ZDO~-Q~j,` AN ORDINANCE OF THE CITY OF DENTON, TEXAS, DESIGNATING THE PROPERTY LOCATED AT 122 NORTH LOCUST STREET AS A HISTORIC LANDMARK UNDER SECTION 35.7.6 OF THE DENTON DEVELOPMENT CODE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Historic Landmark Commission and the Planning and Zoning Commission of the City of Denton have recommended that the property herein described be designated as a historic landmark in the City oCDenton; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The property located at 122 North Locust Street, being more particularly described in Exhibit A attached hereto and incorporated herein by reference (the "Property"), is hereby designated as historic landmark under Section 35.7.6 of the Denton Development Code. SECTION 2. The Property shall be indicated upon the zoning map of the City of Denton as a historic landmark by the letter "H," and the Property shall be subject to all terms, provisions and requirements of Section 35.7.6 of the Denton Development Code and such designation shall be in addition to any other use designation established in the City's zoning ordinance applicable to such property. SECTION 3. Any person violating any provision of this Ordinance shall, upon conviction, be fined a sum not exceeding $2,000. Each day that a provision of this Ordinance is violated shall constitute a separate and distinct offense. SECTION 4. This Ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this Ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage. BEGINNING at the intersection of the East line of Locust Street with the South lines of Oak Street at the Northwest corner of said one, Block 7, Original Townsite of said city, which is also the Northwest comer of a stucco building; THENCE East with the North line of said Lot 1, and the North line of said building on the South line of said Oak Street 86.6 feet to the Northeast corner of said building; THENCE South with the East line of said building 25 feet to the Southeast comer of said building; THENCE West with the South line of said building 25 feet to the Southwest comer on the West line of said Lot 1, and the East line of said Locust Street; THENCE North 25 feet to the place of beginning.
