Public Meetings & Agendas | Denton, TX (civicplus.com) General Information & Status Updates A. Fire Department Deployment to Wildfires – The Fire Department (FD) deployed personnel this week to areas in the Texas Panhandle to assist in the wildfire outbreak. Strike Team 24-118, consisting of crews from Denton, Justin, Wichita Falls, and San Angelo fire departments, will assist Texas Intrastate Fire Mutual Aid System (TIFMAS) resources, along with the Texas Forestry Service (TFS). The City sent four (4) personnel, one (1) brush truck, and one (1) Chief’s vehicle for TIFMAS response, along with one (1) additional firefighter who is deployed as part of Texas A&M Engineering Extension Service (TEEX) Texas Task Force 2. Task Force 2 is positioned in Borger, TX conducting search and rescue operations in the towns of Fritch and Stinnett. Staff contact: Kenneth Hedges, Fire B. Municipal Court Hours of Operation Update – Beginning March 13, 2024, the Municipal Court will change the Wednesday hours of operation for the court clerk windows and phone lines to 8:00 a.m. to 3:30 p.m. Business hours are currently Monday through Friday, 8:00 a.m. to 5:00 p.m. This change has no impact on court dockets, and online services and phone payments will continue to be available. All other business hours will also remain unchanged. Updates are being made to all posted business hour listings. This modification will enable more focused completion of offline assignments, projects, and staff development. Staff contact: Jamie Lindsay, Municipal Court C. Mayhill Name Change Community Meeting – Capital Projects will host a Virtual Community Meeting on Thursday, March 21 at 6:00 p.m., regarding the renaming of Mayhill Road from Edwards Road by the Denton County Transportation Authority (DCTA) train tracks to the new four (4)-lane intersection of Mayhill Road. The existing two (2)-lane section of Mayhill Road needs to be renamed to avoid confusion caused by the road’s expansion south of the bridge. Monthly Mobility Report – Innovative Transportation Solutions (ITS) provides a monthly report which included the overview of several major regional Texas Department of Transportation (TxDOT) projects. DTV Video Highlights for February – In addition to producing public meetings, DTV released several videos this month that raise awareness, educate, and inform our community. The following are highlighted videos Council is encouraged to share: • Denton PD: Forensics Division YouTube Facebook As part of the PD Headquarters renovation project, a dedicated lab space was created for our Forensics personnel to process and analyze evidence. • Denton Rides: Mobile Recreation Unit YouTube Facebook The Parks and Rec Department turned a former Fire Department Ambulance into a Mobile Recreation Unit. • Run for Dylan YouTube Facebook Denton’s first free-standing Automated External Defibrillator (AED) SaveStation at South Lakes Park in honor of 17-year-old Dylan Dorrell. All videos air on DTV, are shared via social media channels, and are available on the City’s YouTube channel. Staff contact: Billy Matthews, Marketing and Communications 2 F. Fleet Services ASE Blue Seal of Excellence Award – The Fleet Services Department proudly earned the prestigious Blue Seal of Excellence Award for the 2023-2024 period from the National Institute for Automotive Service Excellence (ASE). To qualify for the ASE's Blue Seal of Excellence Recognition Program, an organization must ensure that at least 75% of its automotive professionals are ASE certified. Demonstrating commitment to excellence, the Fleet Services Department successfully met all necessary ASE criteria. The department is currently in the process of drafting a proclamation for presentation at an upcoming City Council meeting. Staff contact: Tom Gramer, Fleet and Facilities G. Airport Staff Trained as NWS Storm Spotters – Three (3) operations and maintenance staff members from Denton Enterprise Airport recently participated in a SKYWARN training course, a collaborative effort between Denton County, Texas Woman’s University, and the Fort Worth office of the National Weather Service (NWS). The training equips participants to serve as storm spotters for the NWS. Given the airport's location on the west side of the City and its extensive visual line of sight, these trained individuals can now provide real-time storm information to the City’s emergency management operations during hazardous weather conditions. This capability not only enhances the Airport’s operational readiness but also contributes to bolstering the safety of our residents and community. Staff contact: Ryan Adams, Denton Enterprise Airport Responses to Council Member Requests for Information A. Bike/Pedestrian Lane on Montecito Drive – On Feb. 13, Council Member Holland forwarded an inquiry from a resident regarding painting a bicycle/pedestrian lane on Montecito Drive from Hobson Lane to Ryan Road. Staff conducted a traffic audit and observed Sharrows striping and signage cautioning road users that bike users may use the full lane on the segment of Montecito Drive from Hobson Lane to El Paseo Street. Staff concluded that multiple driveways directly accessing Montecito Drive between Hobson Lane and Ryan Road will be a significant safety risk to bike users, therefore a bike lane is not recommended. Staff recommends adding Sharrows striping and caution signage on Montecito Drive in both directions on the segment between El Paseo Street and Ryan Road and installing a four-way stop sign at the El Paseo Street and Montecito Drive intersection to the ensure safety of road users. Staff is coordinating as effort to implement the recommendations. Staff contact: Farhan Butt, Development Services B. Wreck Frequency on University – On Feb. 14, Mayor Pro Tem inquired about accident statistics for the University Drive intersections from Masch Branch Road to Mayhill Road and taking proactive measures to improve red-light running frequencies. Staff conducted a road safety audit on University Drive at Bell Avenue, Ruddle Street, Nottingham Drive, and Old North Road intersections. Observations included a blocked line of sight for right-turn maneuvers caused by traffic control equipment e.g., cabinets, outgrown vegetation, and a wall monument on the north and south sides of the intersections. The attached crash data analysis reflects that several crashes at these intersections involved red light violations and failing to yield to oncoming traffic. Staff recommends installing a “No right turn on Red” sign in compliance with Texas Manual on Uniform Traffic Control Devices on each side of the Bell Avenue, Old North Road, and Nottingham Drive intersections to mitigate red-light violations through enforcement. Staff is coordinating an effort to install the recommended signage. In addition, traffic officers routinely target high-incident locations 3 with enforcement activities to reduce crashes. Construction prior to 7:00 AM – On Feb. 16, Mayor Pro Tem Beck forwarded concerns from a resident concerning construction practices and surface water management plans of a development adjacent to their property. Staff met with the developer and issued a warning to both the developer and the construction company regarding working hours. Staff also reviewed the surface water management plans of the development and reconfirmed that they complied with City code. Staff and the Engineer of Record will inspect retaining walls during construction to ensure adherence to the approved plans. Staff contact: Tina Firgens, Development Services D. Development Project Voting Record – On Feb. 20, Mayor Hudspeth requested information regarding City Council's voting record in relation to staff's recommendation for development projects. In 2023, Development Services submitted 22 public hearing items related to developments. City Council voted in approval of staff's recommendation in all but two of those development cases. Stuart Apartments (S23-0002) was initially denied but, following reconsideration by City Council, was ultimately approved. Cudd Bonnie Brae Rezoning (Z23-0007) was a 4-3 vote to approve but failed to meet the supermajority requirement. Staff contact: Charlie Rosendahl, Development Services E. Drilled Hole Concerns on Forrestridge Drive – On Feb. 26, Council Member Holland emailed staff regarding a round hole drilled in the curb that appeared to be a core sample on Forrestridge Drive. After investigation, staff identified it as a core hole placed by a vacuum truck to confirm the location of franchise utilities. The core hole was filled on Feb. 26, and permanent restoration is scheduled for next week. Staff contact: Trevor Crain, Capital Projects F. Block Party Funding – On Feb. 26, Council Member Meltzer forwarded an inquiry from a resident regarding available funding for neighborhood block parties. Currently, funding is not available for such events. However, the City does have guidance on how to create a successful block party event, including permitting and street closure information on its website. Staff contact: Dani Shaw, Community Services G. Emergency Water Repair (W. Prairie Street) – On Feb. 26, Council Member Byrd forwarded a resident’s questions regarding construction on W. Prairie Street and City communications practices. After receiving reports of low water pressure from various residents, staff identified and started repairs to a leak on the public water service line. Construction delays occurred due to damage to an unmarked gas line. Repairs to the water line, gas line, and asphalt have been completed. It is standard practice for crews to notify affected residents of an emergency utility repair by going door-to-door and leaving door hangers for those with whom direct contact could not be made. In this instance, door hangers were not left which led to a communications gap. This has since been identified and corrected. Staff contact: Casey Bowles, Water Utilities H. Masch Branch Detour – On Feb. 27, Council Member Meltzer forwarded concerns from a resident of Ranch Estates about the increase in heavy vehicle traffic through their neighborhood due to the Masch Branch Road closure. Staff is exploring additional options to mitigate the impact of the street closure and have scheduled a meeting with the resident early next week. Electric Vehicle Survey – On Feb. 27, Mayor Hudspeth forwarded a survey from the Dallas Regional Mobility Coalition (DRMC) around City owned Electric Vehicle (EV) usage and infrastructure. Apartment Solid Waste Collection – On Feb. 28, Council Member Byrd forwarded concerns from a resident regarding their apartment community’s solid waste collection services. Staff connected with the resident to explain the cause of the service disruption and dispatched a crew to clean up the site. There are 800 working days and 39 months of barricades. See attached TxDOT construction report. • City Participation: TxDOT provided an AFA to the City of Denton for the 10-foot sidewalk component. This AFA notes a fixed cost of $95,000.00 to be transferred to TxDOT and voids the original agreement executed in September 2017. City council approved same on September 1, 2020. Denton County transmitted an ICA to the City of Denton for its $55,000.00 participation in this fixed cost contribution. City council approved same on September 1, 2020. Denton County approved ICA on September 15, 2020. We have reviewed assessments done by other local governments. Fleet tracking/monitoring information on our light and medium duty fleet will have sufficient data later this year to make more informed decisions. How many EVs do you have in your fleet and for what departments? Five EVs. Dispersed amongst Fleet, Solid Waste & Recycling, Denton Municipal Electric, and Community Services. Additionally, we have six plug-in hybrid electric vehicles in our fleet. How many charging stations does your city have? Are they available to the public, or for your fleet only? The City owns 10 charging stations, five reserved for City fleet vehicles and five of which are publicly available. Do you have any usage metrics? For the city fleet charging stations, we do not have metrics as most are “dumb” stations (direct plug for power). For the public EV charging stations on city owned property, from August 2021 through August 2023 they were used approximately 0.6% of the time out of a 24-hour day. If you refine that to look at a 12-hour window (8 a.m. to 8 p.m.) then usage is just over 1%. What do you charge to use them? How much? City Fleet are not charged for the use, as the electric meters are paid by the departments. For the public charging, we use ChargePoint as the vendor and consumers pay $2.40 per hour. 33 How did you pay for the stations? Texas Commission on Environmental Quality (TCEQ) Texas Emissions Reduction Program (TERP) grant funds for the Library and Parks locations. Denton Municipal Electric (DME) paid for the Development Services Center location. Do you plan to add more stations? For City fleet usage, yes. As the fleet expands then EV charging infrastructure will be added as needed. For public usage, not currently. We are closely monitoring the market. In the recent past, we have seen EV charging added at gas stations, grocery stores, banks, apartment complexes, and hotels/motels. How did you determine sites to place stations? Locations for publicly available charging stations were determined by assessing the electrical infrastructure suitability, the availability to the public, and the availability of amenities nearby. This led to the inclusion of two charging stations at our larger parks (North Lakes & South Lakes), two library locations (North Branch & South Branch), and our Development Services Center adjacent to our downtown square. About how many calls has your Fire Department responded to that involved EVs? The Denton Fire Department has not had any EV fires recorded at this time. What are the main issues associated with EV fires? The primary issue is thermal runaway, in which extinguishment is challenging due to the proximity of uninvolved battery cells. Are EV fires more dangerous than regular gas vehicle fires? Yes. What is most used to extinguish EV fires? Water, foam, blankets, etc. Our current practice is to isolate away from structures using blankets. Water usage would be a situational decision. Is there anything else you would like to share related to EVs? The North Central Texas Council of Governments (NCTCOG) is the lead agency for tracking EVs in the metroplex. Electric Vehicles North Texas | DFWCC (dfwcleancities.org) NCTCOG also has a website dedicated to assisting consumers with various funding sources for clean fleet. North Central Texas Council of Governments - Air Quality Funding (nctcog.org) 34 Date: March 1, 2024 Report No. 2024-010 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Provide City Council an overview of youth access to public library materials and facilities, along with the revelation of materials policy EXECUTIVE SUMMARY: Denton Public Library offers comprehensive services and resources, including a collection of 261,981 titles, catering to all age groups while adhering to established policies and procedures. The library ensures parental rights are upheld, delineating responsibilities and access guidelines clearly within its policies. These policies are regularly reviewed and approved by the Library Advisory Board, ensuring consistency and efficiency in service delivery. Denton Public Library policies are available on the library website: https://library.cityofdenton.com/screens/dpl_policies.html. DISCUSSION: Denton Public Library serves residents of Denton across all age brackets, categorizing individuals as a minor (birth to 17 years of age), while those 18 and above are considered adults. Minors may also be referred to as youth, juveniles, children, or teens. Library cards, synonymous with library accounts, grant access to resources and materials. The library’s Circulation Services Policy clarifies how to get a public library account, what types of library accounts are available, and the circulation rules. An application for a youth library account must be submitted by the parent or legal guardian. The parent or legal guardian is the adult on record for the library account and is responsible for account activity, including checkout of materials and any fees accrued. This requirement is in place for the three types of library cards for minors: Youth Denton Resident, Youth Courtesy Card (non-resident), or Books2Go Denton ISD Student account type. The Circulation Services Policy also includes the following text regarding access to library materials by minors: • The library staff cannot and do not act in loco parentis. [In loco parentis is “in the place of a parent” and refers to acting as a guardian of a child and having the responsibilities of a parent.] • It is the policy of the Denton Public Library that parents or guardians, not library staff, are responsible for monitoring and approving the selection of materials made by their children. • The parent or guardian authorizes the juvenile’s uses of the card and accepts the responsibility for the selection of materials borrowed and for the return of the materials and any charges incurred. • Parents or guardians who wish their children not to have access to certain materials or services should so advise their children. The library cannot be responsible for enforcing such restrictions. 35 Date: March 1, 2024 Report No. 2024-010 • Due to both the parent’s and child’s name being on the patron account, both have access to borrowing information. Over 1.06 million items were checked out from Denton Public Library collections in 2023. Approximately 80% of items circulated were physical items (books, DVDs, CDs, audiobooks, or kits) and the remaining 20% of check outs were downloadable materials. Items checked out at library self-service kiosks make up 90% of the library’s in-person check outs. The library’s system does not have the ability to automatically restrict circulation of a list of particular titles for cardholders. While library software could potentially be configured to restrict access to entire collections for certain account types, it is not recommended by staff and is essential to consider the practical implications of such measures. Library collections are broken out into age and type and shelved together in a designated set of shelving, examples include Junior Fiction (fiction chapter books), Easy (picture books), Youth Nonfiction, Teen Fiction, Adult Fiction, Adult Nonfiction, Junior Graphic Novels, Adult CDs, etc. Restricting access would block check outs from every item in a designated collection. For example, a high school student restricted from checking out Adult Fiction materials could not check out school assigned literature like To Kill a Mockingbird, The Great Gatsby, Pride and Prejudice or any of the other 48,341 items in Adult Fiction. Students restricted from Adult Nonfiction could not check out titles like Shakespeare’s Julius Caesar, Night by Elie Wiesel, or any of the other 39,351 nonfiction books about science, math, history, art, technology, biography, or religion to support schoolwork without a parent requesting a staff override for each check out. Implementing blanket restrictions would lead to recurring parental requests to override blocks for youth access, especially for resources crucial for school or personal enrichment. This would impose significant customer service demands and compromise the efficiency of library operations. The Unattended Children Policy describes age requirements regarding when a caregiver must accompany a minor visiting the library. Many families send older siblings to the library with younger family members. The policy also addresses these instances. Any child ages ten (10) and under must be accompanied by a caregiver. An adult caregiver may entrust a teenager (ages 13+) to accompany a child to the library. The temporary teen caregiver must demonstrate that they are willing and capable of supervising younger children. The policy also notes that: Parents, guardians, teachers, and other designated caretakers of children—hereafter known as caregivers—are responsible for the behavior and supervision of their charges while in the library. Library staff does not serve “in loco parentis” (in place of a parent.). The Confidentiality of Library Customer Records ensures privacy rights for patrons, allowing parents or legal guardians access to their minor’s account information. As such, the parent or legal guardian can check the minor’s account via the online catalog at any time or show their photo ID to access account information when speaking to a library staff member: 36 Date: March 1, 2024 Report No. 2024-010 Regarding Parental Access to Records: Private information may be released to the parent or guardian indicated as the adult responsible for the account of an unemancipated minor age seventeen (17) or under. The parents or guardian on the account must provide an accepted form of I.D., as listed in the Circulation Services Policy. The library’s collection of 261,981 titles is selected and managed by professional librarians, following the library’s Collection Development Policy. The Collection Development Policy identifies collection goals, selection criteria for different types of collections, types of materials that are not acquired, collection maintenance, and identifies the library’s Reevaluation of Materials Policy as the process for reconsideration of resources. Professional librarians also follow the Texas State Library and Archives Commission’s CREW: A Weeding Manual for Modern Libraries for collection maintenance. The Reevaluation of Materials Policy provides an opportunity for residents to share concerns about an item in the library collection and ask that it be reevaluated as to whether it meets collection criteria. After sharing concerns with a librarian, a resident may request that a title is reviewed, initiating the review process with professional librarians, the Director of Libraries, and input from the Library Advisory Board. CONCLUSION: The library’s commitment to serving individuals of all ages is supported by policies that require or encourage parental involvement in all aspects of library use by minors. These processes, regularly reviewed and updated, support the library’s mission to transform lives, strengthen community, and inspire imagination.
