AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING AND DIRECTING
THE CITY MANAGER TO EXECUTE AN AMENDMENT TO EXPAND THE SCOPE OF
ACTIVITIES AND EXTEND THE TERM OF A RIGHT OF ENTRY AND POSSESSION
DATED MARCH 3, 2009, AND EXTENDED ON MAY 5, 20095 IN FAVOR OF THE
DENTON COUNTY TRANSPORTATION AUTHORITY (DCTA) AND AUTHORIZING
DCTA TO ENTER UPON AND TAKE POSSESSION OF CERTAIN REAL PROPERTY OF
THE CITY OF DENTON FOR THE PURPOSE OF PERFORMING ACTIVITY AS
DESCRIBED IN ATTACHMENT "A" HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, .the City of. Denton, Texas is a Home-Rule City and a Municipal
Corporation (hereafter "Grantor"), and claims an interest in and to the following described tract
of land:
BEING all that certain lot, tract, or parcel of land described in that certain Quitclaim
Deed from Missouri Pacific Railroad Company to the City of Denton, Texas dated
August 9, 1993, and filed on August 24, 1993, as Clerk No. 93-R0058485 in the Real
Property Records of Denton County, Texas; and also being that same property described
in that certain Correction Quitclaim Deed, dated June 1, 2001 and filed for record in the
Real Property Records of Denton County, Texas as Volume 4857, Page 02021 (hereafter
the "Property").
WHEREAS, the Denton County Transportation Authority (hereafter "DCTA") expects to
acquire an easement in the Property from the City of Denton, Texas for the purpose of
constructing, operating and maintaining DCTA's passenger rail line (the "Project") for
approximately eight miles, extending Southward through the City of Denton, and much of which
easement tract lies within the City of Denton, Texas; and
WHEREAS, the City of Denton, Texas expects to grant unto DCTA a perpetual easement
upon reaching acceptable terms of agreement, in order that DCTA can immediately commence
preparatory construction activities on the above-referenced Project; and
WHEREAS, DCTA needs immediate possession of the Property in order to prepare the
Property for DCTA construction activities, pending final negotiation of the terms of the easement
with the City of Denton and the Dallas Area Rapid Transit; and
WHEREAS, both the City of Denton and DCTA recognize the urgency of commencing
construction on the Project as soon as is reasonably possible; and
WHEREAS, on March 3, 2009 the City Council adopted ordinance Number 2009-059
authorizing the execution of a Right of Entry and Possession to DCTA; and
WHEREAS, On May 5, 2009 the City Council adopted ordinance No. 2009-118
extending the expiration of the Right of Entry and Possession for a period of 30 days from the
date of expiration set forth in Ordinance No. 2009-059; and

WHEREAS, The City Council deems it to be in the best interest of the City to execute an
amendment to expand the scope of activities and extend the term of the said Right of Entry and
Possession in favor of DCTA; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Manager, or his designee, is hereby authorized and directed to
execute a Right of Entry and Possession for the above described property in favor of DCTA. A
copy of the said Right of Entry and Possession is attached hereto as Attachment A and
incorporated herein for all purposes.
SECTION 2. The authority granted DCTA pursuant to this Ordinance shall be
conditioned upon DCTA's compliance with all applicable federal, state or local laws and
regulations including, but not limited to, any and all City of Denton mandated standard
requirements, procedures and processes for obtaining permits prior to the commencement of any
activity authorized herein. Failure to comply with all such requirements, including the obtaining
of required permits, prior to the commencement of such activities shall cause the immediate
suspension of all authority granted DCTA pursuant to this ordinance.
SECTTION 3. The authority granted DCTA pursuant to this Ordinance shall expire on
September 8, 2009 after which date all authority granted herein shall cease and this Ordinance
shall be of no further force and effect.
SECTION 4. This Ordinance shall become effective immediately upon its passage and
approval.

COUNTY OF DENTON )
WHEREAS, the City of Denton, Texas is a Home-Rule City and a Municipal
Corporation (hereafter "City"), and claims an interest in and to the following described tract of
land:
BEING all that certain lot, tract, or parcel of land described in that certain Quitclaim
Deed from Missouri Pacific Railroad Company to the City of Denton, Texas dated
August 9, 1993, and filed on August 24, 1993, as Clerk No. 93-R0058485 in the Real
Property Records of Denton County, Texas; and also being that same property described
in that certain Correction Quitclaim Deed, dated June 1, 2001 and filed for record in the
Real Property Records of Denton County, Texas as Volume 4857, Page 02021 (hereafter
the "Property").
WHEREAS, the Denton County Transportation Authority, a coordinated county
transportation authority created under Chapter 460 of the Texas Transportation Code (hereafter
"DCTA") expects to acquire an easement in the Property from City for the purpose of
constructing, operating and maintaining DCTA's passenger rail line (the "Project") for
approximately eight miles, extending Southward through the City of Denton, and much of which
easement tract lies within the City of 'Denton, Texas; and
WHEREAS, City expects to grant to DCTA a perpetual easement upon reaching
acceptable terms of agreement with DCTA; and
WHEREAS, DCTA needs immediate possession of the Property in order to prepare the
Property for DCTA construction activities, pending final negotiation of the terms of the easement
with the City of Denton; and
WHEREAS, both City and DCTA recognize the urgency of commencing construction
on the Project as soon as is reasonably possible;
NOW THEREFORE, for and in consideration of the sum of TEN DOLLARS ($10.00)
and other good and valuable consideration to it in hand paid by DCTA, the receipt and
sufficiency of which is hereby acknowledged and confessed, City grants to DCTA the right to
enter upon the Property, the right to remove improvements, if any, with which the Property is
encumbered, and the right to possession of the Property for Project purposes.
This grant of right of entry and possession is conditioned upon the following:

DCTA may perform pre-construction surveying upon the Property, such as activities of
survey crews and pick-up trucks; and
2. DCTA may install erosion control, such as erection of silt fences and the installation of
construction entrances; and
3. DCTA may conduct limited clearing and grubbing on the Property, such as cutting and
mulching vegetation, and removing stumps, roots, and debris. Any clearing and grubbing
activity scheduled on the Property shall be subject to the following:
a. A plan for the work shall be provided identifying locations, means and
methods, a listing of contractors with contact information along with a schedule
of who, when, and where the work will be done.
b. Communication with City of Denton personnel that will be inspecting or
monitoring this work Grantee or Grantee's agents shall initiate notification
through Alberto Lopez with Denton Water Utilities at (940) 391-8622.
c. DCTA will provide a point of contact with the DCTA for communication,
coordination and claims resolution.
d. Clearing and grubbing of trees within the 20 feet of the eastern boundary of the
Property shall be limited to chain saws and stump grinders to avoid disturbance to
adjacent underground utilities.
4. DCTA may conduct pot holing of utilities through coordination with the Denton Water
Utilities subject to the following:
a. A plan for the work shall be provided to City identifying locations, means and
methods, a listing of contractors with contact information along with a schedule
of who, when, and where the work will be done.
b. Communication with City of Denton personnel that will be inspecting or
monitoring this work. Grantee or Grantee's agents shall initiate notification
through Alberto Lopez with Denton Water Utilities at (940) 391-8622.
c. DCTA will provide a point of contact with the DCTA for communication,
coordination and claims resolution.
5. DCTA may perform construction activities in Phase 1 of the corridor, Hickory Street to
Shady Oaks subject to the conditions listed in Items 6 & 7 below. The limits of Phase I is
demonstrated in Exhibit 1. DCTA may perform construction activities as outlined in the City
of Denton Work Plan, demonstrated in Exhibit 2.
6. The attached Exhibit 3 shows the current outstanding water, sewer, and drainage issues
related to Phase 1 of the project. The items highlighted in bold font are issues that the City
has determined must be resolved prior to any construction beyond limited clearing and

grubbing, potholing, and erosion control as outlined above. Major issues include, but are not
limited to, the following:
1. The current Construction Plans show proposed improvements that may conflict with
existing City water and sewer lines in many areas; additional information must be added
to the Plans in order to confirm that the City's existing lines will not be damaged.
2. The PEC-4 bridge plans do not provide sufficient design data to show compliance with
the City's design criteria; hydraulics and hydrology data for bridge design must be
provided.
3. Satisfactory resolution of the traffic/transportation comments issued to DCTA in redline
markups on plans submitted by DCTA.
All revisions must be submitted to, and approved by, the Development Review Committee.
7. DCTA must execute the 3-way contract for all public improvements related to water, sewer,
drainage, traffic/transportation, submit performance and payment bonds, and pay 2.5 percent
inspection fee equal to the value of all public improvements prior to the preconstruction meeting
with the Public Works Inspection Department. PS Arora, Development Review Committee
Engineering Administrator should be contacted at (940) 349-7189 prior to initiating any
construction activities.
8. The authority granted DCTA pursuant to this Ordinance shall be conditioned upon DCTA's
compliance with all applicable federal, state or local laws and regulations including, but not
limited to, any and all City of Denton mandated standard requirements, procedures and processes
for obtaining permits prior to the commencement of any activity authorized herein. Failure to
comply with all such requirements, including the obtaining of required permits, prior to the
commencement of such activities shall cause the immediate suspension of all authority granted
DCTA pursuant to this Right of Entry and Possession.
This Right of Entry and Possession shall extend to DCTA, its employees and its contractors.
This Right of Entry and Possession shall be valid and effective for a period of seventy
(70) days following the date of this document's approval by City, as evidenced by the signature
of its City Manager; thereafter it shall terminate and be of no further force and effect.
EFFECTIVE on the I day ofOiVA& .2009.

Listed below is the compilation of the outstanding water, sewer, and drainage comments for work in the
"Phase 1" area; substantial issues are in bold. (Still waiting on Traffic comments.)
General
1. Clearly label existing and proposed water, sewer, and reuse lines on the Traffic Signal Design
sheets, and confirm no conflicts with traffic signal facilities.
Water
1. For any proposed split casings 16" or larger, it is critical that the Engineer Of Record submit
design information describing/illustrating how the following issues (at a minimum) will be
addressed:
• Temporary support of existing pipe when uncovered;
• Method of installing and joining split casing sections;
• Permanent support of existing carrier pipe within proposed casing pipe;
• Sealing ends of casing pipe
The City has requested this information repeatedly over the past several months. Please be
aware that the City will not accept the Plans until this information has been provided and we
have had a chance to review and comment.
2. Near Sta 1992+86, the proposed construction appears to be possibly in conflict with the
existing 30" potable water main. In this cross section, show existing location and depth of this
main so that conflicts can be identified and improvements redesigned as necessary.
3. From Sta 2005+00 thru 2005+78, the proposed excavation appears to be possibly in conflict
with the existing 20" potable water main. In these cross sections, show existing location and
depth of this main so that conflicts can be identified and the improvements redesigned as
necessary.
4. From Sta 2026+00 thru 2029+00, the proposed excavation appears to be possibly in conflict
with the existing 20" potable water main. In these cross sections, show existing location and
depth of this main so that conflicts can be identified and the improvements redesigned as
necessary.
S. From Sta 2031+00 thru 2032+50, the proposed excavation appears to be possibly in conflict
with the existing 20" potable water main. In these cross sections, show existing location and
depth of this main so that conflicts can be identified and the improvements redesigned as
necessary.
6. Near Sta 2044+20, the proposed construction appears to be possibly in conflict with the
existing 20" potable water main. Provide an additional cross section for this location, showing
existing location and depth of this main so that conflicts can be identified and improvements
redesigned as necessary.
7. Near Sta 2069+73, the proposed construction appears to be possibly in conflict with the
existing 20" potable water main. Provide an additional cross section for this location, showing
existing location and depth of this main so that conflicts can be identified and improvements
redesigned as necessary.
Sewer
1. Per previous City comment, all crossings need to be CCTV'd after the construction. Add note to
this effect to the Civil General Notes.
2. Delete "Precast Manhole" and "Cast-In-Place Manhole" Details from Sheet U-134.
3. Near Sta 1993+40, the proposed construction appears to be possibly in conflict with the
existing 15" sewer main. Provide an additional cross section for this location, showing existing
location and depth of this main so that conflicts can be identified and improvements
redesigned as necessary.
Drainage
Volume 3:
Sheet D-129A:
1. There are storm callouts on this sheet, but no storm pipes shown.
Sheet D-133A:
1. Curb inlets cannot be used as junctions boxes.
2. Install an access manhole at RCB bend, or place the drop inlet over the bend.
Sheet D-135:
1. Proposed curb inlets are required to be recessed inlets.
2. Provide flowline and pipe slope information for all storm junctions.
3. Per Sheet C-689, the proposed curb inlets are not located on the sag location. Revise plans
as required.
Sheet D-136:
1. Adjust flow arrows.
Sheet D-139:
1. The lateral from the curb inlet shall tie-in with direction of flow.
2. Curb inlets cannot be used as junction boxes.
Sheet D-141:
1. Junction box is required at lateral connection.

Volume 5:
General Comments:
1. The City recommends installation of a deflector component for all proposed piers located
within the area of stormwater to prevent buildup of trash and debris.
2. City will require a plan and profile view showing the limits of construction of all existing
creeks at each crossing.
3. Provide hydraulics and hydrology analysis for all bridge crossings.
4. Proposed work within Loop 288 will require a TXDOT permit. This permit will be required
to be processed through the City.
5. Show how proposed grading at bridge crossings will tie back to existing grade.
6. Design of structures over FEMA streams must accommodate fully developed runoff
conditions such that there will be no rise in water surface elevations for the fully
developed conditions. Engineer to submit all related hydrology/hydraulics data
developed and used for the bridge routings. In Phase 1 this will apply to the proposed
bridge over Pecan Creek (PEC-4, -Sta 20+50, Sheet 5-111).
Sheet-630:
1. Reinforce turf at upstream end.
2. Provide proof of permission to grade off-site for the proposed grade to drain.
