Texas, ~f .~he enactment of sAi~ above desc~ibe~ o~l~ has heP~ofoPe bee~ filed with the O~nty ~ePk of Denton ~Oounty, Texas, the County in which said O$~y of Denton Is s~t~ated on the 9th day of AiD. 1960. o) T t said Oi~ Oouncil afto~ havi~g a~ve~tise~ for bfds ig the ,~nne~ as ~oquired by law and by tho Oha~tor Of said City, did awamd the contract for the construction of said improvements to Public Construction Company, upon its lowest and best bid therefor and said contract, which is dated April 11, 1960, has been executed by said Public Construction Company and by the City of Denton; and the pe~fo~anee bond ~equired by law and by said contract has been p~ope~ly ~nished by the said ~blic Const~ctien Company. (d) That the 0ity C~neil caused the Directo~ of ~blic Wo~ks to p~ep~e and file esti~tes of the costs of such i~oveme~s and estimates of the ~ount per f~ont foot proposed te be assessed against the p~operty abut- ting each of said streets within the limits defined, ~d against the ~e~ amd t~e owners thereof. (e) ~at upon the filing of said estimates the City Council did by o~din~oe duly enacted on April 12, 1960, p~ovide for and orde~ a hearing to be held at 10:00 o~cloek A.M. on the 10th day of May, 1960, in the Council Ch~be~ of the Municipal ~ilding of Denton, Texas, at which ti~ amd place all persons, fi~, corporations amd estates owning or claiming amy such abutting prope~y, or ~y imte~st the~eim, ~d thei~ agents and attorneys, ~d all othe~ pe~soms imterested therein, were to appe~ and be heard in pe~son or by counsel; and such o~dinance directed the City M~ager to give due notice of such hea~ing in the m~me~ required by law. (f) That afte~ due pmblioation of notice as ~e~ired by law, ~d on the 10th day of May, 1960, at 10:00 A.M., sai~ hea~lng was opened and held in accordance with said O~din~ce and Notice, at which time amd place an opportunity was given to all of ~e above mentioned p~ties amd agents and attorneys te be he~d ~and to offer evidence as to ~1 ~tte~s ia second,ce with said O~dtnanoe ~d Notice, at which time the following appe~ed and testified as follows: (1) 1~. Calls_hun, Director of Public Works of ~he ~=~y or Denton, described certain omissions, errors and m~st~es ~n the P~oJect ~~ and the ~ed~vldual Street Units and he was ~[~ected by the Council to give notic~ ~ the afFeete~ p~ope~ty owners of the omissions, mlst~es, to co~ect the s~e a~d to give notice to the ~fected property owners of the continua~ce of the public he~tng until May ~, 1960, at which tt~ they would be heard as to such co~ec- tions. (3) ~J.a S. ~assen testified that he was ve~ a~tous ro~ m~e improvements to be ~de ~d inquire~ whem the p~oJect would begin. (4) C. L. McLeod inquired as to where E~le D~lve w~l~ be ~aved, said street not being a pa~t of this assessment p~og~. (5) Po~te~ B~ockett inqui~ed as to whethe~ curb ~c. ~e~ wOUld be installed at pvope~y line. ~o~ being told that it would not M~. B~ockett entePed ~o p~otest. Pitts agreed to negotiate with the Di~ecto~ of ~bltc Works for a satts- facto~ solution of this p~oblem. After due notice of the co~ections, errors and mistakes in the o~igtnallP~oJect Summamy and Street Unit lists, the Public Hea~i~g commenced on the 10th day of May, A.D. 1960 at 10:00 A.M. was re-opened at 10:00 A.M. on May 24, 1960, at which time the following appeared and testified as follows: (1) Mms~.. (4) F. ~.~Call~an, D~ector of ~blic Wo~ks of the Gx~"o['~S~oa, testified that ~1 prope~y owners ~feeted by additions, comreetions amd changes in the Project S=~y and individual Street Units had been notified by certified ~il of the additions, corrections amd changes; p~ope~ty owners im eve~ Street Unit wo~ benefit f~om the p~oposed i~ove~nts ~e th~ the oest proposed to be assessed. The M~or then asked if the~e were any othe~ p~ties pre- sent who desired to be heard on ~y ~tter in connection with the ~ovements unde~ consideration, but the~e being no othe~ persons p~esent who wished to be he~d at smch hea~img, the Mayor ~n~nced that the hea~ing was eonti~ed until May 31, 1960, at 8:00A.M. Thee ~Publie Hearing commenced o9 the 10th day of May,~ A.D. 1~60 at 10:00 A.M. was re-opened at 8:00 A.M. on May 31, 1960, at which time the Mayor asked if there were any other pa~ties present who desired to be he~d on any ~ter im eo~eotiom with the i~ovements undev eo~r ai~e~ation, but the~e being no othe~ perso~ presen~ who wished to be heard at such heaving; the C~ncil by ~tion declared the he~img closed and directed the City Attorney to p~ep~e am ePdim~ce ~nco~orating the findings of the O~mCll hereinafter set out. (g) T~% the ~ity G~neil has heard all parties who appeared and desired to testiS, object o~ protest as to the ~pecial benefits im e~ced value to acc~e to said~ abutting p~operty and the real and t~ue owners thereof as compared with the portion of the cost of const~uoting said improvements proposed to be assessed against said ab*string property, and has heard all parties appearing a~d offering testimony, together with all objections and protests relative to such matters and relative to any~rors, invalldities or Irregularities in any of the proceedings an8 contract for said improvements, and has given a Dali and fair hea~ing to all parties making or desiring to maw® any such protest or objection or to offer testimony, smd has Dally examined and con- side.ed all of said evetdence, matters, testimony and objections offered. (~) That said ~ity Council did consider and correct all errors, invaliditles o~ deficiencies called to its attention and Bid find that all proceedings and contracts were Droper e~ in accordance with the laws under which s~me are being had and with the directives of said City Council in reference to smch improvements, and that all of same are in all respects valid and regular. (,i) That based on the evidence, matters, testimony and ob- Jections consi~ered at such hearing the said City Council has dete~mined that the p~cpe~ties, and each and every pa~eel of such property abutting upon the streets and Units as hereinafter set out, will be e~hanced in value an~ specially benefited by the construction of such imp~ovements in an amount in excess of the amount of the east of such improvements p~oposed to be, and as herein- after, assessed against each of said parcels of property, abutting upon said streets, and the real and t~ue owners thereof. (~) That said City Council has adopted the Front Foot Plan or ~mle of apportionment and division of the cesta of said improvements between said abutting properties and the real and true owners thereof herein set forth and has fro/nd the same to be ~ust ~nd equltable and to pmoduce substa~tial eque/lty ~onside~tn~ the benefits to be received and th~ burdens imposed thereb~ and said Council has further found upon the ev~denee considered that the assessments hereinafter made and the charges hemeby declared against said abutting p~opel~ies and the meal and t~ae owners thereof ~e Just and equitable, and tBat ~1 objections ~d p~otests should be ove~led and denied. ~C,TION a. ~he~e belnS ac ~them p~otests o~ tear.ay o~ aEainst o~ ta ~efe~enee to said improvements, benefits o~ pmo- ceedi~s, said he. Texas. has heretofore by Ordinance No. 60-05 duly enacted on February 9, 1960, determined the necessity for and ordered the improvement of Houston Place, in the City of Denton, Texas, in the manner and according to the plans and specification? therefore, which plans and spe~.ifications have heretofore been approved and adopted by said City Council; and . ~ WHEREAS, a notice duly executed in the name of the City of Denton, Texas, of the enactment of the said above described ordinance has heretofore been filed in the Mortgage Records of Denton County, Texas, in Volume 206, Page 358; and WHEREAS, the City Council of the City of Denton, Texas, by Ordinance No. 60-23, duly enacted on the 14'" day of June, 1960, declared the liability of the adjacent 'property owners for a portion of the cost of improving portions of various streets described therein, including Houston Place, and declared the same to be a lien upon the said abutting properties; and .' Barber, was shown to be specially assessed in [he amount of Five Hundred Seventy-five Dollars and 06/100 ($575.06); and WHEREAS, the propetTy owner's share of the cost of improving Lot 1, Block 5, being commonly known as 1125 Ector Street in the City of Denton, Denton County, Texas, is Five Hundred Seventy-five and 06/100 ($575.06) plus lawful interest due [hereupon; NOW, THEREFORE, In consideration of [he full payment by the said Title Resources, [o the City of Denton, Texas, of the remaining assessed amount plus lawful interest [hereon in the amount of "Two Thousand, Six Hundred Seventy-nine Dollars and 43/100 ($2,679.43) (Account No. R21946), the receipt of which is hereby acknowledged, the said City of Denton, Texas, does hereby forever RELEASE AND DISCHARGE the said W.B. Barber, his heirs, administrators, executors, successors and assigns, and the above-described real property, from any and all special assessment liens and claims arising by virtue of [he improvements to 1125 Ector Street in the City of Denton, Texas, described in the aforesaid ordinances by the City Council of said City, and in [he aforesaid notice recorded ut Volume 206, Page 358 of the Deed Records of Denton County, Texas.
