A. Internal Audit Fiscal Year 2022-23 Second Quarter Report — The Internal Audit
Department's Quarterly Reports are intended to provide the City Council and the public
with a status update on the Annual Internal Audit Plan and Recommendation Follow-Up
Status. Additional items of note this quarter include FY2023-24 Preliminary Budget
Information, Knighton Award Receipt, Fraud Awareness Training Completion Update,
Compliance Division Reorganization, and Post-Project Performance Review Procedure

B. 2023 City of Denton Pet Mayor Contest—The City is now accepting submissions for a new
Pet Mayor! After a two-year term, Pet Mayor Elvis Stripling is passing the gavel to a new
Denton Pet Mayor. The Pet Mayor represents local pets at events, programs, and City
functions. The winning pet will receive a City Council proclamation, a feature on the City
website, a social media post, and a cover photo/feature in the Resident Update newsletter.

C. Construction Guide — Capital Projects/Engineering and Marketing and Communications
departments produce the Construction Guide twice a year, which is mailed to all City of
Denton addresses. The guide is intended to give residents an up-close look at the projects,
programs, tools, equipment, and people working to make Denton the best place to live,
work and play. The latest construction guide is anticipated to arrive in mailboxes the week

D. All-Way Crossing Update — The City's contractor has completed three of the four
intersections downtown for the All-Way Crossing Project. The final section located at the
corner of Locust at Hickory between the Wells Fargo Building and Free Play. While both
lanes of Hickory are closed, pedestrians may cross Hickory Street inside the posted
barricades. Once all four intersections are complete, the contractor will stripe the new
diagonal crosswalks. Project completion is anticipated end of June 2023, weather

E. Keep Denton Beautiful Receives KTB Gold Star — Keep Texas Beautiful (KTB), a
statewide grassroots environmental and community improvement non-profit organization,
recently named Keep Denton Beautiful a Gold Star Affiliate. Gold Star recognition is the
highest membership recognition any community affiliate can achieve. KTB will formally
recognize Gold Star communities, including Keep Denton Beautiful, during its conference
in June. Keep Denton Beautiful is managed and operated by Parks and Recreation and
successfully implements programs to clean up litter, plant and distribute trees, educate
residents, and beautify and enhance the community. Staff contact: Autumn Natalie, Parks

F. Special Olympics Track and Field— Parks and Recreation's Special Olympics Team, the
Eels, competed in the Special Olympics Track and Field competition in Burleson, TX on
April 29. The team brought home bronze and silver medals for men's and women's softball
throw. This was the Eels first competition since the team started late last year. Staff contact:

G. Civic Center Hazardous Tree Removal—On May 1, approximately one-third of the canopy
of a Live Oak tree fell at the corner of McKinney Street and Bell Avenue located in front
of the Denton Civic Center (321 McKinney). Staff noted concerns with decay, including
bark, and a cavity between the site of limb failure and the tree's two remaining limbs. A
tree risk assessment was conducted by the City's Urban Forester, which determined the
tree should be removed soon to minimize the risk of additional damage. The tree is
scheduled to be removed by a contractor Saturday,May 6.The removal will have a minimal
impact on the Civic Center parking. City staff will be onsite during the removal to
troubleshoot any issues that may arise. Staff plan to replant the area with one or more trees
pending the determination of underground utilities. Staff contacts: Marshall McGee and

H. Fred Moore Park Vandalism — On May 4, Parks and Recreation restored the pavilion at
Fred Moore Park, which had been vandalized by graffiti on May 1. A police report was
filed to document the incident. Staff contact: Russell Koch, Parks and Recreation
I. CAPRA Site Visit — Parks and Recreation submitted the National Parks and Recreation
Association (NRPA) self-assessment for accreditation on February 10. NRPA's
Commission for Accreditation of Parks and Recreation Agencies (CAPRA) is the unit
responsible for determining if a Parks department meets NRPA's established criteria for
accreditation.
The second step included a site visit from CAPRA evaluators April 26 to 28. During this
period, evaluators vetted and positively assessed the department and its evidence of
compliance with CAPRA standards. The final accreditation hearing will take place in
October 2023 at the NRPA National Convention. Staff contact: Caroline Seward, Parks

Responses to Council Member Requests for Information
A. Defunct Telephone Box Update— On May 1, Council Member Davis submitted a follow-
up request regarding a non-functioning telecommunications box. The box is located
approximately 100 feet east of another box recently repaired, as referenced in the April 21
Friday Report. Staff investigated the site and found an open pedestal behind a campaign
sign covered in bushes. Frontier representatives were contacted, and a repair of the box

B. Traffic Control Near Ranch Estates—On May 2,Council Member Davis shared a resident's
concern regarding traffic concerns at the intersection of Cindy Lane/Western Boulevard
and US 380, as well as traffic-related issues within the Ranch Estates community. The
City currently has "No Truck" signs installed at the entrances of the Ranch Estates
community, as well as 30 mph speed limit signs installed throughout the community.
Additional traffic control measures will be evaluated to reduce the amount of cut-through
traffic through the Ranch Estates community as part of the larger response, along with the
overall developments and traffic patterns in the area. Staff is evaluating the concerns and
will provide a more detailed response once the evaluation is complete. Staff contacts: Brett

C. Resident Seeking Safety Signage — On May 2, Councilmember Davis shared a resident's
concerns about pedestrian safety when utilizing the crosswalk at the intersection of Teasley
Lane and Lillian Miller Parkway. It was noted motorists turning right onto Teasley Lane
are not consistently yielding to pedestrians in the crosswalk and a request was made to
evaluate if additional signage could be added. Upon review, staff agreed there is an
opportunity to place additional signage, and, on May 4, Traffic Operations installed signs
reminding turning vehicles to yield to pedestrians crossing the intersection. Staff contact:

Upcoming Community Events and Public Meetings
A. Garden Workdays at Denia Wildflower Garden—Join Keep Denton Beautiful for monthly
garden workdays at the Denia Wildflower Garden located in front of Denia Recreation
Center(1001 Parvin St.). Get ready to dig in the dirt and learn proper gardening techniques
from the experts! The next gardening event will be on Saturday, May 6 from 9 to 11 a.m.
Those interested can register using Parks and Recreation's new volunteer portal. Staff

B. Free Fan Giveaway — Denton Municipal Electric (DME) and the Sustainability Office,
through the GreenSense Energy Efficiency Program, are distributing over 1,000 free 20"
air circulator floor fans to DME customers. Floor fans are portable, energy efficient, and
can improve comfort during extreme heat. Fans will be available for pick up beginning
May 8, from 8 a.m. to 6 p.m. at the City of Denton Sustainability Office (1001 S. Mayhill
Rd). On May 20, a Fan Giveaway event will be held from 9 a.m. to noon at the Civic
Center (321 E. McKinney St.). Pre-registration is preferred and available online.
Customers will be asked to provide their billing account number, or identification with
name and service address, to verify their accounts. Staff are planning additional pick-up
events with details to follow in future Friday Reports and on the Sustainable Denton web

C. Food N' Fun Friday at North Lakes Driving Range —Bring your neighbors and friends on
Friday,May 12, from 5 to 9 p.m.,to the North Lakes Driving Range(2009 W Windsor Dr)
to enjoy all-you-can-hit balls and enjoy food for purchase provided by food truck vendors.

D. Food Truck Frenzy at Rayzor Ranch Park— Join Denton Parks and Recreation at Rayzor
Ranch Park (3230 Heritage Trail) on May 12 from 5 to 8 p.m. for Food Truck Frenzy!
Several food trucks will offer food for purchase; bring a chair or two to enjoy live music.

E. Cemetery Conservation Workshop — Join City of Denton Parks and Recreation, Denton
Public Library,and the City's Office of Historic Preservation on Saturday, May 13 to learn
more about cemetery conservation. The event begins at 10 a.m. at the American Legion
Hall (629 Lakey St). Christopher Goodmaster, Senior Archaeologist at Integrated
Environmental Solutions, LLC, will provide a brief introduction to historic cemetery
research, documentation, preservation, and restoration techniques. Attendees should wear
comfortable walking shoes, sunscreen, and a hat, as the second half of the session will take
place at Oakwood Cemetery. The event is free to attend,but registration is required online.

F. Night Hike at Clear Creek Natural Heritage Center — Join City of Denton Parks and
Recreation staff on an organized evening hike providing community members, regardless
of hiking experience, an opportunity to experience Clear Creek Natural Heritage Area's
(3310 Collins Rd.) trails showcasing the natural environment at sunset. The next hike will
be held Friday, May 19 from 6 to 8 p.m. Registration is available online. Staff contact:

G. Spring Kaygking—Registration is open for the Saturday,May 27(ages 5+)kayaking event.
Children between the ages of five and 11 must share a kayak with an adult, while those 12
and up can use a single kayak. The cost of the program is $25 for a single kayak and $50

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Information regarding City Council Appointees to Hunter Ranch and Cole Ranch Municipal
Management District Boards of Directors
BACKGROUND:
Hunter Ranch and Cole Ranch are master-planned community developments occurring west of I-
35 West and east of Robson Ranch. On April 7, 2020, the developments sought and received City
Council approval through consent resolutions to form Municipal Management Districts (MMD).
An MMD is considered a governmental agency and a political subdivision of the State.
The Hunter Ranch and Cole Ranch MMDs are intended to finance public capital improvements
and/or services by imposing property taxes and/or special assessments on property owners within
the district who are benefiting from the improvements and services. With that source of revenue,
and once the assessed value of the property is 10 times greater than the amount of debt to be issued,
the MMD can issue bonds, which are then used to reimburse the developers for the up-front cost
of the public improvements.
The MMD is governed by a Board of Directors responsible for the management, operation, and
control of the property belonging to the districts. Five directors are appointed to each district and
the City of Denton has the right, but not the obligation, to appoint an additional director to each
the MMD boards.
DISCUSSION:
In June 2020,the City Council appointed Susan Parker to serve on the Hunter Ranch MMD Board
of Directors and Michael Bradshaw to serve on the Cole Ranch MMD Board of Directors. Since
their appointments, both Hunter Ranch and Cole Ranch have submitted their Phase 1 preliminary
plats, and the MMD boards are meeting regularly to receive development updates and provide
direction on district matters. The term for both City appointees is set to expire on June 10, 2023.
If Council does not replace or reappoint a board member, the existing appointee will continue to
serve in their current capacity and maintain all rights and responsibilities of an appointed board
member.
In accordance with the City and district agreements, the City may appoint one Director to each
district board. The appointees will serve a four-year term for their respective district.
Disqualifying relationships for potential nominees include:
• Nominees cannot be an elected official
• Nominees that are City of Denton employees would be restricted from voting on most
District matters

• Nominees cannot be a developer of property within the district
• Nominees cannot be related within three degrees by either blood or marriage to, or be
employed by (i) a developer of property within the district, (ii) any of the directors of the
District, (iii) the attorney, engineer or manager of the District, or (iv) any other person
providing professional services to the District or property located in the District
• Nominees cannot serve as an attorney, consultant, engineer, manager, architect or in some
other professional capacity for the District or a developer of property in the District
• Nominees can have no business or other connection with the developer of the District, the
attorney representing the District or the consulting engineer for the District in regard to the
District and the development therein
• Nominees cannot be a party to a contract with a developer of property within the District
other than as allowed by Texas Water Code Section 49.052(a)(5)(A)
All directors are subject to the provisions of Chapter 171, Local Government Code, relating to the
regulation of conflicts of interest of officers of local governments. Additionally, all directors are
subject to the provisions of the Texas Constitution prohibiting dual office holding. As a result,
existing appointees to the following boards are prohibited from serving on the district boards:
• Board of Ethics
• Civil Service Commission
• Denton Housing Authority Board
• Health and Building Standards Commission
• Historic Landmark Commission
• Planning &Zoning Commission
• Zoning Board of Adjustment

City Council believes that a speaker's report requires a more detailed review, the City Council will give the
City Manager or City Staff direction to place the item on a future work session or regular meeting agenda
and advise staff as to the background materials to be desired at such meeting.

quitclaim thereof to Us Alliance Prominence Venture, LLC; providing for the terms and

conveyance of a needed public utility easement therein to the City of Denton; providing
for the indemnification of the City of Denton against damages arising out of the
abandonment herein; providing for barricading; providing for consideration to be paid to
the City of Denton;providing for severability and an effective date.
G. ID 23-748 Consider adoption of an ordinance of the City of Denton authorizing the City Manager or
designee, to execute and deliver a third amendment to lease agreement between the City
of Denton, as landlord, and SBC Tower Holdings LLC, as tenant, leasing an additional
150 square feet of land, located near Frame Street, being identified on Block A, Lot 1,
City Hall East Addition, City of Denton, Denton County, Texas, for the use and
maintenance of a communication tower; and providing an effective date.
H. ID 23-915 Consider adoption of an ordinance of the City of Denton, Texas granting an amendment
to the Development Agreement (Agreement) between the City of Denton and Forestar
(USA) Real Estate Group, Inc (Developer) related to reimbursement to the Developer in
an amount not to exceed two hundred sixty thousand dollars and zero cents ($260,000)
for fees submitted to the City as Roadway Impact Fees before September 26, 2022, the
effective date of the Development Agreement for certain lots. The Agreement stipulated
the condition that the Developer complete street construction and/or reconstruction
activities eligible for credit on future road impact fees that were assignable to future home

I. ID 23-824 Consider adoption of an ordinance of the City of Denton granting All American
Entertainment a noise exception for the Monster Truck Shows on Friday, June 2, from 5
p.m. to 9 p.m., Saturday, June 3, from 12 p.m. to 9 p.m., and Sunday, June 4, 2023,
from 12 p.m. to 4 p.m., at the North Texas Fair Grounds - 2217 N. Carroll Boulevard;
and providing an effective date.
J. ID 23-988 Consider an ordinance of the City of Denton authorizing the City Manager to execute an
Advanced Funding Agreement (AFA) and Landscape Maintenance Agreement (LMA)
with the Texas Department of Transportation for the purpose of providing landscape,
scenic enhancement and irrigation on US Highway 377 from Roselawn Drive to Country
Club Road (the "Agreement"); authorizing the City Manager to perform all obligations of
the City under the Agreements including the expenditure of funds; and providing an
effective date.
K. ID 23-766 Consider adoption of an Ordinance of The City of Denton, A Texas Home-Rule
Municipal Corporation, approving an amendment to the Power Purchase Agreement
between the City and Core Scientific Inc., a Delaware Corporation; providing for the
expenditure of funds; and providing for an Effective Date.
L. ID 23-768 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager, or their designee, to execute an amended
Lease Agreement with Core Scientific Inc.; and providing an effective date
M. ID 23-859 Consider adoption of an ordinance of the City of Denton authorizing the City Manager to
execute an Interlocal Agreement between the City of Denton and Lake Cities Municipal
Utility Authority (LCMUA) for the construction of an eight-inch (8") potable water line to
provide service to the City of Denton Lake Lewisville Raw Water Pump Station. The
Public Utilities Board recommends approval(6-0).
N. ID 23-876 Consider approval of a resolution of the City of Denton authorizing the submission of an
application to the Texas Department of Transportation's 2023 Transportation Alternatives
Set-Aside (TA) Program in the amount of $12,885,545 for the Pecan Creek Trail Shared
Use Path; and providing an effective date.
O. ID 23-906 Consider adoption of an ordinance by the City of Denton authorizing the City Manager,
or designee, to execute a 1) Advanced Funding Agreement Amendment No. 1 for the
termination of the original Advanced Funding Agreement and 2) execute a new Advanced
Funding Agreement for funding under the North Central Texas Council of Government's'
Congestion Mitigation and Air Quality (CMAQ) Improvement Program, providing
financial assistance for the city's Pecan Creek and Nette Shultz Elementaries Safe Routes
to Schools (SRTS) sidewalk project; CSJ 0918-46-267, through the Texas Department
of Transportation (TxDOT), in an amount not to exceed four hundred thirty-eight
thousand, eight hundred twenty and 00/100($438,820.00) dollars; authorizing the
expenditure of funds therefor; and providing an effective date.
P. ID 23-893 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
