1961-009 AN ORDINANCE AMENDING THE ZONING AND USE DISTRICT MAP OF THE
0ITY OF DENTON, TEXA~, AS IT APPLIES TO CERTAIN PROPERTY AT
T~E INTERSECTION OF ~ENARD STRUT AND U S. HIGHWAY 35-E,
~D MORE PARTICULARLY DESCR~W.D HEREIN, SO AS TO REMOVE THE
SAID PROPERTY FROM TEE DWELLING DISTRICT; PLAOING THE SAME
IN THE NUSINESS DISTRICT; AND DECLARING AN EFFEOTIVE DATE.
THE GOUNOIL OF THE CITY OF DENTON HEREBY ORDAINS:
SE.CTION. 1. That the Zoning and Use District Map of the Oity of Denton,
Texas, be ~mended as follows:
Ail of the hereLuafter described property is hereby
removed from the Dwelling District as shown on said map,
and all provisions of the Zoning Ordinance of the City of
Denton and the Zoning Map shall hereafter apply to said
property as Business District property and as other prop-
erty located in a Business Distrmct:
Part of the Alex. Hill Survey, Abstract 423 in Denton County,
Texas, and beginning at ~he ~ntersectmon of the East boundary
line of Bernard Street and the South boundary line of U. S.
Highway 35-E, the same marked by Hight-of-way Post;
THENOE with the East boundary line of Bernard, South a dis-
tance of 148.3 feet, an iron pin for corner;
THENCE East on a call South 89° 09' East a distance of 145.4
feet, an iron pin for corner;
THENCE North 81 feet, a point in the South boundary line of
U. S. Highway 35-E;
THENOE along the South boundary line of said highway in a
Northwesterly direction (call N. 64° 22' W) 160.44 feet, more
or less, to the place of beginning.
SECTION 2. The City Council of the Oity of Denton, Texas, hereby finds
that such change is in accordance with a comprehensive plan for the purpose
of promoting the general welfare of the City of Denton, and with reasonable
consideration, among other things, for the character of the district and for
its peculiar suitability for particular uses, and with a view to conserving
the value of buildings and encouraging the most appropriate use of such land
for the maximum benefit to the City of Denton, Texas, and its citizens.
SECTION 3' That this ordinance shall be in full force and effect
immediately after its passage and approval, the required public hearings
having heretofore been held hy the Planning and Zoning Commission and the
City Oouncil.
