Friday Report Distribution for Veteran’s Day – In observance of Veteran’s Day, all City of Denton offices will be closed on Friday, Nov. 11. Due to the closure, this week’s Friday Report is distributed to Council and posted on the City’s website one day earlier, on Thursday, Nov. 10. State of the City – On Nov. 17, the City of Denton is hosting the annual State of the City event in-person from 6 to 8:30 p.m. The Denton City Council, City staff, and other community members will gather to share major milestones from the past year and key priorities for the future, as well as offer opportunities to get involved in our community. • At 6 p.m., City staff will host an engagement fair to help residents learn about City services, programs, and events. • At 7 p.m., Mayor Gerard Hudspeth will give a formal address featuring video highlights from the past year and projects on the horizon. Following the address, Mayor and City Management staff will answer community questions during a Q&A session as attendees continue visiting departmental tables. This event is free and open to the public and will be hosted at Embassy Suites by Hilton Denton Convention Center (3100 Town Center Trail). Board of Ethics Proposed Ethics Ordinance Amendment Tracker – Staff has developed and published a dashboard to track all Board of Ethics proposals to amend the City’s Ethics Ordinance. This dashboard is now available on the Board of Ethics public webpage and provides high-level information on the proposal’s intention, the date and a link to the most recent meeting the proposal was discussed, as well as the proposal’s status. The information on what each status means has also been added in the “Ordinance Amendment Proposals” tab directly above the dashboard. Staff believes that this dashboard will help to improve transparency and accountability and facilitate the tracking of Board of Ethics and City Council actions with regards to the Ethics Ordinance. TATOA Awards – On Nov. 3, the City of Denton and DTV won six programming awards at the Texas Association of Telecommunications Officers and Advisors (TATOA) Annual Programming Ceremony. These annual awards recognize excellence in programming produced by local government agencies from across Texas. The City of Denton competes at the highest level against cities such as Dallas, Houston, Austin and San Antonio. DTV distinguished itself in video production by winning two 1st place awards and four 2nd place awards: • 1st Place - CAT 8 – Public Education: Denton Landfill: A Cell for the Future • 1st Place - CAT 28 – Parks & Rec: Did You Know: Parks and Recreation • 2nd Place - CAT 6 – Documentary: City Hall West: A Very Odd Building • 2nd Place - CAT 12 – Profile of an Organization: Denton Fire: Clear Creek Prescribed Burn • 2nd Place - CAT 34 – Weather: Snow Day in Denton • 2nd Place - CAT 35 – Storytelling: A Tale of Two Births All videos aired on DTV, were shared via social media channels, and are available on the City’s YouTube channel. Texas Travel Industry Recovery Grant Program – The State of Texas recently opened the application period for the Texas Travel Industry Recovery Grant Program (TTIR). TTIR offers one-time reimbursement grants of up to $20,000 for the recovery of Texas businesses that were negatively impacted due to COVID-19 and is funded by the Coronavirus State Fiscal Recovery Fund under the American Rescue Plan Act of 2021. The grant is provided via a statewide program being administered by Texas Economic Development. Eligibility criteria, required documentation, and instructions on how to apply can be found on Texas Economic Development’s website online. Applications must be submitted through the State’s portal prior to November 22 for food service and beverage establishments. Staff contact: Laura Behrens, Finance F. Inclement Weather Warming Stations – Staff compiled and updated the 2022-2023 winter season warming stations list attached, with the updated information now available online. The list includes City facilities available for daytime use, including libraries, fire stations, and five recreation centers. Warming stations provide access to restrooms, water fountains, and a most provide sitting area. These facilities are in addition to the services community and non-profit partners make available during inclement weather. Staff confirmed extended hours at community partner agencies included in the list of warming stations attached. Staff contact: Megan Ball, Community Services G. PARD Staff Receive Awards at TRAPS North Region Conference – The Texas Recreation & Park Society held its North Regional Conference on Thursday, Nov. 3. Several City of Denton Parks and Recreation (PARD) staff attended the meeting to learn best practices from local peers and to share their own expertise in parks maintenance, management, and planning. Denton PARD staff were recognized for their excellence during the TRAPS awards ceremony. Mia Macy, who serves as the Adaptive and Inclusive Recreation Coordinator, was honored with the Horizons Award recognizing outstanding early-career parks professionals. Chris Escoto, a planner with PARD, received the Parks Professional of the Year award, which awards extraordinary contributions in Parks and Recreation and recognizes individuals who make an outstanding impact within their own organization and are responsible for work that is exemplary in its advancement of the parks and recreation profession. Unity Plaza Dedication Update – The University of North Texas (UNT) dedicated Unity Plaza on Saturday, Nov. 5, with City staff and members of Council in attendance. Unity Plaza honors Abner Haynes and Dr. Leon King as the first African Americans to integrate major college football at a four-year university in Texas. Unity Plaza is located between 4 Apogee Stadium and the UNT Athletics offices on the UNT campus and will be included in the City’s public art collection. Teen Tech Tuesday – Denton Teen Council has partnered with the Denton Senior Center for a community service project to provide older adults and seniors one-on-one help with their technology questions. This collaboration was sparked as senior center staff heard from patrons of frustration with phone storage, apps not working properly, or difficulties setting up a new tablet or smartphone. Interaction between both groups is great for technical and interpersonal skill-building and is a wonderful opportunity for intergenerational bridge building. Denton Teen Council teenagers gain real-world experience and the opportunity to give back to their community, while seniors get their technology questions answered by tech-savvy teens. Sessions are held on the first Tuesday of each month from 5 to 6 p.m. Those interested can simply drop in and get the help they need. Participants are encouraged to bring their own devices to receive quality hands-on learning. The first session was held at the Denton Senior Center on Nov. 1 with six seniors and 15 members of the Teen Council in attendance. Staff contacts: David Ruiz and Nicole Brasher, Parks and Recreation Responses to Council Member Requests for Information A. City Hall West – Facilities Management, along with Architexas, presented a work session item at the Nov. 1 Council meeting seeking direction on the future use for City Hall West. Council Member Watts inquired on total square footage with and without the infill floors. To update the space to allow for either of the recommended options, the infill floor must be removed, resulting in a loss of 2,573 square feet from the building total. The square footage of the building without the infill floors will be approximately 14,000 square feet. Staff contact: Trevor Crain, Facilities B. Forestar Eagle Creek Development – On Nov. 1, staff and several members of Council received emails from a resident regarding the Forestar – Eagle Creek Development. On Nov. 7, staff received a follow-up email from the resident. The resident had four items in the Nov. 1 email that were responded to and two items in the Nov. 7 email responded to, with both questions and responses included below: • Item 1. Inaccurate drainage creating mosquito disease breeding ground. o Inspectors from the City’s Watershed Protection Division visited the site on November 2, 2022. The basin was slowly draining. The developer was directed to make improvements to achieve positive drainage within 72 hours of rain events or treat the basin with a larvicide to control mosquitoes. The site will continue to be inspected on a roughly monthly basis for stormwater construction compliance throughout the project. November 7th inquired about another pond on the eastside of the creek for holding water. The eastside pond is a siltation basin which is stormwater control designed to slow stormwater flow and allow silt to settle out prior to leaving the construction site. This siltation basin is designed to hold water and based on rainfall may or may not contain standing water. • Item 2. Streetlights not hooded flooring Denton hooded light code. o The streetlights pictured (post top with acorn style globe) are a standard offering for residential streets and are consistent throughout the city. 5 Originally, staff responded they were not aware of a hooded streetlight ordinance. After follow-up from a council member and the resident, staff confirmed that streetlights are regulated under the Denton Development Code (DDC) 7.11.6 Street Lighting which states: “All street lighting shall be full cut-off and designed to direct lighting below a 90-degree horizontal plane extending from the lowest point of the light source.” The streetlights in the Eagle Creek Development do not meet this provision. This provision of the DDC has not been being enforced. • Item 3. Trees in protected area dead. “Replacement” sticks dead as well. o Inspectors from the City’s Development Services Department inspected the site on November 3, 2022, to determine site locations and loss of dead trees. New tree plantings provided by the developer/ homebuilder that died may still be under warranty or replacement timelines. Staff will work with Community Improvement to come to a solution with the developer/ homebuilder. Thank you for bringing this issue to our attention. o In the ESA, some trees in the area were dead prior to the tree protection fencing being installed and there are trees that have died during the project. The ESA boundary was expanded at project initiation to account for some losses, this expansion ensures the minimum protection is met • Item 4. Separate email. What is the story with this pond? Will there be a way to control mosquitoes and disease? o The detention area is the responsibility of the Homeowner’s Association (HOA). The maintenance and upkeep are the HOA’s responsibility. The City will work with HOAs on recommended best practices as normal course of business. The detention pond provides stormwater benefits as well as an aesthetic to the residents. HELPER Act – On Nov. 7, Mayor Hudspeth requested staff and our federal legislative consultants provide information on the HELPER Act and if the City should support it. The Homes for Every Local Protector, Educator, and Responder (HELPER) Act (HR 3172/S2981) would establish a Federal Housing Administration (FHA) mortgage assistance program to provide insurance for one-time, low-cost mortgages to law enforcement officers, firefighters, elementary and secondary school teachers, and other first responders for the purchase, construction, or repair of the recipient’s primary residence. The mortgages would not require a down payment or monthly mortgage insurance premiums (premiums would be paid upfront at a rate like other FHA-supported loans). Applicants would have to have at least four consecutive years of service and would certify in good faith that they intend to continue in their occupation for at least one more year. The program is in alignment with the 2023-2024 Legislative Program and has received significant support without significant opposition. Staff will send a letter of support to our congressional delegation regarding this legislation. Staff contact: Ryan Adams, City Manager’s Office D. Utility Bill Inquiry – On Nov. 7, Council Member Byrd inquired regarding the possibility of changing a utility bill due date, suggesting that it may be helpful if people can pick their own due date. Bill cycles are grouped in roughly equalized size groups by geographic 6 location to manage daily workloads for office and field staff. Since due dates are determined by the utility read and bill dates, customers are unable to set their own due dates; however, there are two existing options for customers who need more payment date flexibility: • Budget billing - Budget billing does require that the account is at a zero balance but then equalizes the monthly payment amount throughout the year. During the fall and winter, the customer builds a credit balance which helps to offset higher summer bills. If the minimum payment is made each month, the date of payment is not problematic, and no late fees are assessed. The account usage is assessed mid-year and adjusted in the event usage is different from the previous year. At the end of the year in September, the account is settled to determine if there are any excess charges or payments, and the account is set up for the new budget year. • Pay-As-You-Go prepaid utility services - Prepaid accounts have a slightly higher monthly facility fee but offer the greatest amount of flexibility and usage visibility. Pay As You Go customers utilize the MyUsage app and see their electric usage and costs daily. Customers maintain a credit balance that they can always view through the app. Payments can be made at any time and any day so long as a credit balance is maintained. Additionally, prepaid accounts never receive late or interruption fees and never require a deposit. Staff contact: Christa Foster, Customer Service and Animal Services E. Spencer Road Property – On Nov.7, Council Member Byrd inquired regarding the status the underbrush that was cleared from property owned by DME between Spencer Road and the DCTA Trail, as the property needs a second round of clearing and collection of the piles of debris. Parks and Recreation staff is working to attain quotes from contractors to conduct the work. At this time, Parks and Recreation does not have the resources to clear this property internally due to a continued shortage in staffing. Once the procurement process is complete, staff will work to ensure area clean up in partnership with DME, Environmental Services and Parks and Recreation. Home Occupancy Limitations – On Nov. 7, Mayor Hudspeth asked staff to contact an individual regarding their concerns about a home’s occupancy limits. Staff contacted the owner of the property who confirmed their intention to open a senior group home in the future. Staff advised the property owner of zoning regulations, inspection requirements, permitting information, and certificates of occupancy necessary to open and operate a senior group home. Staff will continue to follow existing processes for potential concerns regarding this address. Staff contact: Caleb Norris, Development Services Burial Permit Procedures – The City owns and operates both Independent Order of Odd Fellows (I.O.O.F) and Oakwood cemeteries. City staff issue burial permits, sell plots, and mark gravesites prior to funeral services. On Nov. 7, Mayor Hudspeth requested feedback on an inquiry made by Bill DeBerry Funeral Director regarding the administrative procedures for requesting burial plots and permits, in addition to arranging for gravesite markings. Staff followed up with DeBerry Funeral Directors to confirm the City’s existing procedures, which includes conducting business for immediate burial needs with funeral homes or directly with the family. Working with the funeral home is typically the utilized option. Staff is dedicated to accommodating the needs of both grieving families and funeral home businesses. Trash & Recycling Cart Curb Placement – On Nov. 8, Council Member McGee requested that staff provide notices to residents residing on narrow streets regarding when their trash or recycling carts may be placed on the curb. The current schedule was developed to support the needs of the community including people that work late, leave early, alternate sleep schedules, etc. to ensure that all residents can have their garbage and recycling collected. Pursuant to Sec. 24-43 of the City of Denton Code of Ordinances, residents have the right to have carts at the curb no earlier than 6 p.m. the evening prior to collection day to 8 a.m. the day following. Sec. 24-43. - Residential collection service: (a) All single-family residents within the city shall place their residential refuse and recyclables at the curb as specified by the general manager of solid waste services or designee. (b) Residential refuse and recyclables shall be placed at the curb no earlier than 6:00 p.m. on the day prior to the scheduled collection day. To ensure collection, residential refuse and recyclables should be placed at the curb by 7:00 a.m. on the day of collection. Additionally, (c) Solid waste and recycling storage containers and any unaccepted waste or recyclables shall be removed from the curb or other designated collection point by the customer no later than 8:00 a.m. on the day following the scheduled collection day. As part of the City’s education and outreach efforts, staff will continue to remind customers of the schedule. Staff contact: Brian Boerner, Solid Waste & Recycling H. Trash and Debris Clean Up on Audra Lane – On Nov. 9 Staff received several inquiries regarding a large amount of trash and debris located on Audra Lane. The Parks and Recreation Department assessed the site and performed a same-day clean-up, with photos of the cleaned area provided below. Veteran’s Day Program at Denton Senior Center – Denton Parks and Recreation and patrons of the Denton Senior Center will gather to honor veterans from all branches of our armed forces. The event will feature a patriotic music performance by the Young at Heart Band and will include light refreshments. Cross Timbers Playgrounds Ribbon Cutting – Parks and Recreation staff will be celebrating the opening of the Cross Timbers Playgrounds with a ribbon cutting at Cross Timbers Park South (8400 Clear River Lane) on Saturday, Nov. 12 at 9 a.m. Come by and enjoy free donuts and the new playground. Quakertown Public Input Meeting – On Nov. 14, at 6 p.m., Parks and Recreation will host a virtual meeting for public input regarding temporary signage and public events commemorating and memorializing the Quakertown community. Recycling 101 – Join Sustainability for National Recycling Day on Nov. 15 to review what’s accepted in curbside recycling, where the recycling goes, why certain items are not accepted, and what recycling becomes. American Legion Hall Senior Center Thanksgiving Luncheon – On Thursday, Nov. 17, from noon to 2 p.m., American Legion Hall (ALH) Senior Center will host the annual Thanksgiving Luncheon for members of the 50+ community with keynote speaker Dr. Kenneth Davis, pastor of Empowered Outreach Church. The event is free for senior citizens and features a performance by the ALH Senior Center Choir. The intent is to be transparent and share this information at the end of each fiscal year. DISCUSSION: In September of 2006, City Council passed Ordinance No. 2006-237 (Attachment 1). This ordinance raised the City Manager’s general expenditure authority of budgeted funds from $25,000 to $100,000 due to inflationary trends. General expenditures are defined as fees, professional services, personal services and other categories exempted from the bid process. The purpose of granting expenditure authority to the City Manager is to maximize efficiency, preventing Council and meeting agendas from being burdened with routine purchase approvals. To further maximize efficiency, the City Manager has delegated expenditure authority to the City’s Purchasing Manager for non-contractual, general purchases up to $50,000. At least three quotes are required by state law and are obtained for purchases between $3,000 and $50,000. State law does not require a formal, competitive bidding process for non-contractual agreements in this dollar range. The purchases are completed through a purchase order in the City’s financial software. In September of 2009, City Council passed ordinance No. 2009-189 (Attachment 2), granting the City Manager additional expenditure authority specific to Denton Municipal Electric (DME). This ordinance is separate from the general expenditure authority and allows the City Manager to authorize up to $500,000 for DME purchases meeting the following criteria: (a) the procurement is for materials and services for electric production, transmission, distribution, and station projects; (b) the project is included in the approved budget/CIP (c) the cumulative total of purchases for any project does not exceed the amount available for that project; (d) purchase, in excess of $250,000, that have been recommended for approval by the PUB or approved by City Council (whichever meets first) and; (e) standard purchasing practices have been followed. The general purchases up to $100,000 that were approved by the City Manager during fiscal year 2021-2022 are provided for informational purposes (Attachment 3). Fourteen purchases and amendments were approved by the City Manager using this authority. The City Manager’s additional expenditure authority for DME purchases up to $500,000 was not utilized in fiscal year 2021-2022. 15 November 10, 2022 Report No. 2022-072 CONCLUSION: Granting the City Manager expenditure authority for general purchases up to $100,000 provides Council more time and opportunity to review larger expenses and non-routine purchases.
