Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 21-1837,the following items will be discussed during the Feb. 21 Council Work Session: 1) Ordinance to add polling locations for the May 6,2023, elections(Beck). DCTA Policy Priorities — On Feb. 7, 2023, the Denton City Council held a work session discussion to provide direction regarding its transit-related policy priorities and what policies it desires the City's Denton County Transit Authority (DCTA) board representative to advance while serving on the DCTA Board of Directors. The attached letter, which summarizes the policy priorities determined by Council, was sent to both Board Member Alison Maguire and Alternate Member Pat Smith. State Legislative Update—Since the start of the bill filing period on Nov. 14, almost 4,000 separate pieces of draft legislation have been filed with over 600 of those pertaining to cities. Staff along with its legislative consultants continue to review new legislation, assess their impacts on the City of Denton, and, in some cases, prepare for the possibility of providing written or verbal testimony to the legislature.A report of the bills currently being tracked by the City is attached. Additionally, the Texas Municipal League also publishes detailed descriptions of bills on its website. Several notable milestones have been reached by both chambers of the Legislature over the past few weeks. In late January,the Senate issued its committee assignments,with the state senators representing Denton (Senators Springer and Parker) holding seats on the Local Government, State Affairs, and Transportation committees, among others. This was followed in the second week of February by House of Representative committee assignments. Those House members representing Denton (Reps. Stucky, Hayes, and Patterson) will hold seats on the Appropriations, Transportation, and Urban Affairs committees, among others. While the Senate has held committee hearings on the budget and ERCOT market, most committees will begin holding hearings toward the end of February or early March. There have yet to be any bills filed on ERCOT market reform despite the Lt. Governor and Chair of the Senate's Business and Commerce Committee both stating their opposition to the PUCT's proposed market reform proposal. Both Governor Abbott and Lt. Governor Patrick have released their legislative priorities for the 88th Session. Both included property tax relief, school safety, removing COVID- related restrictions, and education reforms. The Lt. Governor's priorities, which number 30 in all, indicate issues likely to be considered in the first weeks of committee hearings and given the most attention by the Senate members. The Governor's seven priorities will command similar attention in both legislative chambers. Bills related to one of the Governor's emergency items, unlike other bills, can also be voted on within the first 60 days of a regular legislative session. On Jan. 10, the City Council gave staff direction to seek the introduction and passage of legislation that would make the City of Denton eligible to use the "qualified hotel project" economic development tool available in Chapter 351 of the Texas Tax Code. On Feb. 14, Representative Stucky filed H.B. 2321, which would enable the City of Denton to use this tool. Staff and the City's legislative consultants will continue to advocate for the passage of this legislation and provide ongoing updates to the Council on its progress. Library Closed for Staff Development Day- All library facilities will be closed Friday, Feb. 24, for annual staff development training. Employees from all three locations will gather to learn new skills and share best practices. The Library staff development day is an invaluable tool for creating a cohesive vision for library service. This year's training topics include communication, information about local social service organizations, online database changes, demonstrations, and hands-on training with equipment, collections, and programming.Library closings are posted at all locations,on the library's automated phone system, on the library website, and on library social media. Materials on hold for library patrons will remain on hold for one extra day due to the closure. Staff contact: Jennifer Bekker, Library E. 2021 Staffing for Adequate Fire and Emergency Response (SAFER) Grant — The City received notice on Feb. 15 that it will be awarded$3,731,892 under the 2021 SAFER grant. The SAFER Grant Program provides funding at 100 percent with no match required. The grant will fund 12 full-time staff positions at the new Fire Station No. 9 over a three-year period. The new fire station will be located at the Denton Enterprise Airport and serve the northwest portion of the City. It is projected to be completed in the Summer of 2024. The station will have a minimum staffing of four firefighter positions to operate a structural fire apparatus and cross-train to operate an Aircraft Rescue Fire Fighting (ARFF)unit. The submission of the grant application was approved by City Council on February 1, 2022, by Resolution 22-198. The 2021 submission is the fourth SAFER grant application by the City of Denton Fire Department and is now the fourth awarded to the City. Staff contact: Laura Behrens, Finance F. Denton Public Library awarded Humanities Texas Mini-Grant—Denton Public Library has been awarded a$600 mini-grant from Humanities Texas, the state affiliate of the National Endowment for the Humanities,to celebrate Women's History month in March 2023 with the exhibition, "Rural Texas Women at Work, 1930-1960." The grant will be used for the cost to host the exhibition and materials for associated programs. The exhibition includes photographs and explanatory texts to illustrate the lives of rural Texas women, programs developed by the U.S. Department of Agriculture's Extension Service to serve rural communities, and changes across rural Texas in during the Great Depression and World War II. South Branch Library will host a series of supporting programs for children and adults throughout the month of March to support the exhibition and teach about life in rural Texas and traditional cooking, crafts, and livelihood. The "Rural Texas Women at Work, 1930-1960" exhibition will be on display from March 1 through 31. • Yes You Can Can (ages 18+) on Monday, Mar. 6 at 7:00 p.m. Have you always been interested in canning but weren't sure where to start? Join us for a demonstration of different techniques. • Life on the Range (ages 5-11) on Thursday, Mar. 9 at 4:00 p.m. Learn all about Mary Ann Goodnight and her life on the range. We will learn about how she cared for buffalo and make homemade butter together! • Macram6 Workshop (ages 18+) on Tuesday, Mar. 21 at 2:00 p.m. Join local artisan Mary Cresson and learn two basic knots used in macrame work. You will leave with a new skill and two keychains. 3 • Through the Lens (ages 5-11) on Thursday, Mar. 23 at 4:00 p.m. Learn about photographer Dorothea Lange, who captured images of the Dust Bowl and the Great Depression and make Depression-era toys. • Felted Soap Workshop (ages 18+) on Wednesday, Mar. 29 at 6:30 p.m. Have "good clean fun" by creating felted soap! Camelot Street Rezoning — Camelot Street, from Stuart Road to Hercules Lane, was originally platted in 1979 with 20 residential lots and developed with triplexes and fourplexes. In 2002, Camelot Street was rezoned from Multifamily Dwelling Restricted (MF-R)District to Neighborhood Residential 3 (NR-3) District. The NR-3 District did not permit the triplex and fourplex uses,but the Denton Development Code at the time allowed for these uses to continue as Special Exceptions to the zoning, which permitted the uses to continue, be expanded within the same lot, or be rebuilt in the event of involuntary destruction. In 2019,NR-3 District transitioned to Residential 3 (R3)District as part of the Denton Development Code update and the City-wide zoning transition. The current zoning of R3 District does not permit triplexes and fourplexes, and the 2019 Denton Development Code does not authorize Special Exceptions to the zoning regulations. Consequently, the existing uses are nonconforming and subject to the Denton Development Code's Nonconforming regulations, which restrict a property owner from rebuilding if more than 50 percent of the structure is destroyed. To ensure the zoning corresponds to the existing uses, provides certainty for the property owners and residents, and allows for continued investment in properties, Planning Staff proposes a City-initiated rezoning to a district corresponding with the existing triplex and fourplex uses(Residential 6 District). Planning Staff will be holding a neighborhood meeting for property owners located within the area proposed for rezoning and surrounding residents in the upcoming weeks to discuss the proposed City-initiated rezoning, the rezoning process, and any related concerns. The City-initiated rezoning is tentatively scheduled for consideration by the Planning and Zoning Commission on March 15, 2023, with subsequent City Council consideration intended for April. Fire Station #5 Remediation - The City recently hired a third-party consultant to perform an indoor air quality and mold assessment for Fire Station# 5 (2230 W Windsor Dr.). The indoor air quality testing concluded there was not an indoor mold concern and indoor air met thermal comfort and fresh air ventilation guidelines,however,allergen sample analysis revealed detectable concentrations of rat allergens, as there are no established rat allergen guidelines, and remediation was recommended. Starting Monday, Feb. 20, a third-parry contractor will begin the remediation process that includes the removal of impacted insulation and ceiling tiles, cleaning of air registers & vents, a general deep clean of the building (including ductwork and HVAC equipment), and continued pest control. Following remediation, the interior will be sealed to deter rodent infiltration and finishes will change to include new insulated ceiling tile. It will take approximately two weeks to perform the remediation, seal the building, and reinstall the 4 interior finishes. During remediation, Fire personnel will be displaced during the work in a manner focused on response effectiveness, and temporary housing will be provided within the service bays and some personnel/units will be positioned at neighboring stations. Moving forward,Facilities and Environmental Services will work with Fire to monitor Fire Station #5 for pest control effectiveness. City of Denton Receives Two Awards for Air Qualily Education and Outreach - At the January meeting of the Regional Transportation Council, the City of Denton Environmental Services and Sustainability staff received two awards through Denton's participation in Air North Texas, a regional public awareness campaign seeking to improve air quality in the North Texas area. The City received an award in Outstanding Outreach for including Air Quality as a part of sustainability events throughout the year, reaching over 2,500 people across Denton. Staff also received the Arlo Ambassador Award for outstanding use of the Air North Texas Mascot"Arlo the Airmadillo." Environmental Services and Sustainability staff look forward to the coming year as the City continues to work with its regional partners to improve air quality and reduce ground- level ozone. Staff contact: Michael Gange, Environmental Services & Sustainability J. 2023 HVAC Rating Changes and Impacts to GreenSense Energy SEER SEER2 Efficiency Rebate Program- Effective Jan. 1, 2023, the US Department 12 11.5 of Energy changed the way that HVAC systems are tested. New 14 13.4 procedures are more thorough and result in a new rating system for 15 14.3 HVAC units known as SEER2 (Seasonal Energy Efficiency Rating). 16 15.3 The goal of new testing requirements is to better represent field 17 16.2 operating conditions for the HVAC units. The table shows the SEER 19 18.1 ratings compared with the new SEER2 ratings. 20 19.1 21 20.1 The GreenSense Energy Efficiency Program currently lists the minimum 23 22 accepted HVAC SEER to be 16. With the new rating system rebate 24 22.9 applications with a SEER2 equivalent of a 16 SEER(15.3 SEER2)will 25 23.9 be accepted as qualifying equipment. Staff will continue to monitor 26 24.8 changes and update installers in the area as the GreenSense Program 2s 26.7 adjusts to the new standards. Denia Park Renovations Public Meeting — City Staff from the Parks and Recreation Department will host a hybrid meeting to receive resident feedback on planned renovations to Denia Park. The meeting will take place Monday, February 20 at 6:30 p.m. The in- person component will take place at the Denton Development Services Center at 401 North Elm Street. For residents who would like to attend virtually, registration for the webinar is available at least 24 hours before the meeting online. Projects currently under consideration for the renovation include adding a loop trail to increase connectivity between park features, improving irrigation and turf quality, safety improvements at the softball fields, and general landscape improvements. City staff also 5 plan on meeting with the Denia Neighborhood Association to go over renovation plans at the park and to receive additional resident input. Clear Creek Award — At the monthly meeting of the Elm Fork Chapter of Texas Master Naturalists (EFTMNP) on Feb. 16, Clear Creek Natural Heritage Center won the "2022 Outstanding Project of the Year" award. Although this award recognizes the work of Chapter members, it really celebrates the partnership of EFTMNP and the City of Denton, particularly working alongside the Parks and Recreation and Environmental Services Departments. Audra Lane Tree Clearing - On Feb. 7, 2023, staff responded to an inquiry from Council Member Byrd regarding trees at 1501 Audra Lane by Shiloh Farms. The heavily treed site has an issued understory clearing permit (no permitted tree removals). This clearing activity is permitted under DDC 7.7.4.13.2.f. The property owner requested an understory clearing/ grubbing application so the developer could conduct a tree survey for development review. The developer has not submitted a formal development application yet. In response to tree health concerns and potential damage from the grubbing activities, staff will be inspecting the site and documenting issues as necessary. Stop Signs at Bonnie Brae Street and Windsor Drive—On Feb. 11,Council Member Davis notified staff that the LED stop signs located at the intersection of Bonnie Brae and Windsor were not functioning. After evaluation, it was determined that these signs were at the end of their useful life and were replaced with 36-inch static stop signs and 12-inch LED flash cubes on Feb. 15. Staff contact: Ethan Cox, Public Works C. Bike/Auto Collision at Oak Street and Carroll Boulevard — On Feb. 15, Mayor Pro Tern Beck asked staff to assess the intersection of Oak Street and Carroll Boulevard, citing safety concerns after a bicyclist was hit by a vehicle using the bike lane as a turn lane. Staff evaluated the intersection and found that the intersection is correctly striped; however, the striping appeared significantly faded. Staff will refresh the striping to highlight the bike lane and will continue to monitor the intersection,while also evaluating other solutions for the intersection. Riney Road Inquiry—On Feb. 15, Council Member Davis asked several questions related to Riney Road, including project phasing, funding sources, and right-of-way acquisition. Council Member Davis also inquired whether the sidewalk portion of the project could be moved to the first part of the construction timeline. The eastern portion of Riney Road from the Denton ISD property to US 77/Elm Street has completed the planning phase; however, no funding has been identified for this project. Once design funding is provided, Capital Projects can move this project into the design phase. Staff estimates a 6-month design timeframe with a 10-to-12-month construction timeframe.Additional right-of-way along the south side of Riney Road between the Denton ISD property and G. Roland Vela Soccer Complex would need to be acquired from two 6 property owners on the southside of Riney Road to allow for continuous sidewalk connectivity and uniform street width along Riney Road. During Bonnie Brae phase 6, a sidewalk will be installed along the south side of Riney Road, ending construction on the west side of the Denton ISD property identified as the new elementary school site. The elementary school project will include the installation of a sidewalk along their frontage during the construction of the school. Bonnie Brae Phase 6 will also install a sidewalk along the north side of Riney Road and will connect to the existing sidewalk that was installed by development projects. Bonnie Brae Phase 6 is estimated to be advertised for bid next month with construction anticipated to start in Q2 of 2023,pending one parcel acquisition. Moving the construction of sidewalks to the beginning of construction is not advisable as sidewalks are easily damaged by construction equipment. Directing the contractor to construct them first will open the city up to the risk and extra costs of replacement should they be damaged. An alternative option would be to install a temporary sidewalk with temporary construction materials,but this option would not be ADA-compliant and would be difficult for those on bicycles. Staff contact: Trevor Crain, Capital Projects E. AED Inquiry—On Feb. 16, Council Member McGee asked whether all City facilities have an AED, or automated external defibrillator. Automated external defibrillators are used in the event of a sudden cardiac arrest by analyzing the heart's rhythm and delivering an electrical shock if necessary. Staff confirmed that all City facilities have defibrillators, and both the Fire Department and Safety teams work together to maintain them. Kids Rock: The Return—Kids Rock has returned, and young Denton residents are having a blast! Each month, kids enjoy a night out while parents enjoy the night off. The program runs 7 to 11 p.m. Experienced staff plan each month around a unique theme, then create play stations that include games and activities, mini-sports tournaments, unique inflatable fun, ping-pong, video games on a large screen, and a DJ with dance contests! Two slices of pizza and a drink are included for attendees. Staff also sell additional concessions and glow products. Preregistration is required and can be completed online. The cost is $25 per child, with a $5 late fee if registering the day of after 5 p.m., with upcoming program dates of Feb. 17, March 2, and Apr. 21. Staff contact: Sara Farris, Parks and Recreation B. Great Backyard Bird Count—This weekend,Feb. 17-20,is the Great Backyard Bird Count (GBBC), an annual event sponsored by Bird Canada, the Audubon Society, and Cornell University Laboratory of Ornithology. Sustainability Denton and Clear Creek take part in the event for the first time this year on Saturday, Feb. 18 from 8 a.m. to 12:30 p.m. The Great Backyard Bird Count asks individuals to spend as little as 15 minutes observing birds in their area and submitting their observations to scientists for further consideration and compilation. The event at Clear Creek will conclude with family-friendly bird activities. More information on the GBBC can be found online. To register for this event at Clear Creek, sign up online. Mardi Gras - Fat Tuesday — On Tuesday, Feb. 21 at noon, the Denton Senior Center will be celebrating Mardi Gras the best way we know how: with a Fat Tuesday potluck and live music by the Rockin'Rev. There will be plenty of purple,green,and gold and enough beads and King Cake to go around. The event costs $5 per person with registration available online. King, Jr. Recreation Center will celebrate Black History Month on Saturday,Feb. 25,from 10 a.m.to noon. Patrick Powers, a teacher with DISD, will be the keynote speaker. The program also features youth portraying historical African Americans questioning the audience, "Who am I?", as well as musical performances by Travis Brown, Alice Hudspeth, and Dr. Marquis Nuby. Black History Month Program at ALH Senior Center—The American Legion Hall Senior Center will celebrate Black History Month on Friday, Feb. 24, from noon to 2 p.m. Come learn about the contributions of African and African Americans from the past to present through games and presentations. Dr. Danielle Phillips-Cunningham, Texas Woman's University professor will also share a presentation about Quakertown. Refreshments will be served. The event is free to attend. Adapted Rec: Valentine Treat Making — February's Adapted Rec Social Connection is enjoying everything loving and sweet all month long with Valentine Treat Making. Participants will be making chocolates, hard candies, and decorating cookies, as well as designing and decorating packaging. This activity teaches clean food practices and allows for nonverbal expression through creativity. Treat making will take place on Friday, Feb. 24 from 11 a.m. — 1 p.m. Staff contact: Mia Macy, Parks and Recreation G. Women's History Month — The Parks and Recreation Department will host a Women's History Month Celebration on Mar. 11, starting at 10 a.m. at the MLK Jr. Recreation Center. The celebration will commemorate the achievements of women in American history and feature a keynote speaker Marian R. Hicks. This event is co-sponsored by the Denton County Alumnae Chapter-Delta Sigma Theta Sorority, Inc., and will also feature various vendors, resources, and raffles. Great American Cleanup — The 35th Annual Great American Cleanup (GAC), Denton's largest and longest-running citywide litter cleanup, is Saturday, Mar. 25. Cleanups begin at 9 a.m. and are followed by a Volunteer Appreciation Party at Quakertown Park/Denton Civic Center (321 E. McKinney Street) from 11 a.m. to 1 p.m. with a free lunch from In- N-Out Burger, delicious treats from Island Whips, educational activity booths, bounce houses, live DJ, entertainment and more. During the Appreciation Party, prizes will be awarded for the largest group of volunteers, the most bags collected, and the oddest item found. Our goal is to engage 1,500 participants in cleanups of Denton's streets, parks, and waterways. Presently, 121 volunteers are registered but more are needed. Registration is open through Mar. 15 at 5 p.m. Community members can join this effort by visiting the registration page and signing up as an individual or with a group. Volunteers of all ages and experience levels are welcome to participate. Participants receive free litter cleanup supplies and a free event t-shirt(while supplies last). All Rights Reserved. 52 February 17, 2023 Report No. 2023-013 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Community Development Rental Repair Program BACKGROUND: On February 15, 2022, City Council adopted the Denton Affordable Housing Strategic Toolkit (Toolkit), which included five recommended strategies with the activities targeted to deliver affordable housing units by leveraging a variety of resources available from private and non-profit developers,the City, and other housing stakeholders. The Toolkit strategies involve increasing the number of affordable rental housing units. Activity 4 in Year 1 includes the creation of a rental maintenance grant including a program for landlords who lease to low-moderate income households. During the June 25,2022, City Council budget retreat, Community Services staff presented budget items for the 2022/23 Fiscal Year. Included in the presentation was a new Rental Repair Program for landlords who lease to low-income households. During the budget discussions, Council Members provided recommendations regarding program parameters. DISCUSSION: This report provides additional information ahead of the City Council meeting on February 21, 2023, when Council will consider approval of the program guidelines (ID 22-1791). The objective of the City of Denton Rental Repair Program will be to increase affordable housing within the city limits of Denton. The program will assist with essential repairs, structural accessibility modifications, and/or repairs to major systems of recently acquired rental property. Income for tenants must be below 80% of the Area Median Income Limits (AMI). Financial assistance is available up to $24,500 per unit as a 5-year forgivable loan. The number of units will be limited to 1-4 single-family or multi-family units. In exchange for the repair assistance, the rental property owner agrees to rent the property to income-eligible tenants during the term of the loan, known as the Affordability Period. This is a pilot program and changes may be considered in the future,based on the findings. Developing the Program Guidelines Staff surveyed ten cities (attached) with rental repair programs to help determine program guidelines. Program guidelines reviewed were service area, property requirements, income maximums (owner and tenant), rent, maximum programs funds, owner-required funds, types of units, and type of loan and lien period. SERVICE AREA: • Five of the ten cities surveyed provide the program city-wide. Four targeted specific areas within the city limits. 53 February 17,2023 Report No. 2023-013 • The City of Denton program will provide grant funding to repair rental properties located within the city limits of Denton. PROPERTY REQUIREMENTS: • All cities surveyed assist applicants with existing rental properties;three of the ten also assist applicants with new properties. • The City of Denton program will target new properties to increase the number of units by providing grant funding to repair rental property that has not previously been rented by the applicant. INCOME MAXIMUMS (OWNER AND TENANT): • All ten cities surveyed had a maximum income limit for the tenants but not for the owner. • The City of Denton program will require the applicant to rent to tenants at or below 80%AMI as defined by HUD. RENT: • All ten cities surveyed required Fair Market Rent rates. • The City of Denton program will require rent limits using the HUD Fair Market Rent rate updated annually. MAXIMUM PROGRAMS FUNDS: • The ten cities surveyed provide a range of funding from $5,000 to reconstruction. • The City of Denton program will provide $24,500 consistent with other City repair programs. OWNER-REQUIRED FUNDS: • Four of the ten cities surveyed require the owner to provide funds from 5% to 50% of the total repair cost. • The City of Denton program will require the owner to provide funds over $24,500 consistent with other City programs. NUMBER AND TYPES OF UNITS: • Four of the ten cities surveyed assist from one to four units but did not list the type of units. • The City of Denton program will limit the number of units from one unit to four units. This includes single-family, duplex, triplex, and four Alex units. This excludes properties with more than four units including multifamily housing. TYPE OF LOAN: • Six of the ten cities surveyed provide forgivable loans, and two cities require payable loans. • The City of Denton program will provide a forgivable loan allowed by HUD that is forgiven at the end of the five year affordability period. 54 February 17, 2023 Report No. 2023-013 LIEN PERIOD: • Four of the ten cities surveyed require five-year liens, three require ten-year liens, and three required terms from five to twenty-year liens depending on the amount of assistance. • The City of Denton program will require a five-year lien during the period of affordability. Program Funding Community Development staff submitted a funding application to the Community Services Advisory Committee (CSAC) to establish the Rental Repair Program for $100,000. On April 8, 2022, the Community Services Advisory Committee (CSAC) recommended to City Council an allocation of$100,000 in CDBG funds for the Rental Repair Program. The recommendation was included in the 2022 Action Plan that City Council approved on July 19, 2022. Additional funding for the Rental Repair Program for $100,000 was also included in the FY 2022/23 Annual Program of Services (Budget) and the Capital Improvement Program of the City of Denton, Texas approved by the City Council on September 27, 2022. CONCLUSION: The program supports initiatives adopted by the Denton City Council as part of the 2020-2022 Consolidated Plan for Housing and Community Development and the Denton Affordable Housing Strategic Toolkit. The Denton City Council first implemented water and wastewater impact fees in 1998 due to the high population growth projected for Denton. Several factors influenced this decision, including the significant cost of the water supply and water treatment plant at Lake Ray Roberts, community resistance towards increasing water and/or wastewater utility rates to pay for the new infrastructure needed to support the projected growth rates, and the general use and acceptability of impact fees in other communities in the Dallas-Fort Worth metroplex. An impact fee is a one-time charge imposed on new developments to help recover a portion of the capital costs of infrastructure and other improvements required to provide service to the developments. The use of water/wastewater impact fees helps to stabilize rates during periods of rapid growth and helps minimize the economic impacts of growth on the rates of existing utility customers.These fees help shift a portion of the cost of the new or expanded infrastructure required by the development away from the existing utility customers and towards the new development itself. One of the first steps of the Water/Wastewater impact fee study is to establish a Capital Improvement Advisory Committee (CIAC) to review assumptions and make formal recommendations to the Public Utilities Board(PUB)and City Council. The Planning and Zoning Commission has historically served in this capacity with one additional ad hoc member from the City's Extra Territorial Jurisdiction (ETJ). Updating the study requires the completion of a land use analysis to project changes in land uses, densities, and populations within water and wastewater service areas over the next ten years. Part of the land use analysis includes forecasting the timing and mix of single-family, multi-family, and other development types within the service area. The City's consultant,Kimley Horn,and City staff will use this information to develop ten-year water and wastewater capital improvement plans (CIPs) capable of supporting the expected demands. The ten-year CIP will summarize capital projects and associated costs required to support growth in the service areas over the study period according to land use data, population projections, water and wastewater demand forecasts, and the Master Plans of the water and wastewater systems. 58 February 17,2023 Report No. 2023-014 Impact fees are developed by expressing the growth in demand for water and wastewater facilities over the planning horizon in"service units"of impacts. The water and wastewater impact fees for Denton use a single-family equivalent (SFE) as a service unit. The SFE is simply the water and wastewater demand associated with the smallest water meter in the system, which is the typical meter used by a single-family residence. The impact fee study determines the costs to provide a new customer with water or wastewater service using the SFE as the base unit, and these costs become the maximum impact fee amounts allowed under TLGC. The maximum impact fees represent the fees needed for full recovery of costs associated with the proportion of capital programs needed to serve the demands of additional growth. In 2018, the City Council adopted the maximum impact fee and maintained three service areas for water to reflect the differences in service costs among various areas in the City. The current SFE impact fee for each utility is listed below. While this responsibility had been historically staffed by City employees, after the City offered a Voluntary Separation Program (VSP) in May 2020, there were no Safety personnel remaining. On May 20, 2020, the City Manager approved a short-term contract with Rizikon, Inc. to immediately provide on-site safety staffing and services to the City. A final contract was awarded to Rizikon by City Council on July 21, 2020, for a three (3) year term to provide on-site safety services and training programs for City departments. The contract charged Rizikon to develop a comprehensive safety and training program with industry best practices, policies, and procedures. When the contract was executed, it was envisioned for the outsourced staffing model through Rizikon to be a short-term arrangement to build the core foundations of a Safety program, with the goal of transitioning back to an internal Safety staffing model at a future date. There have been four staff members from Rizikon on-site to provide safety training and services. At the beginning of the contract,the Rizikon team reported directly to an Assistant City Manager. The Safety team was transitioned to report to the Human Resources Department in March 2022 to align with the HR and Risk Management teams and continue to evaluate how we strengthen programs, policies, and tools to mitigate risk and ensure the health and safety of our workforce. DISCUSSION: After evaluating with Directors and City leadership, staff determined it would be in the City's best interests to transition back to an in-house Safety staff team to strengthen the safety program, leverage all available resources and efficiencies, and integrate safety into all facets of department operations. As such, staff is planning to transition safety staffing and hire qualified safety personnel as City employees prior to Rizikon's contract expiration in July 2023. The following provides an overview of key elements to transition Safety back to an in-house staffing model: • No Budgetary Impact,Reduced Cost—The annual financial estimate to hire and employ an internal Safety team is approximately$658,687,which is inclusive of fully loaded costs for four staff members and a small budget for outside contract services as needed. This financial estimate is less than the current contracted budget of$718,518.09 with Rizikon for comparable safety staffing and services. Therefore, no additional budget is required, and it will represent a savings to the Risk Fund(internal service fund). 60 February 17, 2023 Report No. 2023-015 The action to create four positions in Position Control will require Council ratification through a budget amendment to the Risk Fund. Staff plans to bring this ratification to City Council when a Risk Fund budget amendment is brought later in the year. A Risk Fund budget amendment is generally sought at the latter part of each fiscal year, once staff has actual and projected expenses related to variable cost items such as claims and insurance premiums. • Hiring Process and Timeline - Staff plans to hire four staff positions for Safety. While titles,job descriptions, and pay grades are being reviewed and finalized,the current plan is to hire a Safety and Risk Manager, Safety Coordinator/Analyst, and two Safety and Training Specialists. In addition, some funds are planned to be budgeted to use outside contract services as needed for certain training classes or inspections as may be needed. Staff plans to finalize and post the open positions in March to begin the hiring process. The goal is to complete the hiring processes within two to three months to onboard new staff and provide a short overlap with the Rizikon contract to ease the transition. • Next Steps —While preparing for a staffing model change, staff has also been evaluating a work plan going forward for Safety. This work plan will focus on four areas to continue the development of a comprehensive safety management system, including: 1. Safety Policy and Structure (policy and program development, systems development,budget management); 2. Safety Assurance (program management, inventory management, safety committees, department coordination); 3. Safety Risk Management (inspections, investigations, risk identification and mitigation, reporting); and 4. Safety Promotion(training, communication, and resources). CONCLUSION: Through the last two and one-half years, the Rizikon staff team has provided safety services and training to the City's workforce. They have made considerable strides in building the policies, procedures, and elements of a Safety program; however, more work must be done to strengthen the City's overall safety program. Staff believes the internal staffing model will best achieve the future goals and objectives to continue strengthening our safety program, leveraging all available resources and efficiencies, and integrating safety into all facets of department operations. After staying at the tiny homes site for about 3 months, she is no longer homeless. * The second client connected to permanent housing was also a senior woman.
