Pending Council Requests Work Session Topics – Pursuant to Ordinance No. 21-1837, the following items will be discussed during the Dec. 13 Council Work Session: 1) An interim Informal Staff Report on our goal to Vision Zero. 2) An ordinance preventing people adverse to the City or in active litigation from being nominated to a position serving on boards and commissions. Announcement of Interim ACM – Last month, staff announced that Deputy City Manager David Gaines was recently selected to be the next City Manager for the Town of Addison. We immediately began preparations for a nationwide search for our next Deputy City Manager and expect that process to last into the spring. To ensure departments continue to receive a high level of leadership support during this transition, we also opened an Interim Assistant City Manager position for internal candidates. After an extensive application and interview process with several qualified candidates, the executive team is excited to announce that Finance Director and CFO Cassey Ogden will be the interim Assistant City Manager beginning Saturday, Dec. 10. Please see the attached memo that was distributed to employees this afternoon for more information and an updated organizational chart. Ryan Adams, City Manager’s Office C. Municipal Court Delayed Opening 12/14 – The Municipal Court will delay opening until 9:30 a.m. on Wednesday, Dec. 14 for staff development. The closure is necessary to allow for all employees to actively participate and should have minimal impact on the public. All online options will remain available for case information, payment remittance, and submission of resolution requests. Messages advising of the delayed opening and online options will be placed on the phone system and at the court entrance. Staff contact: Jamie Lindsay, Municipal Court D. Week of December 26 Friday Staff Report – In anticipation of the holidays and the closure of City offices during the last week of December, the City Manager’s Office will not distribute a Friday Staff Report on Friday, Dec. 30. Denton County MHMR Community Needs Assessment – Denton County MHMR is conducting a Community Needs Assessment to determine gaps in services and obtain feedback that will assist in making future funding decisions. Denton County MHMR is a Certified Community Behavioral Health Clinic (CCBHC), and as part of the certification, they are required to complete a community needs assessment every three years. A QR code is available on the attached flyer to access the online survey. Paper surveys are available at MHMR’s mental health offices in Denton and Flower Mound. Inclement Weather Warming Stations Update - Attached is an updated list of warming stations available during inclement weather for the 2022-23 winter season, effective Dec. 12. This information is also available on the City’s website. The list includes City facilities available for daytime use at all libraries, fire stations, and five recreation centers. 2 Warming stations provide access to restrooms, water fountains, and a sitting area. These facilities are in addition to the services our community partners make available during inclement weather. Staff confirmed the extended hours at community partner agencies that are included in the list of warming stations. Staff contact: Megan Ball, Community Services G. 2021-22 Consolidated Annual Performance and Evaluation Report – The Consolidated Annual Performance and Evaluation Report (CAPER) is a year-end performance report required by the U.S. Department of Housing and Urban Development (HUD). The City of Denton receives Community Development Block Grant (CDBG) and HOME Investment Partnership Program grant entitlement funds annually from HUD for affordable housing, community development, economic development, and public services. Participating entitlement cities are required to develop a CAPER annually. The CAPER assesses the City’s progress and the effectiveness of its performance related to its federally funded activities during FY 2021-22, and the achievement of its overall strategies, objectives, and priorities outlined in the FY 2020-22 Consolidated Plan. The Draft FY 2021-22 CAPER will be available for review during the public comment period from Dec. 12 through Dec. 26. A public notice requesting public comments will be placed in the Denton Record-Chronicle on Sunday, Dec. 11. The report can be viewed on the City’s Community Development webpage. The city will submit this report to HUD by Dec. 30, 2022. A final summary of the CAPER will be provided to City Council once HUD approves the report. Quakertown Centennial Memorial Project Update – City staff continue to receive public input about temporary memorial options and event ideas for the Quakertown Centennial Memorial Project. Following the initial Council work session on Sep. 13, staff conducted the following community engagement efforts to receive feedback on the project: • SEDNA Meeting October 24 • Twilight Tunes November 3 • Parks, Recreation and Beatification Board Meeting November 7 • Virtual Public Meeting November 14 • St. Emmanuel Church Service November 20 • Public Meeting (Hybrid) December 1 • ALH Senior Center Outreach Meeting December 6 • SEDNA 2019 Street Bond Community Meeting December 8 Staff also placed informative placards and comment cards at ALH Senior Center and MLK, Jr. Rec Center. Additional placards and comment cards have been placed at other City recreation centers. Comment cards can be returned to any recreation center and staff will forward those cards to the appropriate Parks Department staff. City staff also reached out to numerous community stakeholders, including the Denton County Office of History and Culture, UNT, and TWU, and hope to solidify a calendar of events soon. These events will include historical, artistic, cultural, and musical events that all center on Quakertown and its history. These events will emphasize the vibrancy 3 of historic Quakertown and remind all of Denton that the descendants of Quakertown continue to have a robust presence in the cultural life of our city. City staff are pursuing temporary memorial options and a calendar of commemorative events in advance of a master planning process at Quakertown Park that will include the placement of a permanent memorial. Recordings of past meetings, updates about the current progress on the Centennial Memorial Project, and opportunities to ask questions directly to staff and to provide feedback online are all available at www.discussdenton.com. Adjustment to Municipal Equality Index Scorecard – In the Dec. 2, Friday Report, staff conveyed that the City had recently scored 100 on the Human Rights Campaign (HRC) Municipal Equality Index. This score was a 22-point increase over 2021 and a score that ranks Denton among the top cities in the state. Since that report, the City of Denton’s score was adjusted to reflect a score of 94. The cause behind the adjustment is not clear and the City has inquired with the Human Rights Campaign and, to date, has not been provided information relating to the adjustment. Fire Marshal Designation - Congratulations to Dr./Battalion Chief Megan Schuth for being awarded the professional designation of Fire Marshal (FM) this week. Following an extensive peer review process, this designation recognizes demonstrated excellence in seven measured components: experience, education, professional development, professional contributions, association membership, community involvement, and technical competence. In receiving this designation, she joins a select group of only 231 FMs worldwide. Staff contact: Kenneth Hedges, Fire 4 K. Climate Action and Adaptation Plan Kick-Off - Community engagement for the City’s first Climate Action and Adaptation Plan will kick off with an introductory webinar on Wednesday, Dec. 14 at 6 p.m. (webinar registration via Zoom). Engagement activities will take place from December 2022 through May 2023. Interested parties can register to receive updates about upcoming activities and view the introductory webinar, which will be recorded and posted, on the Sustainable Denton webpage. There will be many opportunities for the community to learn more about climate action planning and to provide input throughout the plan development process. Privet Removal Update – Beginning in December 2022, the Parks and Recreation Department and the Environmental Services and Sustainability Department will recommence efforts to restore native habitats by controlling invasive Chinese Privet. Efforts to contain privet involve cutting privet shrubs and treating them with herbicides approved within the City’s Integrated Pest Management (IPM) policy. The following schedule of privet containment efforts is deeply contingent on weather conditions as overly wet or windy conditions will make it difficult to get shrub-cutting equipment to the proper locations and to apply the herbicide effectively. Weather permitting, privet control efforts will take place in the following locations, as seen on the attached map: • Dec. 12: Bowling Green Park within the forested area along the eastern edge of the channel. • Dec. 14: Spencer Road across from the Denton Municipal Electric property. Following removal efforts, Parks and Recreation staff will assist in restoring the forest understory and improving habitat conditions by possibly applying a native seed mix site-wide and by planting additional seedlings and native shrubs. The effort to contain and control Chinese Privet may take two to three years given the current density of growth and expected proliferation of the species. Department of Army Corps of Engineers Payment – On Sept. 20, 2022, the City Council approved a payment to the United States Army Corp of Engineers (USACE) for the Lake Ray Roberts and Lake Lewisville annual Major Capital Repair (MCR) and Operations and Maintenance (O&M) fees. A commitment was made to follow up with City Council on the dollar amount that was paid for the 2023 fiscal year. Payment for MCR and O&M fees for Lake Lewisville and Lake Ray Roberts was remitted at $129,355 for FY 23. Staff contact: Stephen Gay, Water Utilities 5 N. Carnegie Ridge Drainage Review – In September 2022, Council Member Maguire requested that staff investigate drainage issues in the Carnegie Ridge neighborhood. Residents residing on Ridgelea Court and Cedarhurst Court expressed concern to then- Council Member Maguire that runoff to their properties had increased because of the development of an adjacent property, located at 734 Crawford Rd in Argyle. Following receipt of this request, staff initiated a review of the development, the neighborhood’s drainage design, and the City-owned right of way (ROW) north of Crawford Road. The property at 734 Crawford Rd is located outside of Denton city limits, and the City does not have dedicated right of way or drainage easements on the property. The development at this location was permitted through Denton County. During staff’s review of the drainage issues, City staff contacted the County’s Development Services staff to determine if the development met County standards for drainage design. The County confirmed that the development met their standards. Staff also evaluated the potential for additional improvements within the ROW. One option was to construct a drainage ditch; however, due to existing grades, it is not possible to construct a ditch on the north side of Crawford as the existing embankment grades are already at the maximum allowable slope. Steepening these grades further to construct the ditch would pose a danger to vehicular traffic and make the area more hazardous to mow and maintain. Staff also evaluated constructing an underground storm sewer drainage system, but this option would include significant costs and only offer a modest benefit. Staff estimates that the best effect this option could achieve would be an approximate 25% reduction in flow for the seven (7) homes immediately downstream. This option would also require removing most or all trees within the existing tree buffer. A rough estimate of the construction cost for his work would be around $195,000. Staff also reviewed the neighborhood’s drainage plans and concluded that much of the runoff into the residents’ backyards appears to be a consequence of how the subdivision was graded by design. The subdivision plans show runoff being concentrated to flow over retaining walls along resident backyards, and what has been observed is consistent with this design. Given the neighborhood’s design as well as the high cost, modest benefit, and environmental impacts of additional drainage facilities, staff does not recommend proceeding with additional drainage improvements in this area. Council Meeting Policies – On Nov. 23, Mayor Pro Tem Beck inquired about text or URLs of any Charter, City of Denton policy, or guidelines on how City Council meetings should be run. Staff advised City Council meetings are conducted in accordance with the following laws and procedural rules: • The Texas Open Meetings Act - Texas Government Code Chapter 552 • City of Denton Charter - Denton City Charter • City Council Rules of Procedure - City’s Code of Ordinances, Chapter 2, Article II, Sec. 2-29 • City Council requests for information or agenda items - City’s Code of Ordinances, Chapter 2, Article II, Sec. 2-30 6 • Robert’s Rules of Order - Due to copyrights, there is no link, however, the newest edition can be purchased online or checked out at the library. There is not currently a website where uncodified ordinances/resolutions are available to the public. Staff contact: Mack Reinwand, City Attorney’s Office B. Record Expunction – On Nov. 27, Council Member McGee inquired about the number of individuals living in the City of Denton who may be eligible for record expunction. Staff advised there is not a means to estimate the number of individuals eligible for expunctions on county charges residing in the City. Staff contact: Tyler Atkinson, Municipal Court C. Sam Bass Boulevard Construction Update – On Dec. 2, Council Member Davis shared concerns from a resident regarding the ongoing construction at Sam Bass Boulevard. Staff confirmed that the project has reached a point where only smaller tasks remain to tie in the new water main. There will still be some work occurring that will require lane closures over the next month; however, the roadway is now open in both directions. Staff contact: Wesley McBride, Capital Projects/Engineering D. Noise Ordinance – On Dec. 3, Mayor Hudspeth asked staff to reach out to a local business owner regarding the City’s noise ordinance. Due to the proximity of his business to both the DCTA rail line and the Union Pacific Railroad, the owner offered to assist with any future updates to the noise ordinance. Staff is evaluating the City’s current ordinance and will reach out to the business owner as the revisions progress. Staff contact: Frank Dixon, City Manager’s Office E. Agenda Item S22-0003b Follow-Up – On Dec. 6, Mayor Pro Tem Beck requested a statement of the fish and wildlife regulations and dark sky alignment on agenda item S22-0003b, related to the monocle tower. The tower as proposed in 22-003b meets several of the USFWS voluntary guidelines for communication towers (no guy wires, co-location opportunities, less than 150 feet). The tower lighting will meet FAA requirements for towers, which are exempted from Dark Sky guidelines. Staff contact: Michael Gange, Environmental Services & Sustainability F. Concept Plan for Oak Vista PD – On Dec. 6, Mayor Pro Tem Beck requested a copy of the Oak Vista concept plan not included in the backup materials. Water Park Fees – On Dec. 6, Council Member McGee forwarded a resident’s concern regarding increased water park fees during the 2022 season. The new fees were presented to the Parks, Recreation, and Beautification Board which unanimously approved the changes at the Feb. 7, 2022, meeting (5-0). Additionally, to attract and retain enough staff to be able to operate the facilities during the season. Parks and Recreation will run a series of promotional opportunities for discounted season pass prior to the 2023 season. Ranked-Choice Voting – On Dec. 8, Mayor Pro Tem Beck requested clarification on HB 259, related to the legality of Rank Choice Voting. The use of RCV for council elections is not authorized by state law and was discussed in the attached ISR published in the Feb. 22, 2019, Friday Report. The following table shows the new value assessed each year by residential, multifamily, commercial, industrial, and other categories. Holiday Movie in the Civic Center: Elf – With the possibility of rain Friday evening, Parks and Recreation staff have decided to screen the Holiday Movie in the Park inside the Civic Center. Breakfast with the Grinch – Join Parks and Recreation at Breakfast with the Grinch on Saturday, Dec. 10 from 10 a.m. to noon at the MLK Jr. Recreation Center Park. City Circle Series – The Denton Senior Center will host its monthly City Circle Series on Dec. 15 from 11:30 a.m. to 12:30 p.m. The program covers various topics related to City Services that are of interest to Seniors. This month’s event features the Denton Police Department sharing the latest information about scams and how to avoid them, including various safety tips. Wreaths Across America – Denton Parks and Recreation will host its first National Wreaths Across America Day event on Saturday, Dec. 17 at Oakwood Cemetery (747 East Prairie Street) beginning at 11 a.m. Wreaths at each of the 253 veteran gravesites at Oakwood Cemetery were sponsored by donation. The wreath-laying ceremony is open to the public and will include the Fire Department’s Pipes and Drums, an address by Rev. Reginal Logan, and the delivery and placement of the wreaths. Cookies and Cocoa Drive-Thru – Join Parks and Recreation for a drive-thru holiday treat on Saturday, Dec. 17 at Denia Recreation Center (1001 Parvin Street). Since that time, we have been working diligently in planning for a period of transition in that role. We began preparations for a nationwide search for our next Deputy City Manager and expect that process to last into the spring. To ensure departments continue to receive a high level of leadership support during this transition, we also opened an Interim Assistant City Manager position for internal candidates. After an extensive application and interview process with a number of qualified candidates, I’m excited to announce that Finance Director and CFO Cassey Ogden will be our interim Assistant City Manager beginning Saturday, December 10. This will provide an opportunity for Cassey to work directly with David prior to his departure. Cassey’s leadership experience and organizational knowledge will greatly help our departments and organization as we continue our important work over the coming months. With the addition ofCassey to this role, we will be modifying our reporting structures to ensure the best leadership support for our departments (see attached organization chart). I want to thank each of you for your continued work on behalf of our community as we continue to evolve and change as an organization. Effective Dec. 12, 2022 21 22 23 24 Date: February 22, 2019 Report No. 2019-030 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Provide information regarding ranked-choice voting. BACKGROUND: At the State of the City event on January 17, 2019, a resident asked whether the City of Denton would consider a ranked-choice voting system for elected officials. In this type of system, also known as “instant-runoff voting,” voters rank all the candidates for a given office by their preference – first choice, second choice, etc. The votes are first tallied based on the first choice on every ballot. If no single candidate wins a first-round majority of the votes, then the candidate with the lowest number of votes is eliminated and another round of vote tallying commences. If a voter’s first choice is eliminated, then the vote goes to the second choice and so on. Eventually, one candidate receives a majority (over 50 percent) and wins the election.1 DISCUSSION: To answer the question from the State of the City event, the short answer is no, the City of Denton cannot move to an instant runoff system for its municipal elections. Section 1.002 of the Texas Election Code expressly preempts local laws regarding elections unless the Election Code expressly provides otherwise. Additionally, Section 3.05 of our Charter states that”… all city elections shall be governed by the Election Code…” This means that with a few exceptions, the Election Code sets the rules that we must follow for our local elections. The Texas Election Code defines two types of voting systems allowed in Texas: • Plurality system: The candidate who polls more votes than any other candidate is elected. • Majority system: A candidate must receive more votes than all other candidates combined. Section 2.001 of the Texas Election Code generally requires a plurality vote for individuals to be elected to a public office. There are three exceptions to this which make a majority vote required: 1) cities with a population over 200,000; 2) if the terms are for more than two years; or 3) if a home-rule city has a charter which states otherwise (Election Code Section 275.002). We fall in the third exception because Section 3.04 of our Charter states that candidates must receive a majority of the votes cast for each place to be declared elected. This makes us one of the cities requiring a “majority vote” and means that the sections of the Election Code pertaining to majority vote elections apply to the City of Denton. Section 2.021 of the Election Code states that if no candidate for a particular office receives the vote necessary to be elected in an election requiring a majority vote, a runoff election for that office is required. The Election Code also lays out specific procedures and timelines for how a runoff election must be held.
