Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 21-1837,the following items will be discussed during the Dec. 6 Council Work Session: (1) Work session on Community Benefit Agreements (McGee). (2) Ordinance stipulating that if sales tax exceeds the anticipated amount, 15% of the overage will be spent on one-time expenditures for Denton Police Officers (Hudspeth). (3) Vote on adopting an ordinance identical to Proposition B at the next meeting after consensus direction is given(Beck). (4) Work session to prohibit public input at city-sponsored meetings including but not limited to city council meetings, from individuals participating via video feed if said individual is operating a motor vehicle (Watts). Letters to Federal Delegation— On Nov. 23, the City of Denton distributed two advocacy letters (attached) to the City's congressional delegation regarding two issues that may be considered by Congress after the Thanksgiving holiday. The first letter is related to a bill that, if attached to a must-pass defense spending bill,may require the city to purchase expensive financial reporting software with no indication of how it will improve transparency. The letter requests it not be attached to the defense bill but heard in committee so that stakeholders can provide input and better understand the intent and impacts of the bill. The second letter is related to a request to increase emergency federal funding to increase the supply of electrical transformers. There is a nationwide shortage of transformers, and the lack of supply may impact the City of Denton's growth and threatens the City's ability to keep up with development effectively and safely. Human Rights Campaign Municipal Equality Index Scorecard—The City of Denton is one of 506 cities nationwide that are rated by the Human Rights Campaign(HRC),a civil rights organization founded in 1980 representing the LGBTQ community,with over three million members and supporters. The HRC developed a Municipal Equality Index(MEI)scorecard to annually examine and rate how inclusive municipal laws, policies, and services are to the LGBTQ people who live and work in the community. Cities are rated based on 5 sections: (1) non-discrimination laws, (2) the municipality as an employer, (3) municipal services, (4)law enforcement, and(5)the city leadership's public position on equality. For the 2022 MEI, the City scored a 100, a 22-point increase over 2021, and a score that ranks Denton among the top cities in the state. Denton Named a Top Boomtown — In a recent study conducted by Smart Asset, Denton was named one of the fastest growing cities in the country over the past year. The study reviewed data from nearly 500 of the largest cities in America including population growth, income,GDP,businesses,housing,and changes in unemployment. The City of Denton was 2 ranked 19th in the study,with the nearby cities of Lewisville (9th),McKinney(33rd),Frisco (42nd), and Flower Mound (50th) also being ranked. NTC Newly Elected Officials Virtual Briefing — The North Texas Commission will be hosting a virtual briefing for newly elected local officials on Jan. 20, 2023, at 10 a.m. This briefing will stress the importance of regionalism and include regional economic profile information/data on how communities are interconnected. It will also include a discussion about the region's greatest challenges and what is being done to address them by public and private sector leaders. Court on Campus — The Denton Municipal Court will host its first Court on Campus outreach event at the University Union at the University of North Texas on Wednesday, Dec.7 from 10 a.m.to 2 p.m.This event will allow students to resolve any pending citations filed with the Denton Municipal Court, without fear of arrest. Students can also discuss options for keeping a citation off their record and opportunities for performing community service. Following the main event, Judge Atkinson will also lead a Q&A presentation for all interested students from 2 to 3 p.m. The Court on Campus event is co-sponsored by UNT Student Legal Services, Dean of Students, TRIO Student Support Services, and the Student Government Association. UNT is utilizing multiple channels to advertise the event, including: • Distribution of flyers (attached)to departments on campus and at table events • Advertising in the student paper,North Texas Daily, and on the TV's in the Dining halls • Placing information on UNT Weekly(email newsletter), campus publications, and websites • Posting the event on the Student Legal Services website, Facebook page, Twitter, and Instagram • Placing custom yard signs at several locations on campus The main court location,phone lines,and online services will remain open during the event. Staff contacts: Judge Atkinson and Jamie Lindsay, Municipal Court G. City of Denton HOME-ARP Allocation Plan—The City of Denton is accepting comments on a draft HOME-ARP Allocation Plan. The plan details how the City intends to distribute the $1,763,622 in HOME Investment Partnership American Rescue Plan (HOME-ARP) funds received from the U.S. Department of Housing and Urban Development(HUD). The plan proposes to allocate funds to eligible entities through a Notice of Funding Opportunity (NOFO) application process to provide Tenant-Based Rental Assistance (TBRA) and Supportive Services. Any individual, group, or agency may submit comments regarding the HOME-ARP Allocation Plan by mail(401 N. Elm Street, Denton Texas 76201), email (CommunityDevelopment@cityofdenton.com) or fax (940-349-7753). A public hearing will be held on Dec. 13, 2022, at 6:30 p.m. during a City Council meeting in Council Chambers at City Hall, 215 E McKinney Street, Council Chambers, Denton, TX 76201. The HOME-ARP Allocation Plan will be submitted as a substantial amendment to the 2021/22 Action Plan for Housing and Community Development. All comments received by December 14, will be considered by the City before submission of the HOME-ARP 3 Allocation Plan to HUD. Citizens may review the report online. YouTube Facebook • New Holiday Lights: In collaboration with the Denton Main Street Association, Denton Parks and Rec coordinated the rollout of new holiday lights downtown and it wouldn't have happened without DME. DME Receives Smart Energy Provider Designation — Denton Municipal Electric (DME) was recognized as a Smart Energy Provider by the American Public Power Association on December 1. DME joins 100 other Public Power utilities that hold the SEP designation. The Smart Energy Provider(SEP)program is a best practices designation for utilities that show commitment to and proficiency in energy efficiency, distributed generation, renewable energy, and environmental initiatives. The purpose of the Smart Energy Provider program is to provide national recognition of utility efforts to incorporate energy efficiencies and sustainability while providing affordable electric service. Additionally, achieving SEP designation will help DME benchmark and evaluate our work on these topics against a set of industry best practices. Athletics Tournaments Economic Impact Update — Parks and Recreation Athletics staff held five tournament rentals in Denton parks during the first quarter of the fiscal year. These events have included youth baseball and youth fast pitch softball. With teams traveling from across Texas and Oklahoma, staff estimate these events brought approximately 1,820 athletes/participants along with upwards of 11,000 spectators into the City of Denton. These events also generated $472,000 of economic impact to the City of Denton. 4 The Athletics Division also hosted the Texas Amateur Athletic Federation (TAAF) State Youth Flag Football tournament on November 19-20, 2022. This event took place at the Vela Athletic Complex. There were five 6 &Under teams,ten 8 &Under teams, seventeen 10 & Under teams, and ten 12 & Under teams competing for the title of State Champion. A total of 491 athletes and approximately 2,946 spectators were in attendance. This event helped generate $188,400 in economic impact. The total economic impact generated from tournaments for FY2022-2023 is currently estimated at $660,400. Staff contact: Jason Barrow, Parks and Recreation K. Innovative Transportation Solutions (ITS) Monthly Mobility Report — During each Mobility Committee meeting, John Polster, the City's transportation consultant with Innovative Transportation Solutions, Inc., typically provides an overview of the attached Mobility Status Report on several major regional Texas Department of Transportation (TxDOT) projects. Muzquiz Friendship City Signs — In May 2022, the City Council directed staff to place signs signifying our friendship city relationship with Muzquiz, Coahuila, Mexico, at the roadway entrances into the City. Staff developed a design and shared it with Proyecto Diez, a local community group with Muzquiz ties, for feedback. Following their approval, the Traffic Operations division utilized an in-house sign printer to fabricate the signs. Staff installed the signs on existing City Limit sign poles on Nov. 21. Blackberry Way Groundwater Mitigation Project—In recent months, staff received several reports regarding groundwater and runoff leading to the accumulation of debris and slick roadway conditions along the curb line and across Blackberry Way. Staff in Drainage and Engineering partnered to design a solution to mitigate the slick conditions by diverting water away from the roadway and into the underground drainage system. Design work was completed in June; however, construction was delayed by concrete shortages during the summer months. Materials were recently received, and construction was completed during the week of Nov. 14. Staff is pleased to report that the groundwater is draining appropriately and no longer impacting conditions on Blackberry Way. Staff contact: Ethan Cox, Streets and Drainage B. Traffic Cones on Teasley and Dallas Drive—On Nov. 21, Council Member Byrd inquired on seemingly unused cones placed throughout Teasley Lane and Dallas Drive. Staff investigated and confirmed the traffic control devices were for recent Atmos emergency repair. This repair was coordinated with TxDOT and cones were removed by end of day. Traffic Calming Intersection of Oakland Street and Congress Street—On Nov. 27, Council Member McGee inquired about the visibility at Oakland Street and Congress Street. Capital Projects/Engineering currently has a project designed and awaiting construction along Parkway Street and Oakland Street, ending at the intersection of Oakland Street and Congress Street. The project will create an on-street trail and reconfigure the drive lanes on Parkway Street and Oakland Street, improve bicycle/pedestrian access, improve crosswalks, and provide traffic calming effects to both Parkway Street and Oakland Street. The project is anticipated to start construction in mid-Jan. 2023, with a Pre-Construction Community Meeting to be scheduled prior to the start of construction. Staff contact: Brett Bourgeois, Capital Projects/Engineering D. Elm and Locust Agreement— On Nov. 27, Council Member McGee requested an update on the status of the acquisition of Elm and Locust. Capital Projects/Engineering staff is currently working with Denton County and the Texas Department of Transportation (TxDOT) on the next steps for Elm and Locust, which includes an agreement between the three parties. Funding for Elm Street and Locust Street north of Hickory Street was included in the Denton County TRIP 2022 Bond election. The northern portions will include waterline, sewer line, drainage, and roadway replacements. The southern portions south of the courthouse included waterline, sewer line, and drainage which have all been completed, and the City is working with Denton and TxDOT on the roadway replacement agreement. TxDOT performed a pavement design analysis which is reviewed for the City of Denton. Staff will provide a Work Session at the Dec. 13 City Council meeting which will include additional information and updates regarding Elm and Locust. Water Outage on Groveland Terrace — On Dec. 1, Mayor Pro Tem Beck asked staff to contact a resident regarding a water outage at his residence on Groveland Terrace. The 6 information was also submitted as an Engage Denton request. Staff reached out to the resident to discuss the unexpected issue that resulted in the water service being turned off. The service restoration time was estimated at approximately 1 to 2 hours. Staff contact: Stephen Gay, Water Utilities F. Housing Demographics — On Dec. 1, Mayor Pro Tern Beck inquired as to whether staff could direct him to current owner-occupancy housing demographics. Holiday Lighting Festival—Kick off the holiday season as a community and light the night tonight in Downtown Denton at the Holiday Lighting Festival hosted by the Denton Holiday Lighting Association! Together we'll sing and countdown for the flip of the switch as the Courthouse Lawn, tree, and surrounding City scene light up in a splendid fashion. Then enjoy a night of parks, play, and free entertainment from some of Denton's finest musicians and artists. The event will run from 6 to 9 p.m. Friday, Dec. 2. Don't forget to stop by Peppermint Park presented by Denton Parks and Recreation (PARD) to enjoy free bounce houses, lawn games, hot cocoa (while supplies last), and PARD giveaways. The Teen Council will also have a photo booth and face painting. The photo booth includes two photo strips and a digital copy for $4 or a donation of a coat or toy. Face painting prices range from $5-10 depending on the design. All funds and donations will be used to help families in need during the holiday season. Movie in the Park: ELF — Join Buddy the Elf as he brings his family together for the holidays at our free Movie in the Park in Quakertown on Dec. 9 from 6 to 9 p.m. Free preshow activities will begin at 6 p.m. including inflatables, lawn games, and a visit from your favorite Elf—Buddy, with the moving beginning at 7 p.m. Be sure to bundle up and bring your own blankets and chairs for this family-friendly event. Cheese and Salsa food truck and Frio's Gourmet Popsicles will be onsite offering sweet and savory treats for purchase. PARD will be selling popcorn and sodas. Wreaths Across America—Denton Parks and Recreation will host its first National Wreaths Across America Day event on Saturday, Dec. 17 at Oakwood Cemetery (747 East Prairie Street) beginning at 11 a.m. Wreaths at each of the 253 veteran gravesites at Oakwood Cemetery were sponsored by donation. The wreath-laying ceremony is open to the public and will include the Fire Department's Pipes and Drums, an address by Rev. Reginal Logan, and the delivery and placement of the wreaths. McKinney St., Denton, TX 76201 • (940) 349-8307 November 23, 2022 The Honorable John Cornyn United States Senate Washington, DC 20510 Via email: andrew_siracuse(&comyn.senate.gov Dear Senator Cornyn: The City of Denton is concerned about efforts to attach the Financial Data Transparency Act (S 4295), to the National Defense Authorization Act (NDAA). Section 203 of S 4295 would require the Municipal Securities Rulemaking Board(MSRB)to establish uniform data standards for local government. This proposal would impose a major unfunded mandate and significant administrative burdens on many local governments and public entities, including the City of Denton. We are especially concerned about how suddenly this mandate has arisen. S 4295 was introduced just four months ago, and the Senate has not held hearings on it. It would be premature to rush this provision into law via a "must pass" bill such as the NDAA without first providing stakeholders with an opportunity to provide the Senate with additional information about its potential adverse impacts. The City of Denton strongly supports transparency and accessibility of information. We strive to make our budget and financial data easily available to Denton residents and other stakeholders. However, this legislation raises numerous concerns, including: • It would impose an unfunded mandate and administrative burden on local governments. We are especially concerned it will require that local government buy and implement expensive new software and reconfigure existing systems or purchase expensive new systems. • It could create more confusion or reduce the transparency of publicly available information. Most state and local governments adhere to governmental reporting standards established by the Governmental Accounting Standards Board (GASB) and this bill could create standards and requirements that conflict with GASB standards. • The FDTA poses an unprecedented, substantial overreach by the federal government. It could empower the MSRB to essentially dictate both the structure and content of disclosures, and indirectly prescribe the accounting and reporting principles of state and local governments and other public entities, which would be a breach of principles established in federal law that served as guardrails for over 50 years, and ultimately the basic tenets of federalism. • In addition,the bill seeks to establish the standards within an unreasonable timeframe. It is already troubling that there is no requirement to solicit input from issuers as drafted. GASB often takes 5-10 years to go from workplan to implementation when developing statements. The FDTA would impose these challenges on a wide array of public entities, including states, cities, counties, water systems, hospitals, and public power. Forcing these very different entities to use a single, standardized template could cause many local governments to lose valuable, detailed information for constituents and could subsequently reduce transparency by eliminating data specific to those entities. Additionally, transitioning to this reporting scheme would require extensive staff time and costly upgrades to financial systems to accommodate the rules. For these reasons, I respectfully urge you to oppose attaching this legislation to the NDAA and allow this proposed legislation to be properly vetted with involvement from stakeholders. McKinney St., Denton, TX 76201 • (940) 349-8307 November 23,2022 The Honorable John Cornyn United States Senate Washington DC 20510 Via email: laura atchesonAcornyn.senate.gov Dear Senator Cornyn: The supply chain problem affecting electric distribution transformers has reached a crisis level that requires extraordinary action from the federal government to ensure that Denton Municipal Electric (DME)and other utilities can continue to provide reliable electrical service to our customers. I am pleased that earlier this year the Administration invoked DPA to address this crisis and both the pending House and Senate FY 2023 Energy&Water Appropriations bill include funding to allow DOE to address it. As Congresses finalizes the FY 2023 budget,the City of Denton urges you to provide$1 billion for Defense Production Act(DPA)implementation to allow the Department of Energy (DOE)to address supply chain issues for electric distribution transformers. This supply chain issue is especially acute for a growing community like Denton,where we struggle to both replace aging equipment in existing neighborhoods and provide service in new and growing neighborhoods. DME currently has nearly$16 million in outstanding purchase orders for electric distribution transformers,with a waiting time of 70 to 104 weeks for delivery of new orders. This issue is not unique to Denton. Earlier this year,the American Public Power Association(APPA) surveyed its members several times to better understand the supply chain constraint of distribution transformers. Simply put,the survey found production is not meeting the demand,with average lead times to procure distribution transformers for all voltage classes rising 429 percent between 2020 and 2022 and some utilities reporting lead times of more than three years and others reporting that manufacturers had stopped accepting their bids. The distribution supply chain shortage is having economic impacts. According to APPA's survey results, one in five infrastructure projects by public power utilities were being deferred or canceled because they are unable to procure the additional distribution transformers required for these projects. These shortages are posing urgent threats to reliability and resiliency,especially in communities recovering from a disaster. The APPA survey found many utilities are at low or near zero emergency stock,with 30%reporting that they are at risk of being OUR CORE VALUES Inclusion• Collaboration • Quality Service • Strategic Focus •Fiscal Responsibility ADA/EOE/AREA www.cityofdenton.com TDD(800)735-2989 11 out-of-stock within one-month,24%reporting being at risk of being out-of-stock within three months, and 46%reporting being at risk of being of out-of-stock by the end of the year. Denton's current inventory of transformers are at levels reserved for normal,daily electric service operational responsibilities and emergency response,but not at levels to support the incredible growth we are experiencing in the City and across the State of Texas. DME has forty-five construction-ready projects and another 128 projects currently in the design phase. Due to the low inventory of transformers and current supply chain issues,we have notified customers and developers DME may not be able to provide immediate service to these projects. For Denton,delivery of ordered transformers is unreliable as most vendors are not able to provide a clear delivery date. Normal delivery is 20-25 transformers. Denton now gets a fraction of that amount with each delivery. Even when transformers are delivered,the quality of the delivered transformers is lower. For example, an inspection on a recent delivery of 10 transformers identified five transformers were missing bushings and two of those were leaking making them unusable. Therefore, only five of the delivered 10 transformers were usable by Denton.Additionally,Denton has experienced price increases for transformers at 250%or higher. This issue is not just a public power issue,but a public safety issue that impacts all electric utilities and the construction industry. I have attached a letter that APPA,the Edison Electric Institute,the National Rural Electric Cooperative Association,the Leading Builders of America,the National Association of Homebuilders, and the Associated General Contractors recently sent to the House and Senate Appropriations Committee request$1 billion in FY 2023 funding to allow DOE to address this crisis under DPA.
