City Receives AA+Fitch Rating-On May 19, Fitch Ratings assigned the City of Denton an AA+ rating. The rating reflects Denton's superior financial resilience and operating reserve cushion, supported by strong revenue growth prospects, high revenue-raising capacity,and sound expenditure flexibility.Details can be found in the attached document. Japanese Language Advancement School of Dallas - On May 17, the Solid Waste and Water Utilities r Departments hosted faculty and T T students from the Japanese School - - of Dallas (JSD). The JSD teaches - 600+ students ranging from preschool to 121h grade. The purpose of their visit was to engage in social studies curriculum discussions and to tour the City's water,wastewater, and solid waste facilities to compare utility operations to those in Japan. Staff contact: Brandi Neal, Solid Waste and Recycling C. 311/Customer Relationship Management System Project Update - In January 2022, the City kicked off an initiative to implement 31 I/Customer Relationship Management(CRM) software which would allow the Customer Service call center to be able to answer all service call types. This initiative enables residents to initiate service requests through self- help or via telephone with Customer Service for all major City services related to utilities, infrastructure, and Community Improvement Services. Due to the significant impacts on the public and the required complex system integrations, the project will be rolled out in phases to ensure the greatest potential for success. Phasing Plan: Phase I Phase II Phase III Phase IV November 2023 March 2024 May 2024 February 2025 Park Maintenance Community Improvement Water Electric Billing Services Engage Denton Wastewater Water Billing Operator Line Electric Dispatch Public Works Solid Waste Dyno Dirt Implementation of all new services will be complete with the inclusion of Phase III. However, plans include migrating some existing Customer Service activities into the CRM system in a fourth phase. Library Launches New Read Along Collection-The Denton Public Library launched the new Read Along Collection on Friday, May 19. This collection features audio-enabled 2 picture books and easy readers that provide an entertaining and interactive experience as young readers listen to a narrator read the book aloud to them. Reading aloud to ti + children helps build language and reading skills, and the library is excited to offer this new collection that will encourage deeper — - engagement with literature for young readers. Monthly Mobility Report-During the May 24, Mobility Committee meeting, Innovative Transportation Solutions (ITS) provided the attached monthly report, which includes the overview of several major regional Texas Department of Transportation(TxDOT)projects. Traffic Box Art Installation - The first of several artistic vinyl wraps have been installed on traffic boxes in the Original Denton District. These boxes feature art developed by Denton Independent School District students at Denton High School, Guyer High School, Ryan High School, and LaGrone Academy. Witness the transformation of the square and surrounding streets with these surprising pops of artistic color. Plans include installing additional wraps on traffic boxes featuring art created by TWU students,UNT -:F students, and other community partners. Pedestrian Safety Crossing on Oak and Welch Streets - On May 17, Council Member Meltzer asked staff to assess the intersection of Oak and Welch Streets for recommendations to improve pedestrian safety, including the possibility of a signalized crosswalk. The installation of a crosswalk at this location presents a challenge and is not recommended due to the "T" configuration of Oak and Welch Streets and the lack of necessary safe spacing between intersections. A signalized crosswalk is located approximately 620 feet to the west of Oak and Welch Streets and provides the safest street crossing opportunity. Nearby, at the intersection of Oak and Thomas Streets, a pedestrian beacon/crosswalk is scheduled for installation as part of the Texas Department of Transportation (TxDOT) Highway Safety Improvement Program(HSIP)This location was chosen due to its distance from signalized intersections with crosswalks and its proximity to student apartments. Green Tree Estates Roads and Trash Service — On May 19, Council Member Meltzer requested information regarding the roads and trash services at the Green Tree Estates neighborhood. Currently, each resident is a City of Denton customer that has been issued a garbage and recycling cart with service occurring at Swisher Road. The roads into the neighborhood are private and not at a standard that would permit a City of Denton Solid Waste collection truck to safely provide service at/in front of each residence. Due to the private nature of Green Tree Estates' interior roadways, any roadway or street improvements would need to be performed by the roadway owner(s). In 2019 the City did very minor improvements to the Green Tree Estates neighborhood roads under a disaster declaration to facilitate the temporary delivery of potable water via a water truck. Oak Street - On March 21, Council Member Byrd submitted a request through Engage Denton regarding a cable on Oak Street. The cable was observed to be hanging from a tree and over the road. Staff communicated with Frontier,who agreed to repair the line; however, on May 23, City staff were notified by Council Member Byrd that the issue was still unresolved.After staff followed up,Frontier indicated that the repair would be completed by June 9. Voter Registration Table Inquiry — On May 22, Mayor Pro Tern Beck requested information regarding the process for setting up a voter registration table during Water Works Park's opening day. A single-day permit is required to sell or do business on park property during a festival, event, or rental. Repair and Code Violations - On May 22, Mayor Pro Tem Beck asked staff to respond to a resident's complaints regarding alleged repair and code violations at a multi-family housing unit on McKinney Street. Staff contacted the individual and provided them with information on how to file a fair housing complaint with HUD and to Denton Housing 4 Authority related to their housing voucher. Community Improvement Services have received previous complaints from other tenants that were addressed in a timely manner by maintenance staff. Staff contact: Dani Shaw, Community Services F. Construction on Crescent Street- On May 23, Mayor Hudspeth and Mayor Pro Tern Beck shared a resident's email regarding construction on Crescent Street. The resident indicated issues with a crumbling driveway as well as a decline in the slope of the yard, making mowing difficult. The reconstruction of Crescent St. is part of the Denton Street Rehabilitation project and is in the final stages of reconstruction,which includes clean-up, sod installation, and sprinkler repair. Estimated completion is scheduled for early June 2023, weather permitting. Vegetation Overgrowth on Audra Lane—On May 23, Council Member Byrd requested an update on vegetation management at the northeast corner of Audra Lane due to the overgrowth of brush, grass, and weeds. A CIS Officer inspected the property and found high grass and weeds violations. The property owner confirmed the area would be mowed within the next week and staff will follow up with an inspection to ensure the violation has been abated. Russell Street Parking-On May 24,Mayor Hudspeth shared a business owner's request to explore options for increased parking spaces on Russell St. Staff will evaluate the existing parking and will work to find an ADA-compliant solution to the issues. Additionally, the City is currently working on a parking study to evaluate the overall parking needs for the downtown area. Water Works Park Opening Day — Summer is here, and Water Works Park (2400 Long Rd.)is ready to kick off its 2023 season on opening day, Saturday, May 27 at 11 a.m.! Street Closure Report.........................................................................................................61 FitchRatings 19 MAY 2023 Fitch Rates Denton, TX's $147M M COs and $72M M GOs 'AA+'; Outlook Stable Fitch Ratings -Austin - 19 May 2023: Fitch Ratings has assigned a 'AA+' rating to the following Denton, TX obligations: --$146.795 million certificates of obligation (CO), series 2023; --$71.845 million general obligation (GO) refunding and improvement bonds, series 2023. Fitch has also affirmed the following ratings at 'AA+': --The city's Issuer Default Rating(IDR); --More than $850 million outstanding limited tax GOs and COs. The Rating Outlook is Stable. The GOs and COs are scheduled for a competitive sale in early-to mid June. Proceeds from both series will be used to finance various public improvements. A portion of the GO proceeds will be used to refund outstanding debt for interest cost savings. SECURITY The GOs and COs are direct obligations of the city, payable from an ad valorem tax levied on all taxable property within the city, limited to $2.50 per $100 of taxable assessed valuation (TAV). The COs are further backed by a limited pledge of surplus net revenues (not to exceed $1,000)from the city's utility system. ANALYTICAL CONCLUSION The 'AA+' IDR and limited tax obligation ratings reflect Denton's superior financial resilience and operating reserve cushion, supported by strong revenue growth prospects, a high degree of revenue- raising capacity and sound expenditure flexibility.The rating also incorporates the expectation that the long-term liability burden will remain moderately elevated. Economic Resource Base Denton is located at the northern end of the Dallas-Fort Worth metro area. The local economy features institutions of higher education, a regionally prominent medical sector, along with a strong warehousing and manufacturing base, leveraging the city's multi-modal transportation network. 8 Denton is experiencing strong growth with an estimated 2021 population approaching 150,000, up nearly 31% since 2010. KEY RATING DRIVERS Revenue Framework: 'aaa' Fitch expects Denton's diverse and expanding tax base and operating revenues to continue to grow at a pace in excess of U.S. GDP. Independent revenue control is high relative to expected revenue volatility during normal economic cycles. Expenditure Framework: 'aa' Fitch expects that the city's pace of spending will be marginally above revenue growth. Discretion with respect to workforce and other operating costs provide the city with adequate flexibility to address economic challenges. Carrying costs do not pressure the budget; however, given the city's growth- driven capital needs, debt issuances will likely increase carrying costs over the near term. Long-Term Liability Burden: 'a' Currently atjust over 20% of estimated personal income, Fitch expects the city's long-term liability burden to remain elevated but within the 'a' range as future debt issuance plans will likely be accompanied by expansion of the resource base. The city's net pension liability(NPQ contributes a modest amount to its long-term liability burden. Operating Performance: 'aaa' Fitch anticipates Denton will maintain superior financial flexibility during economic cycles based on its high inherent budget flexibility and consistently maintained reserve levels. RATING SENSITIVITIES Factors that could, individually or collectively, lead to positive rating action/upgrade: --Sustained decrease in the long-term liability burden materially below 20% of personal income. Factors that could, individually or collectively, lead to negative rating action/downgrade: --Sustained deterioration of economic activity that slows current strong revenue growth to below U.S. GDP, weakening the revenue framework assessment; --A sustained increase in carrying costs to a level above 25% of spending. Best/Worst Case Rating Scenario International scale credit ratings of Sovereigns, Public Finance and Infrastructure issuers have a best- case rating upgrade scenario (defined as the 99th percentile of rating transitions, measured in a positive direction) of three notches over a three-year rating horizon; and a worst-case rating 9 downgrade scenario (defined as the 99th percentile of rating transitions, measured in a negative direction) of three notches over three years. CURRENT DEVELOPMENTS Denton closed fiscal 2022 (Sept. 30 FYE)with a $7 million net general fund operating surplus, net of transfers, and increased the unrestricted general fund balance to $45.5 million, equal to 32.6% of spending. The unrestricted general fund balance has equaled no less than 26% of spending dating back at least a decade. The adopted fiscal 2023 budget reflects structurally balanced operations.According to city officials, all of the key revenue streams are performing well year-to-date, and the city will end the fiscal year with at least balanced operations, and very likely a surplus. Existing unrestricted reserve levels comfortably support the 'aaa' operating performance assessment. The city's formal reserve policy includes a minimum reserve level at 20% of spending plus a 5% resiliency reserve (25% combined total). In November 2019, voters approved a $220.9 million GO bond program to finance roadway, public safety and park-related projects. The GO bond program has also financed various land acquisitions. Following the issuance of the series 2023 GO refunding and improvement bonds, the city will have $54 million in authorized, but unissued debt remaining. According to management, the city is slated to issue the balance in two tranches and will exhaust the authorized amount by December 2025. Given its strong growth projections, the city has a robust capital improvement program, which will necessitate the issuance of debt over the next several years. According to management, the city will likely approach voters for additional bonding authority over the next six to 12 months. CREDIT PROFILE Denton's location at the convergence of Interstates 35 East and West, and ready access to air and rail transportation have contributed to its strong warehousing and manufacturing base.The city is home to sizable distribution centers for several major retailers including but not limited to Target, Aldi and Lowe's Home Improvement. Its diverse manufacturers include Safran, Flowers Baking Company, TetraPak, Paccar Inc. and Peterbilt Motors among others. Denton is also known for its institutions of higher education including University of North Texas and Texas Woman's University and a regionally prominent medical sector. The city's growing health care facilities serve both north Texas and southern Oklahoma.These institutions include Columbia Medical Center Denton,Texas Health Presbyterian Hospital, Medical City Dallas and The Heart Hospital Denton (a Baylor Scott &White facility). The city's tax base continues to experience strong growth. Fiscal 2023 taxable assessed value (TAV) at $16.7 billion reflects a 23% increase over fiscal 2021 TAV. Management expects tax base growth to continue as there are several commercial, industrial and residential developments underway and 10 forthcoming. According to representatives, of the roughly 63,000 acres of land within the city limits, there are approximately 21,000 acres of developable land remaining. Due to the ample availability of developable land coupled with the more than 103,000 acres of land within the city's extraterritorial jurisdiction, which could be annexed, the city is not expected to reach buildout for many decades. However, due to unforeseen events from a renewable energy resource coupled with a 5.3% higher load served during the year, DME purchased additional Renewable Energy Credits (RECs) to ensure 100% renewable energy power supply. BACKGROUND: DME previously received approval from City Council to recognize the use of RECs to meet its 100%renewable energy goal as mandated by the Denton Renewable Resource Plan.Calendar Year 2021 was the first year that DME achieved it's 100%renewable energy goal and that achievement included the use of RECs too. DISCUSSION: DME Renewable Energy Supply Planning— Compliance with the requirements of the Denton Renewable Energy Plan(DRRP) is measured on a calendar year basis. This compliance period is a direct result of the accounting and crediting of RECs by the Electric Reliability Council of Texas (ERCOT) which provides a third-party independent verification of renewable energy credits for all market participants. Consequently, when DME forecast the number of MWhs of renewable energy required to demonstrate compliance with the DRRP, it spans two fiscal years. For calendar year 2022, the number of expected MWhs served for the months of January through September 2022, were forecasted in April of 2021 as part of the fiscal year 2022 budget. The remaining months of October through December 2022 were forecasted in April 2022 as part of the fiscal year 2023 budget. The Energy Management Organization (EMO) uses weather normalized forecasts to predict the amount of energy to be served in the City of Denton and the generation expected from our renewable resources under long-term PPAs. Renewable energy output from our contracted resources are a function of wind speed and duration and hours and intensity of solar irradiation during each day. Forecasting these quantities is based upon proprietary algorithms that use historical correlations of wind and sun to forecast output from each of our contracted resources. Given the volatility of weather,the EMO recognizes that forecasts are likely to be off from actuals but in order to maintain the statistical integrity of the load and generation forecasts, this analytical approach is considered a best practice in the electric utility industry. For calendar year 2022 the EMO projected that the total DME served load would be 1,661,682 MWh. Actual calendar year 2022 load served was 1,750,135 MWh, or 5.3%more than forecasted. Recall that the summer of 2022 was one in which the ERCOT market set eight new all-time 37 May 26,2023 Report No. 2023-037 records, and DME also set new records. Data Center load is fully covered through RECs at their expense and is not reflected in above load served amount. For the calendar year, the EMO projected that renewable energy supply under contract would be sufficient to meet the forecasted load. However, in May of 2022, after both the fiscal years 2022 and 2023 were set, DME became aware that a renewable energy resource would default and not supply any renewable energy despite the forecasts that included that contribution. When DME became aware of the potential shortfall, we entered into a short term(2 year) fixed shaped energy supply transaction that included RECs as a replacement resource. Renewable Energy Credit Inventory— ERCOT, as the market administrator for RECs, issues RECs to each renewable energy generator monthly. However, Retail Energy Providers (REPS) who provide contracted energy in the competitive retail market areas of ERCOT are not required to demonstrate compliance with the renewable energy portfolio standards until May 1 of the year following the compliance year. Because the REC market was developed with this compliance date in mind, renewable energy resources do not generally finalize their REC transactions until mid-April of each year. DME's contracted renewable energy resources do not post their RECs to DME's REC account at ERCOT until mid-April. Consequently, DME does not know the actual level of RECs officially allocated by ERCOT to each renewable energy resource and those resources are trueing up their ERCOT accounts into April of each year. In early April,DME's ERCOT REC account contained 1,659,135 RECs or 2,547 (.16%) more RECs than the forecasted MWh in DME's load forecast but less than the actual load for the calendar year. Actual Load Served and Actions Taken by EMO — As previously stated,DME purchased 1,750,135 MWh from ERCOT for resale to retail customers in calendar year 2022. With an ERCOT REC inventory of 1,659,135 for the calendar year,DME's account was 91,000 or 5.2% short against the actual load served. To balance the account, DME purchased 91,000 RECs from the market to achieve 100% renewable energy supply for the year and to again achieve compliance with the DRRP goal. The 5.2% deficit in RECs at the end of the year was expected based upon the 5.3% more load served by DME than was forecasted. However, because energy can only be purchased prospectively, and the EMO manages the hourly load position in the real-time and next day ERCOT markets, REC backed energy was not purchased. There is no real time or day ahead market for REC backed energy in ERCOT, or any other regional transmission market. Unless DME were to purposefully over procure REC backed energy as compared to the EMO's forecast, the only way to true-up the REC amounts at the end of the year is through the bilateral REC market. This is what was done for calendar year 2022. DME will continue to function in this manner and this practice will be fully explained in the revised DRRP that will be issued later this year. It should be noted that if DME were in a surplus position relative to REC inventory levels, DME would use the same bilateral REC market to sell the surplus RECs and monetize the excess value for the benefits of DME customers. 38 May 26,2023 Report No. 2023-037 The EMO believes the actions taken this year to demonstrate compliance with the DRRP are prudent and consistent with electric industry best practices. The processes and procedures used to demonstrate compliance are fully auditable and are consistent with the findings and recommendations of the City of Denton's March 14, 2022, EMO audit.
