has heretofore been filed with the Cou~*y Clc~k of Den*on Coun*y,
T~xas, tho county in which tho sa~d Czty of Dontoo ~s sz*uate5,
o~ the 9th day of Feb~y, A D 1960
(c) That said City Council after havzng duly advertzsed
for blds mn the manner as required by law and the Charter of the
Ci*y of Denton, dzd award the contzact for ~ho construction of
said improvements to Public Constructzo~ Company, upon its lewes*
and best bid therefor, and said contract which zs dated Aprzl ll,
1960, has been executed by Public Const~uctzon Co~pany, ann by
the City of Denton, the execution oF which contract by tho C~ty
of Denton was authorized by Resolution h~rotofore on tho llth
day of April, A D 1960, passed by sazd Czt~ Council, and tho
p~rformance bond r~quired by law and said cor~ract has been
properly furnished by said Public Construction Company and approved
by and accepted by the City Council, all as roquzreo by law and
tho Charter of the City of Denton, Texas
(d) That the Czty Council has caused tho Dzroctor of
Public Works to prepare and file ~stzmates of the costs of such
improvements and estimates of the azaount pez front foot to be
assessed against the property abut*ing sazd streets wz*hin the
limits defined, and the real and true owners thereof, and the
Director of Public Works has heretofore on thzs date filed sazd
estimates and a statement of other ~atters relating thereto wzth
sazd City Council, and the same has been recezved, oxamlned and
approved by said City Counczl, and that zn accordance with sazd
states,tnt of estimates so filed by said Dz~ector oS Publmc Works
and herein approved, the amounts of said estzmat~d costs as are
here znafter stated and set out in tho schedule oontained zn Sectmon
2 hereof
~?CTION 2 The written statement and report of *he Director
of Publzc Works heretofore filed wz~h th~ City Council, showzng tho
estimated costs of all the improve~aen*s on each of sazd streets
or Units, within the limits above defined showing *he amounts per
front foot p~oposed to be assessed against the abuttzng property
and the real and true owners thereof, on each of said streets or
Units,, for said improvements, showing the total estimated costs
of sazd zmprovements on each of sazd streets or Unzts proposed to
be assessed against and paid by the abuttzng property and the
real and t~ue owners thereof, showing the total estimated costs
of said improvements on each of said strcots and Unz~s proposed
to be paid by the City of Denton, Texas, and showing other matters
relative thereto, having been received and examined by the City
Council, said report and the estimates therein shown are hereby
in al1 things approved and adopted, and it is heroby £ound and
determined by the City Council that the estzmated amounts o£
the several respective items of costs of the said improvements
as above described on each of said streets or Uni*s are as follows,

~CT.ION 3 A portion of the cost of said improvements
shall bo paid and defrayed by the City of Denton, Texas, and a
portion of the cost thereof shall be assessed against and paid
by the property abutting upon said streets within the limits above
defined, and the real and true owners thereof, in accordance with,
and in the manner provided by the Acts of the 40th Legisla*ure of
the State of Texas, Fzrst Called Session, Chapter 106, known and
shown as Article ll05-b of Vernon~s Annotated Civil Statutes of
Texas, as amended, and the total cost of said zmprovements on each
of said streets or Units as herein above described, shall be and
the same are hereby apportioned by the said parties and shall be
paid and defrayed as follows
(a) The City o£ Denton shall pay all of the cost of drainage
installations wherever located, all of the cost of ex-
cavatlon, base preparation, base and surfacing within
street and alley intersections, thirty-throe and one-
third percent (33 1/3%) of the cos* of excavatzon, base
preparation, base and paving of a street surface thirty
feet in width, and one hundred percent (100%) of the
cost of excavation, base preparatzon, base and surfaczng
for the excess width of paving any street surface over
thirty feet in width where sazd excess wzdth is deemed
by the Director of Public Works of tko City of Denton
to adequately handle present and future traffic needs
(b) The remainder of the costs of such improvements shall
be assessed against tho respective abutting properties
and the real and true owners thereof in accordance with
the City Charter and the Statutes of Texas herein re-
ferred to Such assessments shall be made according
to the "Front-Foot Rule", zn proportion as the frontage
of each parcel of property is to the whole frontage
improved, unless the applica*ion of such rule would,
in the opinion of the City Council, zn particular cases,
result in injustice or znequality, in which cases the
City Council shall apportzon and assess such costs in
such proportions as it may deem jmst and equitable,
having in view the special benefits zn enhanced value
to be received by such parcels of property and the
owners thereof, the equities of such owners, and the
adoustment of such apportionment so as to produce a
substan~tial equality of benefits received and burdens
imposed No assessment shall be made against any
abutting property or the real and true owners thereof
for costs in excess of the benefits to such property
in enhanced val,~e thereof by means of such improvements
(c) The several sums above mentioned and assessed against
said parcels of property and the owners thereof and
interest thereon at the rato of eight per centum (8%)
per annum on the initially deferrec balance, together
with reasonable attorneys' fees and costs of collectmons
if incurred, are hereby declared to be and a~e made a
lien upon the respective parcels of property agaznst
which the same are assessed, and a personal lmability
and charge against the real and true owners of such
property, whether such owner be named herein or not,
and the said liens shall be and constitute the first
enforceable lien and claim against the property on
which such assessments are levied, and shall be a first
and paramount llen thereon, superior to all other lions
and claims except state, county, school district and
city ad valorem taxes
(d) (1) The sums so assessed against the abutting property
and the owners thereof, shall become due and pay-
able as follows, to w~t, in ~hirty-six (36) equal
installments, the first payable on or before thirty
(30) days from the completion and acceptance or
the improvements of th~~ Unzt upon which the property
abuts, and one (1) each month thereafter until the
total amount is paid, deferred payments shall bear
interest from the date of such coc~pletion ane
acceptance at the rate of ezght per centum (8%)
pe~ annum on the initially deferred balance, payable
monthly with each installment, so that upon the
completion and acceptance of the zmprovements
a particular Unit, assessments against such com-
pleted and accepted Unit shall become due and
payable in such installments, and with interest
from the date of such completion and acceptance
(2) Provided, however, that aoy owner shall have tho
right to pay the entire assessment, or any
stallment thereof, before maturity, by payment of
principal and accrued interest, and further pro-
vided that if default shall be made in the payraent
of shy installment of prz~clpal or ioterest promptly
as same matures, the~ *he entire amount of the
assessment upon which such default is mad~ shall,
at the option of the City of Denton, or zts assigns,
be and become immodxatoly due and payable, and shall
be collectable, together with reasonable attorneys,
fees and costs of collection, if incurred
(e) The assessed portion of the cost of such improvements
may be further secured by Mechanzc's Iiens to be ex®cute~
in favor of the City of Denton, but Certifzcates of
Special Assessment shall be issuee in favor of tho C~ty
of Denton, whether the owners have executed such Mechan~c,s
Liens or not
SEC,T_I~N 4 A hearing shall b~ hold and g~ven to the real
and t~ue owners of, a~d all owning or claiming any i~terest in a~y
property abutting upoo sai~ streets o~ Units within the limits
above' defined, an~ to all othe~s owning, claiming or interested
said property or any of said matters, as to the assessments a~d as
to the amount to be assessed against each parcel of abutting property,
and the real and true owners thereof, a~d as to the special benefits,
if any, to said property to be received from said zmprovements,
and concerning any error, znvalid~ty, irregulari*y or ooficiency
in any proceedings or contract with reference *hereto or con-
cerni~ng any matter or thing connected therewith, which hearing
shall be held by the City Comncil of D~n*o~, Texas, in the Council
Chamber of the Municipal Building of the City of Den*on, Texas,
at l0 O0 o~clock A M , on the 10th day of May, 1960, at which
*ime and place all persons, firms, corporations or estates owning
or claiming any such abutting properly, or any in*eros* therein,
and their agents or attorneys, and persons in*eros*sd in said
proceedzngs, shall be notified to appear and to be heard in
person, or by counsel, and may offer evidence, and sazd hearing
may be adjourned from day to day and from time to time and kept
open, until all evidence and protes*s have been duly offered and
heard, and the City Manager of the City of Denton, T~xas, is
hereby directed to give notice of said hearing by publzca*ion
of Notice in some newspaper of general circulation in the City
of Denton, Texas, said Notice shall bo published at least three
(3) times in said newspaper before the date set for said hearzng,
*he first of which publications shall be at least *eh (10) days prior
*o the date of said hearing, and such notice by publication shall
be valid and suffzcient, without any further form or charac*er of
notice, as provided for by and in accordance with *he terms and
provisions of said Chap*er 106 of the Ac*s of the Firs* Called
Session of the 40th Legislature of the State of Texas, known as
Article llO~-b of the Revised Civil Statutes of Texas, as amended,
however, the said City Manager may, in addition to the contents
of the Notice of said hearing, as requzred by law and the Charter
of said Cz*y, which shall be for all purposes valid and sufficient
in itself, include zn any one or all of *he publzca*ions of said
Notice such l~urther data and information regarding such proposed
imp~ovements and assessments as the Czty Manager may deem proper
and such general statement in connectzon therewith as the
City Manager may desire, to acquamnt ~hose *o whom *he Notice is
directed with the facts and mat*ers concerning said improvements,
assessments and hearing The form of said Notice, as required
by law and said Cha~ter, ~having been h~retofore submitted to
the City Council by the City Manager, same is hereby approved
for publication
~ Following such hearing as above provided,
assessments will be levied against saie abutting property, and
the real and true owners thereof for that portion of the costs
of said improvements heretnabove determined to be payable by
said abutting property and the real and true owners thereof,
which assessments shall be a first and przor lien upon said abutting
property and a personal liability and charge against the real and
true owners thereof In levying said assessments, if the name
of the owner be unknown, it shall be sufficient to so state the
fact, and if said abutting property be owned by an estate or by
any Firm or corporation, it shall be sufficient to so state the
fact, and it shall be unnecessary to gzve the correct name of
any such owner and no error or mistake in attemptzng to name such
owner or in describing any of said property shall invalidate any
assessment or certificate issued in evidence thereof, but never-
theless, the real and true owners of said abutting property shall
be liable and the assessment against said abutting property shall
be valid whether or not such owner be named, or correctly named,
or said property correctly described therezn
SECTION 6 The construction and installation of the im-
provements herein ordered in each Street Unit herein designated
and described shall be separate and independent of the construction
and installation of such improvements zn each and every other
Street Unit The assessments to be levied for the i~provements
in each Street Unzt shall be separate and distinct from the
assessments to be levied in every other Street Unit, and in making
and levying assessments against proper*y for the improvements in
one Unit, no material or substance in connection with any other
Unit shall be considered, all as fully and to the same extent
as if separate contracts were execute5 and separate proceedings had
with reference to each such Stree* Unit or port,on of street
