That an election be held in the City of Denton, Texas, on the 30th day of January, 1960, at which election the following propositions shall be submitted: ? 0POSITTON NO. 1 "~hall the City Council of the City of Denton, . Texas, be authorized to issue the bonds of said City in the sum of $2,400,000.00, maturing serially in such stallments as may be fixed by the City Council, the maxi- mmm maturity being not more than Forty (40) years from their date, bearing interest at a rate not to exceed 5~% per annum, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of improving the streets and constructing neoesssmy permanent drainage facilities, as authorized by the Constitution and laws of the State of Texas. Thirty years is estimated as the probable period of usefulness of such improvements." PROPOSITION NO 4 "Shall the City Council of the City of Denton, Texas, be authorized to ~ssue the bonds of said City ~n the amount of 92,600,000 00, maturing serially ~n such in- stallments as may be fixed by the City Council, the mex~- mum maturity being not more than Forty (40) years from their date, bearing ~nterest at a rate not to exceed 5~ per annum, for the purpose of ~mproving and extending the City's Sewer System, to be ~ssued in accordance w~th and secured ~n the manner provided in Articles llll-lll$, both znclusive, of the Revised C~v~l statutes oi Texas, as amended, each bond to be conditioned that the holder thereof shall never have the rzght to demand payment of said obligations out of funds raised or to be raised by taxation, secured by a pledge of the net revenues be issued in accordance with and secured in the manner provided ~n Articles llll-lll$, both inclusive, of the Revised C~vil Statutes of Texas, 1925, as amended, each bond to be con- ditioned that the holder thereof shell never have the right to demand payment of said obligations out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of the C~ty's Electric Light and Power System Thirty years is estimated as the probable per~od of usefulness of such improvements" 2 That sa~d elect~on shall be held at the Municipal Building, within sa~d City and Jewell Sm~h ~s hereby appointed presiding officer and shall be authorized to appoint such assistants as may be neces- sary to properly conduct such elect~on, and sa~d presiding officer shall make due return of the results of such election as provided by law 3 The sa~d election shall be held under the provisions of Chapter l, T~tle 22 of the Revised Civzl Statutes of Texas, 1925, as amended, including the provisions of Article 704, as amended by Chapter passed at the First Called Session of the Forty Fourth Legislature, and only legally qualified electors who own taxable property authorized and directed to have a copy of samd not,ce posted at the Munmc~pat Building and at two other public places within samd City not less than fmfteen days prior to the date f~xed for holding sa~d electmon He shall also cause said notice to be published on the same day in each of two successive weeks in the "Denton Record Chronicle", a newspaper of general clrculstlon published within said City, the date of the iirst publication to be not less than fourteen days prior to the date set for said elect~on Except as otherwise provided in said Article 704, as amended, the manner of holding sa~d elect~on shall be governed by the laws governing general elect~ons 6 Article 9, Sec 9 02 of the C~ty Charter contains the following provision and requires th~s electlon ordinance to distinctly specify "(6) a determ~natzon of the net debt of the City aftez ~ssuance of t~e bond° thereby authorlzed~ together with a declaration that the bonds thereby authorized wzll be within all debt and other hmitatlon~ prescribed by the Constitution and laws of the ~tate of Texas" Artzcle 9, Sec 9 O1 (b) provides that "In no event shall revenue bonds be considered an ~ndebtedness of the C~ty" Therefore no such determznat~on ~s required to include the revenue bonds here~nabove submitted, hence as to the general obligation bonds herein proposed to be submitted the determination ~s hereby made that the
