AN ORDINANCE AMENDING THE ZONING AND USE DISTRICT
MAP OF THE CITY OF DENTON, TEXAS, AS IT APPLIES TO
CERTAIN PROPERTY AT THE INTERSECTION OF BERNARD
S~REET AND INTERSTATE ~HIGHWAY NO~. 35E, AND MORE
P~ARTICI~LARLY DESCRIBED HEREIN, SO AS TO REMOVE THE
SAID PROPERTY FROM THE DWELLING DISTRICT; PLACING
THE SAME IN THE BUSINESS DISTRICT; AND DECLARING
AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. That the Zoning and Use District Map of the
City of Denton, Texas, be amended as follows:
All that certain lot, tract or parcel of land
lying and being situated in the City and County
of Denton, State of Texas, and being a part of
a certain 10.366 acre tract of land as conveyed
by Warranty Deed, dated September 3, 1959, from
Wylie H. Barnes and wife, Ruby Barnes, to R. H.
Turnbull and wife, Violet Turnbull, as shown
of record in Volume 449, page 628, of the Deed
Records of Denton County, Texas, and being out
of the ANB TSkins Smrvey, Ab. stract No. 1246,
Denton County, Texas, and being more particu-
larly described as follows:
BEGINNING at a steel pin in the North Boundary
Line of Willowwood Street and in the West Boundary
Line of Bernard Street, and being the Southeast
corner of the past mentioned 10. 366 acre tract
of land;
THENCE North 00' 211 East, along the East Boundary
Line of the above mentioned tract, same being the
West Boundary line of Bernard Street, 271 81 feet,
to a steel pin for ~orner; said corner being the
most Southern corner of a certain 1.091 acre tract
of land as conveyed ,by right-of-way deed, dated
July 8, 1948, from W. H. Barnes and wife, Ruby
Barnes, to the State of Texas, for highway purposes,
said corner also being the most Eastern Northeast
corner of the past mentioned 10.366 acre tract of
land;
THENCE North 35e 441 West, along the Southwesterly
Boundary Line of said 1.091 acre tract a distance
of 130.4 feet, to a~ steel pipe for corner of the
above mentioned tract, and being in the Southwest-
erly Boundary Line of U. S. Highway No. 77 (now
designated as IH 35E);
THENCE North 47° 45' West, along the Southwesterly
Boundary Line of said 1.091 acre tract, same being
the Southwesterly Bounda y Line of Highway No 77
the past
and the Northeasterly Boundary Line of
mentioned 10.366 acre tract, 40 feet, to a point
for corner;
THE~CE South 40o 34' ~3" West 260.00 feet, to a
point fer corner;
THENCE South 00e 21' West, 207.06 feet, to a point
for corner in the North Boundary Line of Willow-
wgod Street, same being in the South Boundary Line of
the past mentioned 10~.366 acre tract,
THENCE East, along the North Boundary Line of Willow-
wood Street and the South Boundary Line of the past
mentioned 10.366 acre tract, 274.49 feet, to point
of beginning and containing in all, 2 02 acres of land.
SECTION 2_. The City Council of the City of Denton, Texas,
hereby finds that such change is in accordance with a comprehen-
sive plan fo~' the purpose of promoting the general welfare of
the City of Denton, and with reasonable consideration, among
other things, for the character of the district and for its
peculiar suitability for particular uses, and with a view to
conserving the value of buildings and encouraging the most
appropriate use of such land for the maximum benefit to the
City of Denton, Texas, and its citizens.
SECTION 3... That this ordinance shall be in full force
and effect immediately after its passage and approval, the
required public hearings having heretofore been held by the
Planning and Zoning Commission and the City Council
