2008-047sAour documems\ordinances\08\sup ordinance cypress campus s07-0010.doe ORDINANCE NO.; 0264w,-09//l AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ARROVING A SPECIFIC USE PERMIT TO ALLOW A MULTI-FAMILY DEVELOPMENT ON APPROXIMATELY 26.12 ACRES OF LAND, GENERALLY LOCATED AT THE SOUTHWEST CORNER OF MCKINNEY STREET AND MACK DRIVE, AND IS LEGALLY DESCRIBED AS M.T. DOWNING, TRACTS 25 AND 26, W THE CITY OF DENTON, DENTON COUNTY, TEXAS, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE. (507-0010) WHEREAS, Spring Brook Planning Group, has applied for a Specific Use Permit to-allow a multi-family development on approximately 26.12 acres of land, generally located at the southwest corner of McKinney Street and Mack Drive, and is more particularly described in Exhibit "A" attached hereto and made a part hereof by reference (the "Property"); and WHEREAS, on January 9, 2008, the Planning and Zoning Commission concluded a public hearing as required by law, and recommended approval of the requested Specific Use Permit, subject to additional conditions; and WHEREAS, the City Council finds that the change is consistent with the Denton Plan and the Development Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. A Specific Use Permit to allow a multi-family development is hereby approved, subject to the following conditions: 1. The density of the development shall not exceed 14.13 units per acre; 2. The development will conform to the attached site plan, including the arrangement of buildings, parking areas and tree preservation areas, as well as the building elevations, unit numbers, and parking spaces; . 3. A Traffic Impact Analysis be completed, subject to acceptance and approval of the City Engineering Department, and that the findings of this analysis be implemented and incorporated into the development; and 4. All engineering requirements for site development, including drainage, shall be satisfied. SECTION 3. The Specific Use Permit Site Plan attached hereto and incorporated herein as Exhibit "B", is hereby approved for the property described in the caption of this ordinance. SECTION 4. If any provision of this ofdinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other sAour documents\ordinances\08\sup ordinance cypress campus s07-0010.doc provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City ofDenton, Texas, within ten (10) days of the date of its passage.
