AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER
NUMBER ONE TO THE CONTRACT BETWEEN THE CITY OF DENTON AND J.R. STELZER
COMPANY; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND
PROVIDING AN EFFECTIVE DATE (BID 3945-HIGH SCHOOL ELEVATED STORAGE TANK
CHANGE ORDER NUMBER ONE IN THE AMOUNT OF $73,400).
WHEREAS, on May 6, 2008 by Ordinance No. 2008-095, the City awarded a public works
contract to J.R. Stelzer Company in the amount of $949,467 for the High School Elevated Storage
Tank Repaint project;
WHEREAS, the Staff having recommended, and the City Manager having recommended to
the Council that a change order be authorized to amend such contract agreement with respect to the
scope of work and an increase in the payment amount, and said change order fees under the proposed
contract are fair and reasonable and are consistent with and not higher than the recommended
practices and fees published by the professional associations applicable to the Provider's profession
and such fees do not exceed the maximum provided by law; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Change Order Number One, increasing the amount of the contract between
the City and J.R. Stelzer Company, which is on file in the office of the Purchasing Agent, in the
amount of Seventy Three Thousand Four Hundred and 0/100 ($73,400) Dollars, is hereby approved
and the expenditure of funds therefor is hereby authorized in accordance with said change order. The
total purchase order amount increases to $1,022,867.

CHANGE ORDER NO. 1
A. INTENT OF CHANGE ORDER
The intent of this change order is to modify the provisions of the contract entered into between the City of
Denton, Texas and )eK. J. R. Stelzer Co., 5850 Russell Drive, Lincoln, Nebraska 68507, for construction of
the High School Elevated Storage Tank Repaint project, dated May 6, 2008.
B. DESCRIPTION OF CHANGE
The City of Denton has requested the contractor perform extra work to re-paint the exterior of the 2.0
million gallon McKenna Park Stand Pipe. This change order covers the extra work as follows:
a. Clean and recoat the entire exterior of the tank. It is anticipated that the tank will be left in service
during this work.
b. Pressure wash the entire stand pipe surface with 5000 psi machines using orbital tips. The City of
Denton will provide water at no charge. It is expected this effort will remove all loosely adhering
paint, chalk, and other contaminants. This effort will not remove all dimension created by partial
removal but will assure only tightly adhered coating remains. This work specifically excludes any
special ground protection or containment.
c. The coating system shall be Tnemec Series 30 Acrylic Spra-saf. This coating is rust inhibitive and
will serve as primer and/or finish and shall be applied in two coats @2.5 DMT each coat for a
minimum total 5.0 DMT.
d. The entire tank shall be painted one color (15131- White, or 11 WH White) as directed by the City.
e. The Denton "Tank Logo"' will be placed on the North side Ina dimension that is suitable for this style
tank. Logo coating shall be Tnemec 10740-color urethane. Logo colors to match the High School
Elevated Tank logo colors.
f Two (2) accent 18-inch wide color accent bands (color to match the tank logo "blue") may applied
around the top and base of the tank on a unit price basis per each, if so directed by the City of Denton.
2. The contractor has requested additional contract time on the High School Elevated due to extended time
necessary to evaluate and perform recommended approach on the highly corroded roof rafters and the
repairs to the pits in the tank floor.
