AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF
FEES CONTAINED IN ORDINANCE 2004-060 BY ADOPTING A NEW PLANNING AND
DEVELOPMENT DEPARTMENT REVIEW FEE SCHEDULE AS AUTHORIZED BY THE
DENTON DEVELOPMENT CODE FOR THE CITY OF DENTON, TEXAS, FOR FILING
APPLICATIONS FOR REVIEW, APPROVAL, AND ISSUANCE OF MUNICIPAL SETTING
DESIGNATIONS (MSDS); PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Denton has been presented with a new
Planning Development Review Fee Schedule which is attached hereto and made a part hereof as
Exhibit "A" (the "Planning Fee Schedule"); and
WHEREAS, the City Council finds that the fees imposed by the Planning Fee Schedule
are in the public interest and do not exceed the reasonable cost to the City in providing the
engineering review of the applicable development applications; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. Ordinance 2004-060 is hereby amended by the adoption of the Planning
Fee Schedule for all purposes and authorized to be imposed for filing applications for review,
approval, grant or issuance of plats, plans, licenses, certificates, variances, special exceptions or
designations required by the subdivision rules and regulations and zoning regulations set forth in
the Denton Development Code.
SECTION 3. This ordinance shall repeal every prior ordinance in conflict herewith, but
only insofar as the portion of such prior ordinance shall be in conflict; and as to all other sections
of the ordinance not in direct conflict herewith, this ordinance shall be and is hereby made
cumulative except as to such prior ordinances or portions thereof as are expressly repealed
hereby.
SECTION 4. If any section, subsection, paragraph, sentence, phrase or word in this
ordinance, or application thereof to any person or circumstance is held invalid by any court of
competent jurisdiction, such holding shall not affect the validity of the remaining portion of this
ordinance, and City Council of the City of Denton, Texas hereby declares it would have enacted
such remaining portions despite any such invalidity.
SECTION 5. This ordinance shall become effective immediately after its passage and
approval./

o All fees must be paid:
• By close of business (5:00 p.m. on the Wednesday preceding the Planning and Zoning Commission meeting at
which the item will be considered
• By 10:00 a.m. on the Tuesday preceding the City Council meeting at which the item will be considered
• By the close of business (5:00 p.m.) on the Monday one week before the Zoning Board of Adjustment meeting
at which the item will be considered
o Exceptions:
• The exception to the above requirement for fee payment is the fee for Engineering Inspection which must be
paid in full prior to the recordation of the plat
