchable on the City's website. Staff contact: Kevin Babcock, Technology Services G. City of Denton North Lakes Recycling_Update — During the recent North Lakes Tennis Center Parking lot construction, the North Lakes Recycling Center (NLRC) was temporarily closed. From September 7, 2022, to September 24, 2022, customers who would have traditionally used the NLRC to manage their recyclable materials. were directed to the City of Denton Landfill's Recycle Center located at the Home Chemical Collection(HCC) center. Managing recyclable material through the HCC helped mitigate the queue and landfill customer wait time at the scale house. During this 17-day period, the recycling center at the HCC accepted recyclable material from a total of 728 customers; 68% were Denton Residents and 32% were non-city residents. This is an almost 100% increase in participation over landfill recycling traffic alone. A total of 8.6 tons of material was collected during this period with a 22% rate of contamination. Park Employee Awarded Prestigious National Scholarship — This week, employees from the Aquatics team attended the World Waterpark Association symposium in Las Vegas, NV. Hannah Hickman, a Pool Manager with the Parks and Recreation Department, was recognized as the national recipient of the 2022 Chris Stuart Emerging Leaders Scholarship. This award recognizes a single individual from across the US who is under the age of 35, has 5 years or less full-time experience in the industry and exemplifies leadership qualities that represent the future of the aquatic industry. Hannah is a senior at Ouachita Baptist University and will receive her degree in December 2022. She intends to enter the aquatics industry full time after graduation. Hannah grew up with PARD programs such as the Denton Dolphins Swim team. She went on to work as a Lifeguard, Swim Instructor, Swim Coach, Lifeguard Instructor, and Pool Manager with Denton. Drinking Fountains and Bottle Fillers — On September 19, Mayor Pro Tern Beck inquired about city ordinances,policies, and regulations regarding public-facing drinking fountains and bottle fillers, both publicly and privately owned. Staff advised of the following 3 applicable 2021 International Building Codes (Section 2904) and Plumbing Codes (Chapter 4): • All businesses are required to provide water fountains to patrons and staff. Exceptions include hotels (and the sort), apartment house, and single and two- family homes. Existing businesses may not currently comply with newer building codes. • Drinking fountains shall not be required for an occupant load of 15 or fewer. • Restaurants that provide water in a container at no charge do not have to install drinking fountains. • Where more than three drinking fountains are required, up to 50 percent shall be allowed to be water dispensers (bottle fillers). • 50 percent of all drinking fountains installed shall be wheelchair accessible and 50 percent installed shall comply with requirements for standing drinking fountains. • No drinking fountains or water dispensers shall be installed in public restrooms. • Freeze protection would be required for any outdoor installation of drinking fountains. • An increase in meter size may occur if installing additional fixtures at a site. Robson Ranch Newsletter — On September 26, Mayor Hudspeth shared a constituent's email inquiring whether City staff could contribute written material for their community newsletter. Staff will gauge the feasibility of the request and use it as an opportunity to improve its communication strategies to include all residents in Denton. Election Costs — On September 29, Mayor Pro-Tern Beck requested information on the City's average election costs(per election),both with and without cost sharing. There have been nine (9) elections since 2018, including 2 runoff elections. The last nine (9) elections have all been joint elections. As a result, staff and Denton County do not have the ability to break down the cost information to determine what the cost would be if there were no cost-sharing with other jurisdictions. There are several variables that determine the cost of an election, including the number of polling locations (early voting/election day), the number of workers needed per election, voting equipment, etc. Attached is a summary of election costs from 2018 to 2022, itemized by the following: • Election Cost Summary from 2018-2022 &Average Costs (w/participating jurisdictions) o Details the final cost of each election, including publication costs • Election Participant& Locations Log- 2018 through 2022 o Details the election type, election order, canvassing, number of early voting/election day locations, and total participants Staff contact: Rosa Rios, City Secretary's Office D. Copper Canyon Road Development IngRija - On September 30, a constituent contacted Mayor Hudspeth inquiring about a potential apartment complex near Copper Canyon Road. A Pre-Application Conference (PAC) was held on April 27, for a proposed development at 2020 Long Tail Trail, on the west side of Copper Canyon Road, along the border with the Town of Copper Canyon. The proposed development is an 848-unit duplex and 4 multifamily development on—125 acres,split between two large-lot sections.The two parts of the development are: • A 402-unit (201 buildings)Duplex development on approximately 77 acres directly adjacent to Copper Canyon Road, and • A 446-unit(67 buildings) Multifamily development on 48 acres west of the Duplex development The proposed development was to be primarily in the Extraterritorial Jurisdiction (ETJ), but the project or one of its access roads appears to potentially cross into the 10' strip along the border with the Town of Copper Canyon that is within Denton City Limits. Since the project is in the ETJ, subdivision standards in the Denton Development Code(DDC)would apply to the entire project, but zoning and most other DDC development standards would not, except for the part of the project that may fall in the 10' strip in the City Limits. The applicant has not submitted any development applications for this site. Staff contact: Sean Jacobson, Development Services E. Public Restroom Signage — On September 30, Council Member Maguire requested that signs be placed within the downtown area indicating the location of public restrooms available within Quakertown Park. Parks and Recreation and Traffic Operations are currently collaborating on a plan to install signage in strategic locations around the square and Hickory Street. These signs will match the wayfinding signs seen throughout the community. Staff is currently working on the design; however, fabrication delays are expected pending the receipt of replacement parts for the sign printer. The anticipated date for placement is October 28. Cemetery Ground Penetrating — On September 30, Council Member Maguire requested staff research the location of plots located within Oakwood Cemetery, specifically along the western side of the property where redevelopment is occurring. Parks and Recreation staff is preparing a scope of work to hire a consultant to conduct ground penetrating radar on both cemeteries along with data collection initiatives. Meanwhile, staff is obtaining quotes to survey the specific area near the redevelopment along the fence line soon. Funding is currently not available for the entire project,but staff plan to provide a supplemental request for FY2022-2023. Staff contact: Fince Espinoza, Park& Recreation G. Carnegie Ridge Drainage — On September 30, Council Member Maguire requested that staff investigate the drainage issues in the Carnegie Ridge neighborhood. As part of the request, Council Member Maguire shared examples and photos from residents residing on Ridgelea Court, Cedarhurst Court, and Creekmere Drive. Drainage and stagnant water concerns for Creekmere Drive were previously brought to staff s attention by an Engage Denton request in March 2022. There is a dedicated 25' drainage easement immediately south of the resident's property, and upon review, staff determined that improvements to the drainage easement would improve drainage and reduce stagnant water. Because the resident's property and the drainage easement are adjacent to undeveloped private property containing an Environmentally Sensitive Area, Drainage Operations partnered with Community Improvement Services, Watershed 5 Protection, and Legal to ensure improvements in the easement were appropriate. Efforts to clean and improve the easement concluded in July 2022.Attached are photos illustrating the conditions before and after the improvements. Drainage Operations inspects the easement every 6 months and performs additional cleaning and maintenance according to inspection results. Regarding Ridgelea Court and Cedarhurst Court, residents expressed concern to Council Member Maguire that runoff to their properties has increased because of the development of an adjacent property. Staff is in the process of reviewing plans for the development in question as well as plans for recent improvements to Crawford Road. Viability of Hydrogen as Fuel — On October 1, Council Member McGee and Mayor Pro Tem Beck inquired on the viability of using hydrogen as fuel to reduce carbon emissions and regional hub grants from The Department of Energy (DOE). Consideration of applying to DOE for grant funding of Denton as a regional hydrogen hub is not feasible as the City of Denton does not operate any natural gas pipelines or distribution systems. If the City were to become a local distribution company for natural gas, such action would require an election by the citizens pursuant the City Charter. The City of Hempstead, New York is applying for funding to evaluate blending of hydrogen at low levels with natural gas then distributing it to the City's natural gas customers in the city-owned natural gas local delivery system. Denton Municipal Electric (DME) staff evaluated the information shared for feasibility. As a fuel, Hydrogen (H2) contains more energy per pound than natural gas (CH4) by almost 140% and the molecule contains no carbon, allowing no carbon dioxide to be emitted during combustion. However, the following do affect the viability of H2 locally: 1. Flammability—For combustion,both oxygen and an ignition source are needed. Hydrogen will burn with lower amounts of air present and with higher amounts of air than natural gas. This wide flammability range makes controlling the combustion of hydrogen more difficult than controlling the combustion of natural gas and makes the handling of hydrogen a greater safety issue. 6 2. Flame speed—There is an engineering concern with flame speed when designing combustion equipment. Hydrogen has a much higher flame speed than natural gas and controlling the location of the combustion is important, equipment designed to burn natural gas is less efficient. 3. Flame temperature—Hydrogen's adiabatic flame temperature is 500 degrees hotter than natural gas and the materials in the existing combustion chamber(s) for natural gas combustion will not hold up to this higher heat, leading to a requirement of different materials. Hotter combustion temperatures also result in higher nitrogen oxide (NOx) emissions.NOx is an ozone precursor and is tightly controlled by the Environmental Protection Agency(EPA) from combustion sources. The Denton Energy Center (DEC) engines are not designed to burn hydrogen as the materials of construction and existing control systems are inadequate. Testing on similar units by Wartsila have shown that up to 5% hydrogen in the inlet fuel stream can be tolerated by the engines with little concern but control system upgrades are required. Natural gas pipeline companies are still evaluating the short-and long-term effects on their systems and Federal Energy Regulatory Commission (FERC) will need to approve the injection into any interstate pipeline. Producing green hydrogen from renewable resources is also a very expensive proposition as the storage and delivery systems need to be constructed. Forecast prices for 2030 delivered green hydrogen is $15/MMBtu. Current natural gas prices are between $5 and $9/MMBtu with January 2023 futures at $6.90/MMBtu on October 2, 2022. DME will continue to monitor developments and the economics associated with hydrogen as a zero- carbon emission fuel. Staff contact: Terry Naulty, DME I. Reasonable Accommodations for Board and Commission Members — On October 3, Council member McGee inquired regarding the ability of differently abled community members to serve on boards or commissions and if the City is equipped to meet their service needs. The City of Denton absolutely strives to provide reasonable accommodations to any person as they engage with the City of Denton or receive services. The Committee on Persons with Disabilities, an advisory committee to the Council,was created in part to help make our services more accessible. For those interested in serving, the Board and Commissions application available on the Board and Commissions webpage has a space for prospective members to request reasonable accommodations. Crossing Guard Inquiry — On October 3, Council Member Davis inquired as to whether school crossing guards are employed by the City of Denton police department or through Denton Independent School District. Crossing Guard at University Drive and Malone Street - On October 3, Council Member Davis inquired about the lack of a crossing guard at the intersection of University Drive and Malone Street. Staff is happy to report that the position was filled on September 27 and was the last of 8 vacancies remaining since the beginning of the school year. Staff contact: Derek Bradford, Police L. Bell Street Public Meeting Notices—On October 3, Council Member McGee asked which neighborhoods received notice of the Bell Street public meeting as well as the ®_ —Guinn-HEil e USequoia number of notices sent. Letters regarding the virtualTexas community meeting were sent to 316 addresses surrounding 'I li w mans the immediate area from Woodland along Locust to University McKinney, then along McKinney to Mingo, and Mingo back up to Woodland (highlighted). This included homes surrounding the TWU campus. SEDNA Water Shutoff Notice — On October 3, Mayor Hudspeth reached out to staff regarding notices that were given out in Southeast Denton associated with the Southeast Denton Package A project. The flier contained information from an incorrect project and had multiple items marked out with handwritten information provided. Staff met with the contractor and provided the correct form and instructions from the City of Denton's Standard Technical Specifications. Staff will continue to work with the contractor to ensure notices are timely and accurate. Staff contact: Seth Garcia, Capital Projects/Engineering N. Fort Worth Drive and Country Club Road—On October 3, Council Member Davis shared a resident question regarding recent traffic sign changes at the intersection of Country Club Road and Fort Worth Drive. The original sign configuration at this intersection included a "No U-Turn" sign on southbound Fort Worth Drive and permitted right turns on red for Country Club Road. As part of the Texas Department of Transportation (TxDOT) improvements on Fort Worth Drive, a newly installed median restricted southbound access to businesses on the east side of the roadway. In August 2021, Capital Projects/Engineering and Traffic Operations partnered with TxDOT to provide temporary access by removing the "No U-Turn" sign on Fort Worth Drive, and to avoid conflicts with drivers performing U-turns, a"No Right Turn on Red" sign was installed at Country Club Road. Recent improvements to the business park provided access via E. Mission Street for drivers traveling southbound on Fort Worth Drive. As a result, the Capital Projects/Engineering department coordinated with TxDOT and Traffic Operations to return the intersection to the original sign configuration. On September 8, 2022, the "No Right Turn on Red" sign was removed from Country Club Road, and the "No U-Turn" sign on was reinstalled on southbound Fort Worth Drive. Stickers/Grass Burs in Joe Skiles Park — On October 5, Council Member Davis asked whether staff has a plan for mitigating the stickers/grass burs in Joe Skiles Park. Staff advised that while a pre-emergent is applied annually, the lack of irrigation in the park impedes the ability to control the grass burs. Staff plans to design irrigation for the park 8 and obtain quotes before discussing the next steps. Staff contact: Gary Packan, Parks & Recreation Upcoming Community Events and Meetings A. Denton Arts & Jazz Festival — The 42nd Annual Denton Arts & Jazz Festival will begin on Friday, October 7 at 3 p.m. at Quakertown Park and the Denton Civic Center. This event features seven stages of continuous music, fine art, crafts, food, games, and more and will continue Saturday from 10 a.m.— 11 p.m., and Sunday from 11 a.m.—9 p.m. Staff contact: Arianna Bencid, Parks and Recreation B. Kids' & Teens' Day Off—Whether it's a holiday,winter break, or teacher workday, we've got you covered! Drop your kid or teen off for a day of supervised fun! The$3 3 fee includes a day jam-packed with physical activity, creativity, and play through a variety of fun, enriching activities, and field trips. Kids must be dropped off by 9 a.m. each day and need to pack their own drinks, snacks, and lunch. Preregistration is required two days prior to each date to ensure minimum enrollment is met. Walk-ins will be accepted if there is space available. The next Kids' & Teens' Day Off is scheduled for October 10 and 11 from 7 a.m. — 6 p.m. The field trips will include a visit to the Museum of Illusions, a pumpkin patch, and local parks. Dia De Los Muertos Celebration— The Parks and Recreation Department will host a Dia De Los Muertos Celebration on October 15, starting at 10 a.m. at the MLK Jr. Recreation Center. The celebration will feature keynote speaker Dr. Valerie Martinez-Ebers, who is a Distinguished Research Professor of Political Science and Director of the Latina/o and Mexican American Studies Program at the University of North Texas. Online registration opened on Tuesday, Oct. 4 at 10 a.m. and filled up in less than 24 hours. The first species to sell out were Brandywine Maple and Texas Redbud. The Tree Giveaway waiting list is now open to City of Denton residents for sign up. Registered waiting list participants are eligible to arrive at the conclusion of the event on Oct. 22 to select any trees not picked up by registered participants. Trees are available on a first come, first serve basis while supplies last. Limited to waiting list registrants, one per household. The Community Tree Giveaway is Saturday, Oct. 22, 8 a.m. to noon at the Denton Landfill where 700 trees will be distributed to Denton residents. The Community Tree Giveaway is Keep Denton Beautiful (KDB)'s largest and longest-running tree distribution effort. KDB has given away more than 20,000 trees through its annual Tree Giveaway event over the programs two-decade history. This year seven different species of trees are being distributed, all of which are drought-tolerant, and native or well-adapted for Denton soils and climate. Tree species include Brandywine Maple, Loblolly Pine, Mexican Sycamore, Purpleblow Maple, Roughleaf Dogwood, Sweetgum, and Texas Redbud. Information about the tree species, tree planting and care resources for this year's giveaway can all be found at www.kdb.org. KDB is also seeking volunteer groups to help with the annual giveaway! Wreaths Across America — Denton Parks and Recreation (PARD) will host its first National Wreaths Across America Day on Saturday, December 17, at Oakwood Cemetery, located at 747 East Prairie St. in Denton. The mission of Wreaths Across America is to Remember, Honor and Teach the public about America's veterans by organizing wreath-laying ceremonies at graveyards across the country. Supporters may sponsor wreaths either online or by mailing a check directly to Wreaths Across America; however, the City of Denton will only receive credit for orders placed through our group page. The wreath sponsorship deadline is Nov. 28 to guarantee delivery for this year. To sponsor a wreath or volunteer, visit www.wreathsacrossamerica.org/TX1167. Wreaths range from $15 for an individual wreath to 10 wreaths for $150. Sponsorship options include Patriot Pairs: where a wreath is donated to the gravesite and a matching wreath is delivered to your home,to a loved one, or a friend. Each month,kids ages 5 to 11 will enjoy a night out while their parents enjoy the night off. Recreational Care staff will plan each event around a unique theme, create play stations including games and activities, mini-sports tournaments, unique inflatable fun, ping-pong, and video games on the big screen. Of course, it's never a party without a DJ and dance contests! The program will run from 7 p.m. to 11 p.m. Pizza and a drink will be provided as part of the $25 registration fee. Concessions and glow novelties will also be sold. Preregistration will be required. Denia Recreation Center will also be offering Teen Night for ages 11 through 17 once a month beginning in January. The overlap in age for the two programs will allow parents to choose the option most suitable for their early middle schoolers and be consistent with summer camps. Oncor proposed to implement its proposed increase in rates effective June 17, 2022. On June 7, 2022, the City took initial action on Oncor's application and suspended Oncor's proposed effective date to keep Oncor's proposed rates from going into effect. This permitted the City, through its participation in the Alliance of Oncor Cities ("AOC"), an opportunity to review the rates and, if prudent, negotiate on behalf of Oncor customers within the City of Denton for a more reasonable rate increase. AOC could not come to an agreement with Oncor on negotiated rates and is recommending its member cities deny Oncor's rate increase. This will likely result in Oncor appealing the matter to the Public Utility Commission of Texas ("PUCT") for a final determination of rates. BACKGROUND: Municipalities have exclusive, original jurisdiction over an electric utility's rates, services, and operations within a city's boundaries. This means that for a utility like Oncor to change its rates it must seek approval to do so from the city in which it provides its service. Even if a city has ceded its jurisdiction to the PUCT, a city nonetheless has the statutory right to participate in rate proceedings before the PUCT. But,the PUCT has appellate jurisdiction over rate-setting decisions a city makes. This means that Oncor may appeal to the PUCT, a city's decision regarding rates. Previous Suspension of Oncor Rates Oncor filed its Statement of Intent to raise rates with the City and with the PUCT on the same date, May 13, 2022. On June 7, City acted to suspend the effective date of Oncor's requested rate increase by 90 days. Contemporaneously with the City's prior action to suspend the rate increase, the City also: (1) authorized intervention in proceedings related to Oncor's proposed rate increase as a member of the coalition of cities known as the Alliance of Oncor Cities; (2)directed Oncor to reimburse AOC's rate case expenses; and(3)retained the law firm of Herrera Law and Associates, PLLC with respect to rate proceedings involving Oncor before the Public Utility Commission of Texas and courts of law and to retain consultants to review Oncor's rate application subject to AOC's approval. DISCUSSION: Because Oncor filed its application with the City and with the PUCT on the same date, the City, as part of the AOC intervened in the proceedings before the PUCT. 39 Oct. 7,2022 Report No. 2022-062 During the suspension period, through AOC the City participated in the proceedings, including hearings, at the PUCT. AOC through its Special Counsel, Herrera Law & Associates, PLLC, engaged rate consultants to evaluate Oncor's proposal to increase rates and is participating in the hearings being held as directed by the PUCT. The hearings regarding Oncor's application to increase rates are expected to run through October 5, 2022, after which the administrative law judges' ("ALM')will issue a proposal for decision("PFD"). The ALJs' proposal for decision will be presented to the PUCT commissioners likely sometime in February 2023, for a final decision. Areas of Concern with Oncor Rate Request While there were numerous issues raised by Oncor's application to increase rates, AOC focused on several key issues that standing alone have the greater effect on Oncor's proposed increase: Oncor's rate of return, its depreciation expense, Oncor's funding for its self-insurance reserve and its incentive compensation for its employees including its executives, and Oncor's post Test Year adjustment to its payroll expense. Regarding Oncor's rate of return, AOC's rate expert concluded that a rate of return of 6.31%was a reasonable return that would allow Oncor continued access to the capital markets to raise financing for its ongoing operations. By comparison, Oncor proposed a rate of return of 7.05%. AOC's rate expert's proposed rate of return is comprised of 57.20% long-term debt and 42.50% common equity; a cost of long-term debt of 4.39%; and a cost of equity (aka, return on equity) of 8.90%. By comparison, Oncor's rate of return is based on a capital structure of 55.00%long-term debt and 45.00% common equity; the same cost of long-term debt of 4.39%; and a cost of equity of 10.30%. The effect of AOC's expert's conclusion regarding Oncor's rate of return is a decrease of about$177.8 million to Oncor's requested increase in rates. With regard to Oncor's depreciation expense, Oncor's rate expert concluded that Oncor's depreciation expense should be decreased by about $75.0 million. Regarding Oncor's self-insurance reserve, though AOC's expert did not disagree with the amount of Oncor's funding for its self-insurance reserve, AOC's expert-recommended amortization of 10 years (versus Oncor's proposed 5-year amortization). The effect of a longer amortization period is to reduce Oncor's request for self-insurance reserve is a decrease of$58.9 million to Oncor's proposed increase. With regard to Oncor's incentive compensation expense, AOC's expert recommended a decrease of$29.8 million to Oncor's proposed amount for incentive compensation. With regard to Oncor's proposed post Test Year adjustment to increase its payroll expense,AOC's expert recommended a decrease of$9.2 million to Oncor's proposed increase. Combined, AOC's experts' conclusions regarding Oncor's rate of return, depreciation expense, self-insurance reserves, incentive compensation, and payroll adjustment combined equate to a decrease of about $211.7 million to Oncor's proposed increase of about$251 million. In addition to AOC's analysis, parties representing other municipalities in the proceeding before the PUCT also concluded that Oncor's requested increase was too high. Those parties proposed a decrease of about $314 million to Oncor's proposed increase in rates. Added to AOC's findings, 40 Oct. 7,2022 Report No. 2022-062 AOC and the other cities participating in the proceeding before the PUCT recommended that the PUCT reduce Oncor's proposed increase of$251 million,by about $525.7 million. The effect of these recommendations is that AOC and the other cities participating in Oncor's rate case at the PUCT,recommended to the PUCT that Oncor's present revenue be decreased by about $275 million. Rate Case Expenses Cities, by statute, are entitled to recover their reasonable rate case expenses from the utility. The accompanying Resolution directs Oncor to continue to reimburse AOC's rate case expenses on a monthly basis based on a presentation of approved invoices from the cities. CONCLUSION: AOC's Special Counsel and consultants' analyses found that Oncor's rates should be decreased. However,because: (1)the PUCT has appellate jurisdiction over the City's actions setting Oncor's rates; and (2) any rate the City sets would be in effect for only a short period, AOC's Special Counsel recommends that the City deny Oncor's proposed increase in rates. Additionally,to do otherwise could cause significant confusion in the pricing of electricity by retail electric providers ("REPs"). The REPS are the entities that sell electricity services to end-use customers and have a direct relationship with the end-use customer. The REPs generally need from four to six weeks to change their billings to customers. Thus, requiring Oncor to change its rates consistent with Oncor's and the other cities' rate experts' findings pending Oncor's appeal to the PUCT, likely would not provide the REPs sufficient time to adjust their billings to end-use customers, and likely would require the REPs to change their billings twice: once to conform their billings to the City's decision and again to conform their billings to the PUCT's decision. A denial of Oncor's proposed increase maintains the status quo until the PUCT issues its final order regarding Oncor's rates and provides the REPs adequate time for the REPs to change their billings to end-use customers. The City must take final action on Oncor's proposed increase by no later than October 30, 2022. If the City does not take action by October 30, 2022, Oncor's proposed rates will be deemed improved by operation of law. ATTACHMENTS: 1. BACKGROUND: Texas Department of Transportation (TxDOT) is in the process of redesigning the overpasses along Interstate-35 (IH-35) corridor in the City of Denton and the interchange where Interstate- 35E (IH-35E) and Interstate-35W (IH-35W) intersect just south of the city. The TxDOT project will encompass approximately a 6.5-mile-long section of interstate which includes 6 overpasses and the single interchange. The TxDOT project has a letting date of September 2023 and construction is anticipated to begin in 2024. TxDOT contacted the City of Denton as part of their community outreach to be able incorporate design elements that are reflective of the community. TxDOT has developed and offered their Aesthetic Design Guidelines to help communities create an overall corridor of design continuity while maintaining our City of Denton identity. In January 2022, the City of Denton's Parks and Recreation Department requested a statement of qualifications for wall, hardscape and landscape enhancements along the IH-35 corridor. The purpose of the project would be to pursue the graphic design of the Mechanically Stabilized Earth (MSE)retaining walls, decorative hardscapes and landscapes enhancements related to the TxDOT project of the redesigned overpasses, underpasses and interchange. In February 2022, the consulting firm, Kimley-Horn, signed a professional services agreement (PSA 7599-007)with the City of Denton for the completion of the walls,hardscape and landscape aesthetics schematic plans. The first proposed locations that will receive the MSE wall aesthetic enhancements are the following: • Loop 288 (underpass) • U.S. 380 (overpass) and(baseline/accent Intersection) • W. Oak Street(overpass/baseline intersection) • I-35E and Interstate 35W at Bonnie Brae Street (baseline/accent intersection) The first proposed designs, in coordination with TxDOT, City of Denton's Parks and Recreation Department and the Public Arts Committee (PAC), consisted of large medallions. TxDOT recommended that the proposed designs move away from the large medallions due to engineering issues caused by the additional weight on the MSE walls. The first viable draft designs were presented to the PAC on April 7,2022. Based on the renderings at this time the PAC recommended that the designs be simplified for clarity. 43 October 7, 2022 Report No. 2022-063 The second draft of designs were presented to the PAC on June 2, 2022. On this occasion, the PAC gave the following recommendations: • Some designs are too detailed, • Not to use two treble clefs on the same line, • Do not use backward musical notes, • Use a score to music that represents Denton, • Focus should be on the music notes rather than sound waves, • Consider only having a few detailed intersections and keeping the rest less busy, • Pay attention to notes and their meanings, and • Consider messages relevant to Denton. The third draft of designs were presented to the PAC on August 4, 2022. The following recommendations were given to the consultant engineer to incorporate: • Eliminate the singers in A-1 and guitar player in A-3 • Add the full guitar to B-1 • Eliminate B-2 • Eliminate C-2(Option B),provide more detail with the artists, add a trumpet and trombone player, eliminate the sound waves from C-2 (Option A) • Add notes to D-1 with meaning • Eliminate D-2 and D-1 (Option A) After these first 4 iterations of changes to the schematic plans by the PAC, the Parks, Recreation, and Beautification Board(Parks Board)was given a chance for their input. The meeting occurred on July 11, 2022, and their recommendation was to make sure the musician outlines fully represented the contributions of women and minorities to Denton's music culture. Both University of North Texas (UNT) and Texas Woman's University (TWU)were represented during the design process as part of the focus group that worked with Kimley-Horn on the esthetic schematic plan. The final MSE walls aesthetic schematic plan was presented to the PAC on September 1, 2022, and to the Parks Board on September 12, 2022. Both committees supported the designs as presented. See Attachment 1 below. DISCUSSION: Upcoming TxDOT Deadlines & Fiscal Responsibility The final MSE wall aesthetic schematic plans are ready to be submitted to TxDOT. The deadline for submission of the schematic plans was September 30, 2022. The deadline for submission of the design plans and contract documents is anticipated to be at the end of October 2022. Upon submittal and approval of the final design plans to TxDOT,the package will be incorporated into the larger TxDOT plan set. This plan set is to be used as a basis for preparing a corresponding 44 October 7,2022 Report No. 2022-063 engineer's opinion of probable cost for the construction cost that will be incurred during the highway improvements which is anticipated to begin in 2024. As TxDOT progresses forward with their original form liner (5 X 10 panels) design of their overpasses, the City of Denton will only be responsible for the cost of the additional imprinted designs on the panels, paint schemes, additional lighting and any other additions which may be included onto ongoing maintenance and repair agreements. The preliminary anticipated cost for each of the recommended locations are as follows: • Loop 288 - $265,000.00 (Concept A-1 & Concept A-2; imprinted design only) • U.S. 380 - $260,000.00 (Concept B-1 & Concept B-2; TWU, imprinted design only) • W. Oak Street- $287,500.00 (Concept C-1 & Concept C-2; imprinted design only) • I-35E and Interstate 35W at Bonnie Brae Street - $300,000.00 (Concept D-1 & Concept D-2; imprinted design only) The preliminary estimated total cost is $1,112,500.00. This is based on an estimated cost of$50 per square foot. Per TxDOT, costs per square foot have been lower,but staff wanted to estimate higher based on the market. Final costs will not be realized until bids are received. This will be budgeted in FY2023-2024. CONCLUSION: Staff recommends the acceptance of the work done by the City of Denton's Park and Recreation Department and their coordination among various partners and boards which have given input for the refinement of the aesthetic concept plans. Staff recommends permission be given to the City of Denton Capital Project/Engineering Department to submit the prepared final construction documents to TxDOT for their review and approval once completed by the end of October. The submittal of the construction documents will allow for TxDOT deadlines to be met and allow for the progress to move toward construction. ATTACHMENTS: 1.
